About this file

This is a Questions and Answers document for solicitation SP4500-25-R-0001 regarding hazardous waste removal services in the Azores, Portugal. The document addresses 13 contractor questions covering key topics including deadline extensions, pricing currency, manifest requirements, and operational timelines.

Key clarifications include: the submission deadline has been extended to January 17, 2025; pricing must be in USD despite European location; contractors must provide both Portuguese and English language manifests; contract start date is April 1st; contractors must provide their own forklifts and scales; anti-terrorism training requirements will be determined by Installation Security; and several timeline requirements can be adjusted if necessary (including extending the 15-day manifest return requirement to 15 business days, the 15-day sampling analysis to 20 business days, and the 25-day supply delivery requirement to 30 business days). The document also clarifies there is no expedited CLIN in the price sheet, and contractors must comply with both Portuguese law and U.S. DoD documentation requirements.

1. Is it possible to extend the submission date by four weeks? Due to Christmas and New Year, the processing time is extremely limited. Yes, the new closing date will be 17 January 2025.

1. The price list is in US dollars. The contract is in Europe, we are a European company and normally always invoice DLA in euros. HW Generators and other U.S. DoD personnel around the world have requested contract pricing in USD for years because they must make currency conversions in the ordering systems with every TO, and the conversion rates change daily. Several DLA representatives met in person with industry leaders in Europe (July 2023) and asked if they would be prepared to bid on DLA HW Disposal contracts in USD. Those industry leaders who were asked ultimately said, “Yes, we can do that”.

1. 1.1.2 – Attachments 9 & 16 seem to apply only to the CONUS area. By Portuguese law, only electronic manifests are available for this order. DLA understands and requires the Contractor to perform IAW Portugal laws. However, U.S. DoD personnel, including DLA CORs and Manifest Trackers must (for audit purposes) receive manifests written in English or bilingual. Per Section 1.1.2, “If bilingual manifests are not authorized or available, the Contractor shall prepare separate Portuguese and English versions of the manifest documents reflecting equivalent information and submit both versions to the USG wherever provision of shipping documents is required under this contract, including invoicing for payment per Section 8.1.” This may require additional work for the Contractor, but this requirement is non-negotiable under all non-U.S. contracts.

1. 3.1 – Regarding Clin's 1074RE & 1075RE, the Air Force has its own ISO containers. Unless the DLA representative misunderstood during the requirements meeting, the Generator expressed a requirement for these CLINs in the new contract. The Generator also approved of the PWS in their review. Offerors providing bids under this solicitation should provide firm, fixed pricing for these services as written in Sections 3.1 and 3.2 of the PWS.

1. The new contract will start on April 1st? Yes

1. 1.1.1 a & 3.15 – For the Management Service, professionals need to be hired for only 1.5 years. They are very difficult to find. DLA understands it might be difficult for our Contractors to hire qualified employees for a short-term duration. However, provision of these services under DLA HW disposal contracts will end on or about 30 Sep 26, upon completion of the final issued Task Order.

1. 1.1.1 b – Anti-terrorism training (AT) is mandatory for almost everyone, even truck drivers. What level is required? The level of AT training required of Contractor personnel performing work under this contract will be determined and established by the Installation Security Office and the Installation Environmental Office. These requirements may vary with changing force protection conditions.

1. 1.2.4 The contractor must provide their own forklift and calibrated scales? Per 1.2.6.b., “The Contractor is responsible for loading and furnishing all equipment appropriate for the safe and efficient loading of containers, totes, and pallets. Such equipment will include a lift gate on the conveyance vehicle and/or a forklift or pallet jack as appropriate for the job. The Contractor should never assume Material Handling Equipment (MHE) will be provided by the USG. The USG will not block, chock, brace, lash, band, or in any other manner, secure the cargo on such conveyance vehicles furnished by the Contractor.” Per 1.2.7a., USG scales will be used when available, operable, and authorized by the USG. Offerors providing bids under this solicitation should provide firm, fixed pricing based on the assumption the Contractor will provide the scales, forklift, and forklift driver.

1. 1.3.1 e – There are only digital manifests without signature according to Portuguese law. Refer to DLA response to question (3) above. Digitally generated Portuguese manifests are accepted in addition to the required English language manifests.

1. 1.2.11 & 7.1 – There is not Expedited Clin in the Price sheet. That is correct. A requirement for expedited services is not anticipated under this contract. Language in the PWS related to expedited services can be disregarded unless and until such service requirements are added via contract modification after the contract award.

1. 1.3.1 – The return Manifests can be released weeks after the loading , because Lajes is on an Island far away from Mainland. Per 1.3.1.e., “Within 15 calendar days following delivery of the waste to the final disposal facility, the Contractor shall provide to the COR a copy of the manifest(s) and other shipping documents, signed by a principal representative of the final TSDF.” This requirement doesn’t restrict how long it takes for the waste to ship to the final TSDF. It only requires the return manifest be provided to the COR within 15 calendar days after it arrives. DLA can change this requirement to 15 business days if the Offeror(s) state it is necessary and sufficient.

1. 3.11 – The results of sampling are not available within 15 days. Some samples are not possible to send by Aircraft. Per 3.11.e., (with formatting change), The Contractor will perform the analysis and provide a complete analytical report to the COR within 15 business days following issuance of a written TO per Section 7.0, unless otherwise stated in the contract. The first full business day following issuance of a written TO will constitute Day 1. DLA can change this requirement to 20 business days if the Offer(s) state it is necessary and sufficient.

1. 7.0 c – Delivery of supplies are not possible within 25 Days, because they must be transported by ship. Per 7.0.c., “The standard time to provide containers and other supplies ordered under Supply CLINs is 25 business days, unless specified elsewhere in this contract. Supplies shall be delivered to a pre-determined location in the presence of a USG representative from the procuring installation by COB on the last day of the required performance time. The USG representative shall oversee the delivery of supplies and conduct an inventory of the delivered items against those ordered on the TO. Discrepancies will be annotated on the written TO and a TO modification will be issued as applicable. DLA can change this requirement to 30 business days if the Offer(s) state it is necessary and sufficient.
