About this file
This is Standard Form 30 (SF30) which documents an amendment to solicitation SP0602-25-R0700 for bulk petroleum products under the Foreign Military Sales program. The amendment makes administrative changes to three sections: General Solicitation Notes, Contract Administrative Data, and Evaluation Factors for Award.
Key changes include requirements that refineries must provide safe berths accessible to commercial vessels with direct pipeline loading (barge transfers not acceptable), updated procedures for invoice submissions including electronic, mail, fax and courier options to DLA Energy's Fort Belvoir office, and clarified evaluation criteria specifying that awards will be made on a lowest laid-down price basis including transportation costs. The evaluation will use fixed price with economic price adjustment contracts, considering variables like fuel types, quantities, shipping locations using nominal 30,000 DWT US-flag tankers. The JP8 and EN590 diesel fuel requirements will be awarded on an all-or-none basis to the lowest priced technically acceptable offeror, with preference given first to US firms with US refinery sources, then non-US firms with US refinery sources, and finally to firms with non-US refinery sources.

(3) INVOICING FOR DETENTION/DEMURRAGE COSTS. Invoices for detention/demurrage costs will be submitted by the Contractor directly to the Contracting Officer.
3. SECTION M – EVALUATION FACTORS FOR AWARD:
a.) FACTOR 2: PRICE:
Fixed Price with Economic Price Adjustment (EPA) contracts will result from this solicitation. The Contract Team will evaluate proposals for pricing purposes in accordance with 52.212-2 – COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES (NOV 2021)
The lowest price is defined as the lowest laid-down price, to include transportation costs, as determined by an evaluation spreadsheet which will provide the basis for award. Numerous variables will be analyzed using the spreadsheet. These variables include the offeror’s proposed prices, fuel types, evaluation factors, award quantities, shipping locations, and customer receipt location. Transportation rates will be included for tanker delivery in accordance with [M24.03-1.100 (12 2024) EVALUATION OF OFFERS INVOLVING F.O.B.TANKER LOADING (FMS) (DLA ENERGY NOV 2003).]
The evaluation spreadsheet will be used to calculate the overall pattern of delivery of fuel from contractor facilities to specific customer location(s) that represents the lowest total combination of price for product and transportation.
The Turbine Fuel, Aviation (JP8) and Diesel Fuel Oil (EN590) requirement will be awarded on an all or none basis to the lowest priced, technically acceptable offeror.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, electronically mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
b.) M24.03-1.100 (12 2024) EVALUATION OF OFFERS INVOLVING F.O.B. TANKER
LOADING (FMS) (DLA ENERGY NOV 2003)
(a) Transportation will be considered in the evaluation of all origin offers unless the solicitation specifically indicates otherwise in the Schedule. The transportation rate will be based on a nominal size U.S.-flag tanker of approximately 30,000 Deadweight Tons (DWTs) and will be inclusive of time charter hire. The Time Charter Hire will be the U.S.-flag time charter arranged by the U.S.
government. This evaluation rate will be the daily rate for U.S.-flag time charter cost inclusive of fuel. DLA Energy will use the evaluation rate along with round trip mileage over the tanker route to the required location being evaluated to compute a transportation rate expressed in U.S. cents per gallon. This rate will then be added to the per gallon offered price to determine the evaluated price.
(b) The Government will award on the basis of the lowest acceptable, responsible offer received for each item, with a preference given to offerors in the following order:
(1) Lowest acceptable, responsible offer received from a U.S. firm with a U.S. refinery source.
(2) Lowest acceptable, responsible offer received from a non-U.S. firm with a U.S. refinery source.
(3) Lowest acceptable, responsible offer received from a U.S. or non-U.S. firm with a non-U.S.
refinery source.
c. A conformed copy of the solicitation with these changes will be posted to SAM.gov.
d. All other terms and conditions remained unchanged
