The bidder shall furnish a bid guarantee in the form of a firm commitment, bid bond supported by good and sufficient surety or sureties (b) e.g., acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. To unsuccessful bidders as soon as practicable after the opening of bids; and(1)

Section 00 21 13 - Instructions to Bidders
1.0 BID SUBMISSION, PREPARATION INSTRUCTIONS, AND CONTENT
These instructions are designed to ensure the submission of necessary information to provide clear understanding and the comprehensive evaluation of bids. In the Sealed Bidding procedures, price will determine the "Apparent Low Bid;" however, the submission of a low bid does not in and of itself determine responsibility of a bidder or a fair and reasonable price. Therefore, it is necessary to require additional information in order that the Contracting Officer may make an award to the lowest, overall priced, responsive, and responsible bidder.
2.0 BID SUBMISSION
2.1. INSTRUCTIONS
a. Bids shall be submitted prior to 1:00 PM (PDT) on Thursday, 18 September 2025 as identified on block 13 of the Standard Form (SF) 1442, as follows: One (1) digital/electronic copy shall be mailed electronically to Mr. Manuel E. Rosas at manuel.e.rosas.civ@army.mil with W911S825BA017 McChord Field Outrigger Installation
b. No other means of submission is allowed.
c. Bidders must be registered in the System for Award Management (SAM) database (https://www.sam.gov), with NAICS code 238990, Fencing, Fences, Gates and Components in order to be considered for award. ,
d. Any bid, modification, or revision, received after the exact time specified for receipt of bids will be considered late and will not be considered.
Late bids will be processed as indicated in FAR Part 14.304.
e. The CS is the sole point of contact for this procurement. Address all questions or concerns regarding this solicitation, in writing, to the CS.
Please, identify the applicable Statement of Work (SOW) paragraph number or solicitation reference with each question. The deadline for submission of questions is Tuesday, 2 September 2025 at 2:00 PM (PDT).
2.2. BID OPENING
The Government will host a public bid opening on Thursday, 18 September 2020 at 2:30 PM (PDT), which will be held at Building 100 Col Joe Jackson BLVD, Suite 2001, JBLM-McChord Field, WA 98438. Due to the established protocols to provide teleconferencing services, the Government intends to publish further instructions 72-96 hours prior to the stated bid closing time/date, which will include the teleconference number and specific relevant details of that process. Should the solicitation period need to be extended, referenced instructions will be provided 72-96 hours prior to the new bid closing time/date.
3.0 General Instructions
3.1. The basis of award for this requirement is price and price-related factors IAW FAR 14.101(e). Noncompliance with the Invitation for Bids (IFB) requirements may hamper the Government's ability to properly evaluate the bid and dim the bid to be non-responsive and may be grounds to eliminate the bid from further consideration for contract award.
3.2 CLIN0001AB is an additive CLIN. This additive may or may not be awarded depending on the funding availability at the time of award of CLIN 0001AA. CLIN 0001AB is the installation of double outriggers and six strand of barbed wire in lieu of single strand outriggers and three strand barbed wire as specified in CLIN0001AA.
3.3. Submission of the documentation specified below will constitute the Bidder's acceptance of the terms and conditions of the IFB, concurrence with the SOW and contract type.
3.4. It is the Government's intention to award without discussions IAW FAR sub-part 14.404-1(e) and (f). Bidders are, therefore, encouraged to present their best prices in their bid submission. However, the Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
3.5. Instructions outlined in paragraph 4 below prescribe the format for the bid submission and describe the approach for the development and presentation of bid data.
3.6. If a Bidder believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise deemed unsound, the Bidder shall immediately notify the CS in writing with supporting rationale. The Bidder is reminded that the Government reserves the right to award this effort based on the bid, as received, without discussion.
3.7. In accordance with FAR Subpart 4.8 - Government Contract Files, the Government will retain all copies of unsuccessful bids in the contract file.
3.8. All referenced documents for this solicitation are available on the new Government Point of Entry, SAM at https://sam.gov and selecting "Contracting" on the landing page.
4.0 CONTENT - PREPARATION INSTRUCTIONS
4.1. BID PACKAGE FORMAT
All bids are due no later than the date and time specified in Block 13 A of the SF1442. No bid will be accepted if received after this date and time.
Offerors shall submit their bids in Adobe Portable Document (PDF), Microsoft Word, or Microsoft Excel format. PDF files shall be searchable and shall allow the Government to copy and paste as text to another document.
4.2. BID CONTENT
a. This section shall be clearly marked "IFB DOCUMENTS W911S825BA017." IFB documents shall contain a signed copy of all documents requiring the bidder's signature. Bids shall include the required information in the items below.
1) On company letterhead, signed by an officer of the company, provide the following details:
(a) authorized representative(s), along with title(s), telephone number(s) and e-mail address(es), who can obligate your company contractually, with any dollar amount limits per person, sign the bid, and sign other contract actions. The letter must also acknowledge the acceptance period of 60 calendar days as stated in block 13 of the SF1442;
(b) Contractor/Bidder, UEI number, CAGE Code, and Tax ID number and mailing address;
(c) Physical address, if different than mailing address;
(d) Discount Terms, if any;
(e) Signature of Bidder (original wet or digital signature required);
(f) Printed name and title of signer; and
(g) Date signed.
2) Executive Summary. The purpose of this portion is to present the Government a clear and concise introduction to the Bidder, including significant risks, and highlight any key or unique features, excluding price. This should be a "big picture" explanation and provide the Bidder's overall approach and supporting rationale for the performance of the contract's requirements.
3) If joint venture, the Bidder must provide:
A signed SF1442 by the primary member of the joint venture and a Corporate Certificate unless a written agreement by the joint venture is furnished with the bid designating one firm with the authority to bind the other member(s) of the joint venture. Additionally, the Bidder shall submit a copy of the joint venture agreement with the bid. Failure to comply with the foregoing requirements may eliminate the Bidder from further consideration. The SBA must receive the joint venture agreement prior to the bid due time/date and approved before award of any resulting contract.
If a Bidder is contemplating a joint venture on this procurement, it must advise its assigned SBA Business Opportunity Specialist (BOS) as soon as possible. It is also recommended that the agreement be submitted as soon as practicable to ensure compliance with established regulations. Any corrections and/or changes needed can be made only when the BOS has adequate time for a thorough review before the bid due time/date.
4) Bid Bond Guarantee. In accordance with FAR sub-part 28.101-2(b), Bidders are required to submit evidence of guarantee as specified in FAR clause 52.228-1. Signed bid bond shall be included with the electronic bid and the original shall be mailed separately via United States Postal Service. The bid package shall include evidence of the bid bond mailing (e.g. certified mail receipt). Failure to provide this documentation will render a bid ineligible for consideration and contract award.
5) Signed authorization letter addressed to the Bidder's financial institution authorizing the Contracting Officer, or designated alternate, to discuss the Bidder's financial history and liquidity.
b. STANDARD FORM (SF) 1442, SOLICITATION OFFER AND AWARD & ACKNOWLEDGEMENT OF AMENDMENTS
The SF1442 shall be submitted fully completed; pages 1-2 of IFB W911S825BA016. The Bidder shall acknowledge any amendments to the IFB in accordance with the instructions on the SF1442. All Bidders are cautioned to complete blocks 20a - 20c with an original wet or digital signature in block 20b.
c. BID SCHEDULE Bidders shall enter their bid price in the Bid Schedule found at Section 00 01 00 of the SF1442.
d. RESPONSIVENESS Bids received with incomplete or missing documentation will be considered non-responsive and may be removed from consideration for contract award.
BASIS FOR AWARD
1.0 The Government will award a single firm fixed-price contract, within the time for acceptance specified in the solicitation, to the responsive and responsible offeror whose bid will be most advantageous to the Government, considering only price and the price-related factors. Award will be made to the responsible offeror who offers the lowest reasonable and realistic price. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 15.404-1(b). All priced bids in response to this solicitation must include all costs associated with work elements, applicable taxes, permits, and licensure. Prices shall also include the overall project management, superintendent oversight and quality control necessary for the planning and execution of work requirements.
2.0 Initially bids shall be ranked ordered according to total price including the base and the additive contract line item. The Government will make award on the base bid item (CLIN 0001AA) at a minimum, and intends to make award for the additive item (CLIN 0001AB) for which funding is available. The low bid shall be the Offeror that is otherwise eligible for award; and offers the lowest aggregate amount for the base bid item (CLIN
0001AA), plus the additive item (CLIN 0001AB), that provides the most features within the funds determined available.
3.0 DETERMINATION OF RESPONSIBILITY
In accordance with FAR 14.408-2, Responsible Bidder - Reasonableness of Price, the Contracting Officer will determine that a prospective contractor is responsible IAW FAR Subpart 9.104-1.
4.0 PRICE AND PRICE-RELATED FACTORS
Price. As stated in FAR Part 14.408-2, the Contracting Officer will determine that the prices offered are balanced, complete, and fair and reasonable before awarding the contract. The Government will evaluate price using one or more of the price analysis techniques in FAR sub-part 15.404-1(b).

(a) This clause does not apply to the unrestricted portion of a partial set-aside.
(b) , as used in this clause, means a first-tier subcontractor, including an independent contractor, that-Definition. Similarly situated entity
(1) Has the same small business program status as that which qualified the prime contractor for the award ( , for a small business set-aside contract, e.g.
any small business concern, without regard to its socioeconomic status); and
(2) Is considered small for the size standard under the North American Industry Classification System (NAICS) code the prime contractor assigned to the subcontract.
(c) This clause applies only to-Applicability.
(1) Contracts that have been set aside for any of the small business concerns identified in 19.000(a)(3);
(2) Part or parts of a multiple-award contract that have been set aside for any of the small business concerns identified in 19.000(a)(3);
(3) Contracts that have been awarded on a sole-source basis in accordance with subparts 19.8, 19.13, 19.14, and 19.15;
(4) Orders expected to exceed the simplified acquisition threshold and that are-
(i) Set aside for small business concerns under multiple-award contracts, as described in 8.405-5 and 16.505(b)(2)(i)(F); or

(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities.
