SECTION C – DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

1.0 BACKGROUND

Wild horses and burros on public lands administered by the Bureau of Land Management (BLM) and Forest Service (USFS) are protected, managed, and controlled under the provisions of the

Wild Free-Roaming Horses and Burros Act of December 15, 1971, as amended (16 U.S.C. 1331-

1340). As resource conditions and other factors warrant, excess wild horses are removed from the public lands and made available to the public to be placed into private care through adoptions and sales programs. Wild horses that have not been adopted or purchased are cared for in off-range corrals (ORCs) and off-range pastures (ORPs). The BLM has initiated a management strategy that provides for the removal of more excess wild horses and burros than our nationwide off-range corrals and pastures can accommodate. The purpose of this requirement is to:

A. Provide off-range pasture space to support a total program capacity of 16,000 wild horses across all awarded contracts in in the following states: Kansas, Missouri, Oklahoma, and Utah. Each Contractor shall have the capacity to care for a minimum of 200 animals in a pasture (grassland) setting on private land. Wild horses are to be maintained in pastures large enough to allow free-roaming behavior; provide adequate forage, water, and shelter necessary to sustain animals in good body condition.

B. Minimize the handling of animals by humans.

C. Provide regular, on the ground monitoring and inventory of the animals to ascertain their well-being and safety (SOW Sec. 7.2H).

D. Gather and prepare all animals for shipment in accordance with the Attachment No. 01 –

CAWP section V.

E. Provide management by individuals who are knowledgeable and experienced about the behavior and nutritional requirements of equines and the management of land for the sustained production of grass and other desirable forage plants (SOW Sec. 5.1).

On December 8, 2004, Public Law 108-341; Section 142 amended the 1971 Wild and Free-

Roaming Horses and Burros Act (Public Law 92-195) that requires the BLM to sell excess wild horses and burros which meet the following criteria:

▪ Animals that are 11 years of age and older; or

▪ Animals that have been offered unsuccessfully at three adoption events.

This may require the BLM to remove animals that meet the above criteria or as otherwise determined by the authorized Government personnel from contracted ORPs during the contract.

D. The plan should identify any personal protective equipment necessary to mitigate hazards.

6.0 GOVERNMENT FURNISHED PROPERTY, INFORMATION, SERVICES

6.1 Government Actions

A. Post-Award Site Visit, NEPA Review, and TO Process: Following award of the IDIQ contract, BLM will facilitate a Post Award Site Visit to inspect the ORP facilities and verify compliance with the minimum requirements identified in section 7 of the SOW. Any deficiencies identified during the site visit must be corrected prior to obtaining NEPA compliance and before issuance of TO and delivery of the initial horses.

B. Environmental Review and Facility Readiness: BLM will initiate the appropriate NEPA document (e.g. Determination of NEPA Adequacy, Categorical Exclusion, or Environmental

Assessment (EA)). During this process, BLM will evaluate the carrying capacity of the contractor’s property to determine an appropriate stocking level and assess the potential https://sam.gov/content/wage-determinations https://sam.gov/content/wage-determinations https://www.dol.gov/sites/dolgov/files/WHD/legacy/files/SCADirectVers5.pdf

V1/d5 05.21.2026 Page 17 of 94 pages, excludes attachments environmental impacts associated with the operation and maintenance of an ORP on the

Contractor’s private and/or leased lands.

See the NEPA Handbook.

C. The Contractor is eligible for the first task order for services and delivery of horses when:

(i) The Contractor meets all contract requirements;

(ii) The Post-Award Site Visit has been completed, and any identified deficiencies have been corrected;

(iii) Any required facility modifications have been completed;

(iv) The Contractor has implemented all mitigation measures, design features, and other requirements identified in the NEPA document;

(v) BLM has completed NEPA compliance.

The NEPA process typically requires 6 to 24 months to complete. As a result, issuance of the

TO and placement of horses may not occur for up to 24 months after IDIQ contract award.

BLM will not issue a TO if:

(i) Resource concerns identified during the environmental review cannot be adequately addressed through project design features;

(ii) BLM and the Contractor cannot reach an agreement on an appropriate stocking level based on in-depth analysis of the best available data; or

(iii) The Contractor is unable or unwilling to implement required design features, mitigation measures, management practices, or monitoring requirements identified in the

NEPA document.

The IDIQ contract is subject to termination if the EA is not approved, then at that time the

TO minimum guarantee may be invoiced.

D. Following completion of the NEPA process, issuance of a TO, and delivery of horses at the facility, BLM will provide a Shipping Report for each shipment. The Shipping Report will identify the animal’s freeze mark/microchip numbers, signalment key, physical description, and originating off-range corral facility; in addition to any applicable documentation for interstate transport of horses (i.e. Coggins test results, certificate of veterinary inspection).

Individual animal health records documenting vaccination history will also be provided. See

Sec. 7.2 for additional details.

E. BLM anticipates conducting at least three inspections throughout the year to assess animal

BCS, forage/water conditions, and any animal health issues. At least one or more visits will include a United States Department of Agriculture (USDA) Animal and Plant Health

Inspection Service (APHIS) Veterinarian who will also assess BCS and look for health problems. Inspection findings will be discussed with the Contractor. See Attachment No. 07 for an example BLM inspection report.

F. BLM and the Contractor will conduct at least one annual count to determine current inventory and assess overall animal health. BLM will document this count on Attachment https://www.blm.gov/sites/blm.gov/files/uploads/Media_Library_BLM_Policy_Handbook_h1790-1.pdf

No. 07, and a copy of this report will be provided to the Contractor. Adjustments to the inventory will be made based on this annual count.

G. If horses are relocated off the ORP at the conclusion of the contract performance period, or for convenience of the Government, BLM will conduct all animal pre-conditioning

(vaccinations, de-worming, blood testing) and preparation for shipment (brand inspection and health certificates) of horses from the Contractor. BLM will coordinate the shipping of animals from the pasture facility. BLM will provide a hydraulic squeeze chute for the purpose of preparing horses for shipment from the ORP.

H. BLM will notify the Contractor of any required dates and number of animals that need to be moved into the Contractor’s corrals to facilitate relocation.

I. BLM will accept, conditionally accept, or reject submittals in accordance with the SOW.

7.0 CONTRACTOR FURNISHED SERVICES, FACTILITES, MATERIALS, AND

SUPPLIES

7.1 General Tasks

The Contractor shall provide all necessary land, facilities, pastures, personnel, equipment (except for the hydraulic squeeze chute Sec. 6.1 G) and supplies to perform the following general tasks.

Specific requirements for each are set forth in the subsequent paragraphs of this SOW. The

Contractor shall:

a. Provide land, forage, salt, minerals, water and fences necessary to properly care for and maintain a minimum of 200 horses and up to the maximum in Section B as modified dependent on NEPA determination. The Contractor must also provide supplemental feed as necessary to maintain the animals in good condition (i.e. during periods of drought, deep snow, ice storms, fire, during times when the forage is depleted of protein content or when other circumstances warrant). The animals should be grazed on grassland pastures that can produce sufficient standing forage for a period of at least eight months or longer. It is anticipated that supplemental feeding will be required for a

120-day period. It is the Contractor’s responsibility to plan and budget for the amount of supplemental feed that will be necessary to maintain animals in good BCS. Funding for additional supplemental feed will only be provided in situations described in SOW

Sec 7.2 E4 (below). The pastures should have sufficient rock and soil type to maintain proper hoof size and shape without trimming.

b. Maintain fences and keep animals on contracted lands and prevent animals from escaping onto neighboring lands. Contractor shall make every effort to immediately return escaped animals back onto contracted lands. Contractor shall notify the COR if, within 48 hours, escaped horses cannot be returned to contracted lands. Should the escape of animals occur, all costs to catch, gather, remove and/or return any escaped

V1/d5 05.21.2026 Page 19 of 94 pages, excludes attachments horses to said facility shall be incurred by the Contractor. In the event the Contractor fails to return escaped horses within 30 days, BLM will attempt to retrieve said animals and charge the Contractor for all expenses incurred. If trespass penalties/violations are incurred, the Contractor shall be liable for all costs associated. Once the BLM has determined the total cost of retrieval of escaped animals, the Contractor will be notified in writing by the CO, and the total cost will be deducted from the next invoice.

c. Provide corrals and adequate facilities to load and unload wild horses on an as needed basis.

d. Unload, sort and segregate animals as needed upon their arrival, when additional horses are transported to the facility.

e. Gather and move horses from pasture to pasture as needed, supervise their health and welfare, and maintain the facilities in a safe hazard free condition.

f. If directed by the COR, gather and hold in isolation horses up to a period of 90 days, until time for shipment.

g. Prior to the submission of the monthly invoice, the Contractor will conduct a complete inventory of all animals and deaths. The results of each inventory will be included in the monthly invoice. Maintain a record keeping system that documents the frequency and results of these observations.

h. Catalog and maintain the health records that accompany each animal delivered to the pasture (as provided for in Sec. 6.1 D). Each death will be recorded by the freeze mark and/or description of the animal, date the animal was noted as dead and then submitted on each month’s invoice. The records shall be made available for duplication within 5 days after a request is made by the COR. Monthly invoices, death records, and receiving information for the previous month shall be submitted in accordance with

Section G.2, Section I- Department of Interior (DOI)-AAAP-0028 Invoice Processing

Platform (IPP), and F.2 Submittal Table RSN-09. See Attachment No. 08 for Example

Invoice and Reports.

i. Dispose of the remains of dead animals according to state and or local requirements for disposal of dead animals. The Contractor or their representative approved by the COR will be required to complete euthanasia training by firearm as required by BLM policy for reasons of acts of mercy, health and safety.

j. The Contractor agrees not to pasture any other horses wild or domestic other than those delivered by the BLM in the same pasture occupied by wild horses. In the event neighboring horses show up in a contracted pasture with BLM animals, the Contractor shall immediately remove domestic horses and notify the COR. Further, action to reduce trespass domestic horses will be handled on a case-by-case basis (i.e.

construction of a double fence).

k. Perform all animal handling, care and maintenance, and facility design in accordance

V1/d5 05.21.2026 Page 20 of 94 pages, excludes attachments with BLMs CAWP Standards for Off-Range Pastures (Attachment No. 01). The CAWP standards are tied closely to the items in this SOW. The BLM is utilizing a CAWP assessment program to ensure that BLM employees and Contractors involved in the

WH&B program are adhering to the CAWP requirements (WH&B website) at https://www.blm.gov/programs/wild-horse-and-burro/comprehensive-animal-welfare-program. The CAWP assessment program will conduct CAWP assessments during the life of the contract. The BLM CAWP assessment report will be provided to the

Contractor by the COR or CO upon completion as applicable. The COR will consider the findings of the CAWP assessment and may address any non-compliant standards via the Contract Discrepancy Report (CDR, see Section E. 4 Criteria for Evaluating

Performance, Section F.2 Submittal Table, RSN-10, and Attachment No. 09). The

Contractor will have the opportunity to review and respond to the CAWP assessment prior to it being posted publicly. The BLM will make the CAWP assessment report publicly available on the above website. Names of Contractors, contract numbers or other personal/proprietary information will not be included in the report or posted. The

CAWP requires annual training for all personnel, including BLM staff and Contractors involved in off-range pastures. The free online training typically takes an hour to complete. Once the training is completed, the Contractor will provide the certificate of completion to the COR and cc the CO. Instructions to access the training will be provided to the Contractor after contract award.
