5. Offeror's attention is invited to the insurance requirement contained in this solicitation (Contract Clause FAR 52.228-5). Certification of the required coverage for the prime contractor shall be furnished prior to beginning work on this contract, and the Contracting Officer may request evidence of the required insurance at any time during the life the contract.

6. Reference Contract Provision 252.236-7008, CONTRACT PRICES - BIDDING SCHEDULES (DEC 1991). The prices shown in the Bidding Schedule must reflect ALL costs involved in performing the work, as described in the plans and specifications.

7. The term "Bidding Schedule" shall also be construed to mean "Offer Schedule" or "Schedule". The terms "bid" and "offer", and "bidder" and "offeror" shall be construed as having the same meaning in this solicitation and resulting contract.

8. A complete bid package must contain the following:

(c) A Bid Bond and Power of Attorney is required along with the bid on the due date. In accordance with DoD Deviation 2020- O0016, electronic signatures and electronic, mechanically-applied, or printed dates may be used and shall be considered original signatures and dates. The bid bond must be on a SF 24 form. Rejection of a bid bond shall be in accordance with FAR 28.101-4 Noncompliance with bid guarantee requirements.

(d) Section 00 45 00, Representations and Certifications, completed and return only additional certifications found in this section. In addition, the offeror must have entered current and complete data within the past year in Online Representations and Certifications at www.sam.gov.

(e) When completing the "Offeror" portion of the SF 1442 (Blocks 14 - 20), an official having the authority to contractually bind the company must sign the SF 1442 in accordance with FAR 4.102. One copy of the SF 1442 is required to have an original signature.

(f) All amendments to the solicitation must be acknowledged.

9. Joint Venture Requirements - Parties wishing to propose as a joint venture must submit, with the Pro Forma documents, an executed copy of the joint venture agreement. The joint venture agreement shall be executed in accordance with FAR 4.102(d).

Each joint venture partner shall submit evidence satisfactory to the Contracting Officer that its Board of Directors has approved its participation in the joint venture or by an instrument of similarly binding character in the case of an unincorporated entity.

Section 00 21 00 - Instructions

INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

1. DESCRIPTION OF THE PROJECT: The work covered in this solicitation consists of furnishing all labor, equipment, material, and performing all work to remove and replace one (1) 70 Ton Chiller and two (2) Computer Room Air Conditioning (CRAC, 7 & 9 Ton) units within Building 1044. To accomplish at a minimum what is described in paragraph 7 of the Statement of Work (SOW) (PRINCIPAL FEATURES) - from proper sizing, demolition of existing units and installation of new units, following all manufacturer requirements and applicable codes/base regulations.

2. INSTRUCTIONS TO BIDDERS:

2.1. You are invited to submit a bid in response to our Invitation for Bids (IFB) entitled W50S8G-25-B-A001: BLDG 1044 Chiller & CRAC Unit Replacements, Project Number: MHMV252100, at Kirtland AFB, NM 87117.

2.2. As a result of this solicitation, the Government intends to award a Firm Fixed Price (FFP) contract resulting from this solicitation to the responsible bidder whose bid, conforming to the invitation for bids, will be most advantageous to the Government, considering only price.

2.3. This solicitation is set-aside 100% for small businesses. The North American Industry Classification System (NAICS) for this solicitation is 238220, Plumbing, Heating, and Air-Conditioning Contractors. The size standard for this NAICS is $19.0 million.

4. NOTICE OF PRE-BID CONFERENCE AND SITE VISIT

4.1. A pre-bid conference will be conducted on July 23, 2025 at 9:00 AM for the purposes of briefing on the bid requirements and answering questions regarding this solicitation. This conference will be held at Building 1044, 2251 Air Guard Road Southeast, Kirtland Air Force Base 87117.

Interested Contractors are highly encouraged to attend the pre-bid conference. The site visit will be held immediately following the conference.

4.3. This information must be provided in advance, in order to no later than 2 calendar days prior to the pre-bid conference / site visit, ensure access to the military base and conference site and ensure adequate seating for the conference attendees. Even if you have access to the base, you must register to ensure adequate seating. The furnishing of the above information is voluntary; however, your failure to furnish all or part of the requested information may result in the Government's denial of your access to the pre-bid conference. This information will be provided to the Base Security Forces who will authorize your entrance to the site.

4.4. Visitors must pick up their passes at the Kirtland AFB Truman Gate prior to arrival. You will be required to present the following information upon arrival: (1) Vehicle Registration, (2) Valid Drivers License, (3) Proof of Insurance for Vehicle, (4) Safety Inspection and Car Rental agreement if applicable. Any of the above information furnished by you is protected under the Privacy Act and shall not be released unless permitted by law and/or you have consented to such. NOTE: The Truman Gate Visitor Center can become very busy and may take a long period of time to obtain your pass. It is highly recommended that passes are picked up early so that your company can attend the pre-bid conference / site visit.

4.5. Information provided at this conference or site visit shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation amendments shall apply.

4.6. A record of the conference shall be made and furnished to all prospective bidders via posting at www.SAM.gov. The record will include minutes of the meeting, including questions (on a non-attribution basis) and answers.

5.5. Receipt by the offeror must be acknowledged in the space provided on the SF 1442 or by returning a signed copy of the amendment by the time set for receipt of bids.

5.6. For security reasons, all technical and engineering data related to this solicitation will be distributed using the Contract Opportunities (SAM.gov) system. It is named ATTACHMENT 4 - DRAWINGS OF CURRENT UNITS and will be available for download within the solicitation.

5.6.1. Amendments, if/when issued will be posted to www.SAM.gov for electronic downloading. This will be the only method of distributing amendments prior to closing; therefore, it is the offerors responsibility to check the website periodically for any amendments to the solicitation. Websites are occasionally inaccessible due to various reasons.

6. BID REPOSITORY AND BID OPENING:

6.1. A bid repository is provided for hand carried bids and is located at 600 Wyoming Blvd NE, Albuquerque, NM 87123. Hand carried bids must be deposited in the repository No Earlier Than 1 hour prior to the time established for opening of bids. Bidders are cautioned that they will be required to sign-in and obtain a visitor's pass to enter the facility and should allow time to accomplish this. Late receipt of bids due to entry delays will not be deemed excusable and the Contracting Officer may declare the bid "late" in accordance with FAR 14.304.

6.2. The bid opening will occur at the time and date specified in Block 13 of the SF 1442 at 600 Wyoming Blvd NE, Albuquerque, NM 87123. All interested offerors and their major subcontractors are encouraged to attend the bid opening.

6.2.1. The Government will not be responsible for bid submissions delivered to any location or by any method other that stated above. Offerors are responsible for submitting bids in sufficient time to be received by the Government in accordance with the instructions provided.

8. BID PREPARATION EXPENSES AND PRE-CONTRACT COSTS:

This IFB does not commit the Government to pay costs incurred in preparation and submission of bids or for other costs incurred prior to award of a formal contract.

Clauses and provisions from the Federal Acquisition Regulation (FAR) and supplements thereto are incorporated in this document by reference and in full text. Those incorporated by reference have the same force and effect as if they were given in full text. Clauses and provision may or may not be in order consecutive order.

10. DISPOSITION OF UNSUCCESSFUL BIDS:

In compliance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful bids including the bid bond.

To establish its responsibility, the apparent low bidder may be requested by the Government prior to award, to submit a statement regarding his previous experience in performing comparable work, his business and technical organization, financial and bonding resources and plant available to be used in performing the work. (a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds-

(1) To unsuccessful bidders as soon as practicable after the opening of bids; and

(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be 20 percent of the bid price or $N/A, whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

(a) Definitions. As used in this provision, Covered article, FASCSA order, Intelligence community, National security system, Reasonable inquiry, Sensitive compartmented information, Sensitive compartmented information system, and Source have the meaning provided in the clause 52.204-30, Federal Acquisition Supply Chain Security Act Orders-Prohibition.

(b) Prohibition. Contractors are prohibited from providing or using as part of the performance of the contract any covered article, or any products or services produced or provided by a source, if the prohibition is set out in an applicable Federal Acquisition Supply Chain Security Act (FASCSA) order, as described in paragraph (b)(1) of FAR 52.204-30, Federal Acquisition Supply Chain Security Act Orders-Prohibition.

(c) Procedures.

(1) The Offeror shall search for the phrase "FASCSA order" in the System for Award Management (SAM)( https://www.sam.gov) for any covered article, or any products or services produced or provided by a source, if there is an applicable FASCSA order described in paragraph (b)(1) of FAR 52.204-30, Federal Acquisition Supply Chain Security Act Orders-Prohibition.
