About this file
This document provides instructions for a solicitation seeking proposals for worldwide conventional weapons destruction services. Offerors are required to submit proposals in four volumes for evaluation under two phases. Phase I requires experience demonstrating capabilities similar in scope to conventional weapons destruction activities. Phase II requires an implementation strategy for Iraq, a strategic approach, and past performance information. Price proposals must provide pricing for a potential task order for Iraq conventional weapons destruction services using firm-fixed-price and cost-reimbursement contract types. Proposals are due by September 21, 2023 with advisory downselect notifications issued approximately two weeks later and phase II proposals due as provided in notifications. The Department of State Office of Acquisition Management will evaluate proposals and make award for worldwide conventional weapons destruction services under solicitation number 19AQMM23R0037.

SECTION L-001 – REQUEST FOR PROPOSAL INSTRUCTIONS, CONDITIONS, AND NOTICES
TO OFFERORS
L.1 DISCUSSIONS WITH OFFERORS
The Contracting Officer is the only person who is authorized to conduct clarifications, communications, or discussions with the offerors from release of this RFP through contract award. Any such discussions shall be conducted in accordance with the regulations stipulated in FAR Part 15. Any questions or comments concerning this RFP, in particular or in general, shall be addressed only to the Contracting Officer. The Contracting Officer is Christopher L. Toso and can be reached at TosoCL@state.gov.
L.2 PROPOSAL AND REQUIREMENTS QUESTIONS
All proposal questions shall be submitted to the Contracting Officer via email at TosoCL@state.gov within 14 calendar days after the solicitation issuance date in Block 6, by 0900 ET. All questions must be submitted using Appendix A – Question and Answer (Q&A) Template. Appendix A contains further instructions under the spreadsheet tab “Instructions.” All Offerors shall separate technical and price questions and clearly identify each question with a reference to the solicitation. If submitting questions, offerors must include the solicitation number in the subject line of the email.
L.3 PROPOSAL DUE DATE AND SUBMISSION
a) All written proposals shall be submitted electronically via email to the Contracting Officer (CO) in the format and instructions outlined in this section. Offerors shall be responsible for ensuring the electronic submission is successful and received by the CO via email by the proposal due date and time. When submitting written proposals to the CO, the offeror shall request read receipts to ensure the CO receives the offeror’s proposal. Send offers with sufficient time for processing by servers, considering the size of the message. Do not exceed 40MB per email. If an offeror submits multiple emails to complete a proposal submission, the offeror must clearly identify the set in the subject (i.e. message 1 of 3). No other methods of submission will be accepted.
b) Submission instructions for Phase II proposals will be provided after the Government completes its evaluation of Phase I proposals.
c) Proposals shall be valid for no less than one hundred and eighty (180) calendar days from the proposal due date.
d) The Government is not liable for any expenses incurred by the Offerors in developing and submitting proposals for this solicitation.
L.4 PHASED PROCUREMENT
The Government intends to conduct this procurement through a phased proposal submission and phased evaluation. A notional schedule is provided:
– Phase I proposals due
– Advisory Down-Select (ADS) notifications issued approximately two weeks after Phase I proposals are due
– Phase II proposals due, this date will be provided with ADS notification
– Selection and award
L.5 PROPOSAL FORMAT
a) All files, except for the pricing tabs, shall be in MS Word or PDF. Printing should be single spaced. Each paragraph shall be separated by at least one blank line. A standard, 12-point minimum font size applies. Arial, Calibri, or New Times Roman fonts are required. Tables and illustrations may use a reduced font size no less than 8-point.
b) Microsoft Word and PDF files shall use the following standard format:
Margins – Top, Bottom, Left, Right – 1” Gutter – 0” From Edge – Header, Footer 0.5” Page Size, Width – 8.5” Page Size, Height – 11”
c) All price breakdown information to aide in the price evaluation shall be submitted in Microsoft Office Excel Read/Write format and viewable in Microsoft Excel. All calculations and formulas shall be unprotected and accessible in electronic submission documents.
L.6 PROPOSAL ORGANIZATION
a) The Offeror’s complete proposal shall consist of the following four (4) volume submissions, which will be provided in two (2) phases, as outlined. Each electronic file shall be clearly labeled with its title and volume number.
Phase I: Volume I: Non-Cost Factor 1 – Experience
Phase II: Volume II: Non-Cost Factor 2 – Implementation Strategy for Iraq
Volume II: Non-Cost Factor 3 – Strategic Approach Volume III: Non-Cost Factor 4 – Past Performance Volume IV: Factor 5 – Price Proposal
b) Volume I is limited to 30 pages. Volume II is limited to 30 pages. The remaining volumes do not have page limitations. Where included, the cover letter, title page, table of contents, table of figures, list of tables, glossary of abbreviations & acronyms, resumes, and commitment letters are not included in the page limitation. All pages must be numbered. Pages that exceed the required page limitations will be removed and not be read or evaluated by the Government.
c) Each volume shall be file named with only the following information: Company name, Solicitation Number, and Volume Number.
L.7 PROPOSAL CONTENT REQUIREMENTS (PHASE I AND II)
a) All information shall be confined to the appropriate file. The Offeror shall confine submissions to essential matters, sufficient to define the proposal in a concise manner, to permit a complete and accurate evaluation of each proposal.
b) Assumptions: The Government does not encourage offerors to make assumptions or take exceptions from the requirements of the solicitation. Rather, offerors are encouraged to submit questions using the required process outlined in this section.
However, if necessary, the offeror’s Volume submission must clearly and unambiguously identify all such assumptions, exceptions, or dependencies on which the offer is based.
Each assumption, exception or dependency shall be specifically related to a paragraph and/or specific section of the solicitation. The offeror shall provide rationale in support of any noted assumption, exception, or dependency, explaining its effect in comparison to the solicitation in detail. Assumptions, exceptions, or dependencies do not make a proposal automatically unacceptable. However, many assumptions, exceptions or dependencies, or a significant assumption, exception, or dependency, which provide(s) little or no benefit to the Government or which do(es) not support the Government’s requirement as documented in the solicitation may receive unfavorable evaluation.
c) Cost or price information related to this proposal is prohibited in Volumes I-III.
d) Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of each proposal. Offerors are cautioned against “parroting” of the technical requirements. “Parroting” is defined as imitating the words of the technical requirements without articulating a clear understanding of the requirements or capability to perform.
e) Files shall not contain classified data/information. Proprietary information shall be marked or noted clearly. The use of hyperlinks in proposals is prohibited and the linked or embedded information will not be evaluated.
f) Proposals not received in accordance with these instructions may be rejected. Failure to furnish current and complete information may cause a proposal to be rejected.
g) The penalty for making false statements is prescribed in 18 USC 1001.
L.8 INSTRUCTIONS – PHASE I
Volume I, Non-Cost Factor 1 – Experience. Provide project experiences that demonstrate capabilities similar in scope and complexity to the Conventional Weapons Destruction (CWD) activities found in this solicitation’s Performance Work Statement (PWS). All submitted projects must have been performed Outside of the Continental United States. Project experiences submitted for the Offeror shall include substantial performance occurring within the past five (5) years of the date of issuance of this solicitation. Experiences not occurring as described are considered not recent and not relevant and should not be submitted. For each project experience submitted, the offeror shall provide a description of the services provided and explain the relevancy to the project requirements in sufficient detail. In addition, each project should describe the mobilization effort and response times. The offeror should demonstrate experience supporting a CWD program similar to the size and magnitude of Weapons Removal and Abatement’s (PM/WRA), as communicated by this solicitation. As a reminder, this factor has a 30-page limit.
Offeror’s are encouraged to include relevant experiences that were self-performed as the prime contractor. If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity or the Joint Venture partners.
If submitting project experiences from intended subcontractors, the prime offeror shall include a Letter of Meaningful Involvement signed by both parties, outlining the committed activities for each party for this effort. To expand, if an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the offer), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract in order for the past performance information of the affiliate/subsidiary/parent/LLC/LTD member companies to be considered. The proposal shall state specific commitments of technical resources (e.g. personnel, equipment) that the affiliate/subsidiary/parent/LLC/LTD member companies commit to the performance of this contract. In particular, the proposal shall clearly state the specific commitments of resources of the affiliate/subsidiary/parent/LLC/LTD member that said member will be accountable for on this project. The proposal shall also describe specific roles of the affiliate/subsidiary/ parent/LLC/LTD member companies in terms of the work it will either self-perform or manage on behalf of the Offeror in performance of the contract.
Offerors shall provide sufficient information for the Government to determine its level of confidence in the ability of the Offeror to perform the solicitation’s requirements based on an assessment of relevant experience from the offeror.
L.9 ADVISORY DOWN-SELECT NOTIFICATION
After the Government completes technical consensus of Phase I - Experience, Offerors will receive an advisory notification via e-mail from the Contracting Officer. This notification will advise the Offerors of the Government’s advisory recommendation to proceed or not to proceed with Phase II submission. Offerors who are rated most highly for Phase I will be advised to proceed to Phase II of the proposal submission process.
Offerors who were not among the most highly rated will be advised that they are unlikely to be viable competitors, along with the general basis for the Government’s advisory recommendation. The intent of this advice is to minimize proposal development costs for those Offerors with little to no chance of receiving an award.
Note that the Phase I evaluation factor is more important than Phase II evaluation factors.
The Government intends to provide no more than five (5) Offerors with an advisory notification to proceed. However, the Government’s advice contained in the notification is a recommendation only, and those Offerors who are advised not to proceed may elect to continue their participation in the source selection process.
Phase II submissions will not be considered from Offerors who have not submitted Phase I proposals by the due date and time stated in this solicitation. For those Offerors that are rated most highly and advised to proceed to Phase II of the proposal submission process, the Contracting Officer will include the Phase II submission instructions on the advisory notification, including the due date for the Phase II submission. The Government recommends Offerors to begin preparation of Phase II proposals only after receipt of the Phase I advisory down-select notice.
The down-select notifications will include further information. The Government intends to allow offerors at least one (1) business day to decide whether it wishes to proceed with a Phase II submission. The exact response timeframe will be provided in the notice.
Offeror’s that received advisory notification not to proceed to Phase II, but choose to proceed to Phase II, shall send an email to the Contracting Officer not later than 24 hours after receipt of the advisory recommendation not to proceed, indicating its intent to participate in Phase II. After the Contracting Officer receives notice from the offeror stating its intent to participate in Phase II despite the Government’s advisory notification not to proceed, the Contracting Officer will send a separate e-mail with Phase II submission instructions within two (2) business days.
L.10 INSTRUCTIONS – PHASE II
The Government’s notification to offerors after evaluation of Phase I submissions will include the due date for Phase II written submissions.
Volume II, Non-Cost Factor 2 – Implementation Strategy for Iraq. It is the intent of the Government to issue a task order under this contract against the Iraq Performance Work Statement (PWS) included in this solicitation. Offeror’s shall provide a clear, concise, and realistic plan and approach for meeting the requirements laid out in the task order’s PWS, see Attachment 1. Offerors shall address their understanding of the requirements, operational capabilities, and technical approach specific to the Iraq PWS and QASP, see Attachment 2. Include a single resume for the proposed Iraq Task Order Lead, who is considered a Key Personnel. As a reminder, this Volume has a page limit.
Pricing for this task order shall be submitted separately, in Volume IV under Factor 5 – Price Proposal.
Offerors shall provide sufficient information for the Government to determine its level of confidence in the ability of the Offeror to perform the solicitation’s task order requirements based on an assessment of the offeror’s implementation strategy.
Volume II, Non-Cost Factor 3 – Strategic Approach. The Offeror’s strategic approach shall demonstrate a clear understanding of the requirements outlined in the IDIQ’s PWS.
The submission shall demonstrate how the offeror will implement their proposed solutions to achieve timely, reliable, secure, flexible, responsive, compliant, and cost-effective services. The Offeror’s approach shall demonstrate their capability to urgently respond to and manage emerging needs, worldwide, which may include requirements in hostile and austere environments. As a reminder, this Volume has a page limit.
Offerors shall provide sufficient information for the Government to determine its level of confidence in the ability of the Offeror to perform the solicitation’s requirements for worldwide CWD services based on an assessment of the offeror’s strategic approach.
Volume III, Non-Cost Factor 4 – Past Performance. The offeror shall provide recent and relevant past performance information. If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in Non-Cost Factor 1 - Experience. If there is not a completed CPARS evaluation, then offerors shall submit Past Performance Questionnaires (PPQs) using Appendix B for each project included in NCF 1. The Offeror should provide completed PPQs in their proposal volume. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other solicitations.
However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Christopher L. Toso, Contracting Officer, TosoCL@state.gov.
Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 – Offeror Experience. Offerors may also address any adverse past performance issues. Explanations shall not exceed two
(2) double-sided pages (or four (4) single-sided pages) in total.
The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.
Performance award or additional information submitted will not be considered.
Offerors with no past performance or relevant experience shall type “NO PAST PEFORMANCE OR RELEVANT EXPERIENCE” in Bold Letters in Volume III, Past Performance on a blank page in this volume.
Volume IV, Factor 5 – Price Proposal. The offeror shall provide a comprehensive price proposal for the Iraq Task Order’s PWS and QASP, see Attachments 1 and 2, respectively. This volume shall consist of all information required to support a price and cost analysis. Fixed prices and labor rates submitted and awarded shall be valid for the duration of the resulting award. All prices shall be in United States Dollars. There are no page limitations to this volume. Certified cost and pricing data is not currently required;
however, the Government reserves the right to request such data prior to award.
Technical responses shall be separate from pricing information provided.
The offeror shall submit a detailed price narrative supporting each price/cost proposed.
The price proposal narrative must provide a thorough explanation and rationale for all proposed prices.
Offerors shall submit their price proposal using Appendix C – Pricing Tabs. Upon award the Contracting Officer will incorporate the proposed rates from Tabs 1-4 into the resulting IDIQ by Attachment C – Rates. Tabs 6 and 7 will be incorporated into the resulting order for Iraq as Attachment 3 – Price Schedule and Labor Rates.
The task order type associated with the Iraq task order contains a hybrid pricing structure, using Firm-Fixed-Price (FFP) and Cost Reimbursement (No Fee).
Pricing Information and Instructions for Appendix C – Pricing Tabs:
1) Offerors shall propose all rates, costs, and prices in United States currency.
2) Offerors shall not hide or lock any rows, columns, or cells that contain proposed data.
3) Any formula issues identified in Appendix C should be brought to the Contracting Officer’s attention as soon as possible, but no later than five (5) days prior to the due date of the Price Proposal.
4) In Pricing Tabs 1-4, 6, and 7, offerors shall complete the orange-highlighted areas only. The Government may have locked and password-protected other areas to preserve the integrity of the content and to facilitate the evaluation process.
5) In Pricing Tab 1, offerors shall identify their most current indirect cost rates that would be used as the proposed provisional billing rates. Such rates shall match the rates identified in the Price Proposal’s supporting information. The proposed provisional billing indirect cost rates shall not exceed the ceiling indirect cost rates proposed in Pricing Tab 2.
6) In Pricing Tabs 1 and 2, offerors shall propose only their own indirect cost rates.
Indirect cost rates for subcontractors and/or other entities should not be proposed in whole or in part. The proposed indirect cost rates shall reflect the impact of this potential contract. Therefore, such rates shall reflect the maximum dollars the offeror anticipates to receive through the duration of this potential contract (cumulative of all task orders). See FAR 31.203(c) (Indirect Costs) and FAR 42.704(b) (Billing Rates). Offerors shall include all indirect cost rate descriptions that are anticipated to apply under this contract. The proposed indirect cost rate descriptions and allocation bases shall match the respective indirect cost rate descriptions and allocation bases.
7) In Pricing Tabs 1 and 2, offerors shall follow the model provided under “The Following Is For Illustration Purposes” section, including:
a. Add or delete rows as necessary. The number in the Indirect Cost Rate Description column signifies a specific indirect cost rate description.
b. Each row will apply to a different Offeror Fiscal Year Period, which offerors shall identify with month, day, and year in the right-most column.
c. Propose an Offeror Fiscal Year Period for each of the offeror’s fiscal years through the life of the contract.
d. Do not list a contract performance period in the Offeror Fiscal Year Period column unless the offeror fiscal year period matches the contract year period.
8) In Pricing Tab 1 and 2, Facilities Capital Cost of Money (FCCOM) factors shall be separately identified if the offeror allocates FCCOM costs as part of its established or disclosed cost accounting practices.
9) In Pricing Tab 2, the proposed ceiling indirect cost rates shall match or otherwise not exceed 10% of the respective provisional billing indirect cost rates proposed in
Pricing Tab 1. For example, if a provisional billing indirect cost rate proposed in Pricing Tab 1 is 5.00%, the respective ceiling indirect cost rate proposed in Pricing Tab 2 shall be 5.00% or otherwise not exceed 5.50%.
10) In Pricing Tab 3, offerors shall review all of the content, which is presented for illustration purposes as guidance, and replace the content in the table (rows 5 through 10) with content specific to the offeror’s fiscal year, indirect cost rate structure, and ceiling indirect cost rates proposed in Pricing Tab 2. Offerors may add rows, if necessary.
11) In Pricing Tab 4, each proposed not-to-exceed (NTE) profit percentage and NTE fee percentage shall not exceed two decimal places. Each proposed NTE fee percentage shall not exceed 10.00%.
12) Pricing Tab 5 provides the total evaluated price, which is the sum of the Iraq Task Order. This tab is locked and does not require editing by offerors.
13) In Pricing Tab 6 for Iraq, the number in the “hours” column represents the RFP-specified estimated productive hours per year. The 1,880 RFP-specified productive hours per year are based on 2,080 annual hours minus 200 paid time off hours. Such productive hours are being used for evaluation purposes. The Government considers such productive hours to be the maximum productive hours worked by any given employee, regardless of nationality.
14) In Pricing Tab 6, in the OFF/SUB/OTH cells under Entity and pursuant to FAR 52.216-29(b), offerors shall select from the drop-down menu, the entity(ies) proposed to perform the labor category. OFF is an acronym for (Prime) Offeror. SUB is an acronym for Subcontractor Offeror. OTH is an acronym for Divisions, subsidiaries, or affiliates of the (prime) offeror under a common control.
15) In Pricing Tab 6, in the AN/LN/TCN cells under Nationality, offerors shall select, from the drop-down menu, the nationality(ies) of the individual(s) proposed to perform the labor category. AN is an acronym for American National. LN is an acronym for Local National. TCN is an acronym for Third Country National.
American National (AN): Individual who has legal status to work in the United States of America (e.g., United States citizen, United States resident alien, and individual with permit showing authorization to work in the United States).
Local National (LN) (also known as Host-Country National): Individual who has legal status to work in the task order place of performance (e.g., citizen or permanent resident of the country where task order performance occurs).
Third Country National (TCN): Individual who:
a. Is neither a citizen of the United States nor of the country to which assigned for task order duty;
b. If employed, is eligible for return travel to the TCN’s home country or country from which recruited at U.S. Government expense; and
c. Is on a limited appointment in the task order place of performance for a specific period of time.
The Government locked the AN cells because the corresponding labor categories are required to be performed by ANs only. As such, the fixed fully-loaded hourly labor rates proposed for the AN cells shall be based on AN performance only.
16) In Pricing Tab 6, under Fixed Rate, offerors shall propose one fixed fully-loaded hourly labor rate per labor category/CLIN per period, regardless of which entity (offeror, subcontractor offeror, and/or other) or which nationality(ies) is anticipated to perform the labor category.
If an offeror (small business or non-small-business) normally allocates indirectly the costs associated with a labor category identified in Pricing Tab 6, we remind such offeror that such allocation does not relieve the offeror from complying with each solicitation term, including this instruction. Any non-small-business offeror shall also complete FAR 52.230-7 (Proposal Disclosure – Cost Accounting Practice Changes).
17) In Pricing Tab 6, the proposed fixed fully-loaded hourly labor rates shall be based on a normal workweek of 40 hours (8 hours per day x 5 days per week).
18) In Pricing Tab 6, each proposed fixed fully-loaded hourly labor rate shall consist of a proposed unloaded hourly labor rate, any labor-related direct costs (e.g., any direct fringe benefits, any direct bonuses), any costs associated with satisfying local labor laws, applicable indirect costs, and profit amount. It shall not include any other costs. It shall also not be $0.00 or other nominal amount; it shall be an amount commensurate with the corresponding labor category description identified in RFP Section H.6.4.4 and the nationality(ies) of the individual(s) proposed to perform the labor category.
19) In Pricing Tab 6, the proposed fixed fully-loaded hourly labor rates shall not exceed two decimal places.
20) In Pricing Tab 6, offerors shall enter, in whole numbers (i.e., no decimals), their estimated indirect costs in the Ind $ columns. Such costs shall reflect the applicable ceiling indirect cost rate(s) proposed in Price Tab 2 multiplied by the RFP-specified estimated direct costs. To determine the applicable proposed ceiling indirect cost rates, offerors shall:
a. Ensure the RFP-specified estimated direct costs (i.e., subcontractors costs or travel costs, depending on the task order) are in the allocation base of the selected indirect cost rate description(s);
b. Ensure that the proposed applicable ceiling indirect cost rate(s) are for the offeror fiscal year(s) that coincides with the contract period. When a given contract period traverses two offeror fiscal years, the offeror shall show and compute accordingly for the given contract period the proposed applicable ceiling indirect cost rate(s) for each of the two offeror fiscal years.
c. Follow the guidance in and complete Pricing Tab 3 accordingly, including reviewing the formulas in columns C through H.
21) In Pricing Tab 7, the Government provided formulas to automatically calculate each proposed Subtotal, Total, and Total Proposed Price. Offerors shall verify all formulas and otherwise the arithmetic accuracy of all proposed information.
22) In Pricing Tab 7 for Iraq, the Government specified an estimated direct cost under the ODCs. Because the Government anticipates that a significant amount of the RFP-specified estimated direct cost will be for the associated cost element, and because offerors need to know what indirect cost rate description(s) (e.g., G&A) to apply to the RFP specified estimated direct cost, the Government identified such associated cost element as the most appropriate direct cost element.
23) Pricing Tab 7 for Iraq includes an evaluation of the option to extend for up to six months under clause 52.217-8. This does not commit the government to an extension.
Price Narrative Instructions and Supporting Information:
1) In the Narrative, offerors shall identify for the task order, based on their Total Proposed Price in Pricing Tab 7, respectively, their:
a. Proposed subcontractors;
b. Total dollars estimated to be subcontracted to each proposed subcontractor;
c. Total dollars estimated to be performed by the offeror; and
d. Percentage of work (based on estimated total dollars) to be performed by the offeror and each proposed subcontractor. “Subcontractor,” in this context, is defined, pursuant to FAR 44.101 (Definitions), as “any supplier, distributor, vendor, or firm that furnishes supplies or services to or for a prime contractor or another subcontractor.”
2) Offerors shall identify the name and full contact information, including email address, of their cognizant Federal auditor (e.g., local Defense Contract Audit Agency branch).
3) Offerors shall identify the name and full contact information, including email address, of their cognizant Federal agency official (CFAO). The CFAO works in the offeror’s cognizant Federal agency, which is normally the agency with which the offeror has the largest dollars in negotiated contracts, including option periods. See FAR 42.003. If the Government has not appointed a CFAO, the offeror shall identify the name and full contact information, including e-mail address, of the contracting officer cognizant of the largest dollars in negotiated contracts, including option periods.
4) Offerors shall identify each segment/business unit proposed to perform work under this contract and is part of the offeror. A segment/business unit, among other things, has its own indirect cost rate structure, and if applicable, its own Cost Accounting Standards Board (CASB) Disclosure Statement.
5) Offerors shall submit evidence to support the provisional billing indirect cost rates proposed in Pricing Tab 1. Offerors shall submit at least one of the following pieces of evidence, pursuant to the following descending order of precedence:
a. Current forward pricing rate agreement with the offeror’s cognizant Federal agency official
b. Current other negotiated indirect cost rate agreement (that contains forward pricing indirect cost rates) with the offeror’s cognizant Federal agency official
c. Current forward pricing rate recommendation letter issued by the offeror’s cognizant Federal agency official
d. Current provisional billing rate agreement with the offeror’s cognizant Federal agency official
e. Current provisional billing rate recommendation letter issued by the offeror’s cognizant Federal agency official
f. Most recent (within the last year) audit report from the Defense Contract Audit Agency (DCAA) or other qualified external auditor
g. Most recent (within the last year) audit report from a qualified internal auditor
h. Current indirect cost rate proposal submitted to the offeror’s cognizant Federal agency official and cognizant auditor
If the offeror has one or more of the items under “a” through “h” above but the item(s) does not account for the impact of this potential contract, the offeror shall submit the item(s) along with the information requested under “I” above, which then must account for the impact of this potential contract.
The provisional billing indirect cost rates proposed in Pricing Tab 1 shall match the respective rates submitted in the above support.
6) Each non-small-business offeror shall submit its current Cost Accounting Standards Board (CASB) Disclosure Statement for each segment/business unit proposed to perform work under this contract and is part of the offeror.
Pursuant to 48 CFR 9903.201-1 (CAS Applicability) and 48 CFR 9903.201-2(a) (Types of CAS Coverage), if this contract is awarded to a non-small business, the contract, including all resulting task orders, will be subject to full CAS coverage.
Pursuant to 48 CFR 9903.202-1 (General Requirements), when a contract is subject to full CAS coverage, a CASB Disclosure Statement(s) must be submitted before award and for each segment/business unit proposed to perform work under this contract.
Among all sources associated with the allocation of costs, the Government considers the CASB Disclosure Statement (Form CASB DS-1) the most reliable source because it is subject to Federal law (41 U.S.C. chapter 15, Cost Accounting Standards), certified by an authorized signatory of the reporting unit, and subject to a criminal penalty for the signatory when making a false statement pursuant to 18 U.S.C. Section 1001.
As such, the Government requires that the indirect cost rate descriptions, allocation bases, and fiscal year periods proposed in Pricing Tabs 1 and 2 match verbatim the respective content in the current CASB Disclosure Statement(s).
7) In accordance with FAR 15.404-3(b) (Subcontract Pricing Considerations), offerors shall conduct appropriate cost or price analyses to establish the reasonableness of proposed subcontract prices, and shall include the results of these analyses.
a. Results shall be in the form of the offeror’s cost/price analysis report(s).
b. The report(s) shall include:
1. Cost/price analysis technique(s) used (e.g., comparison of proposed prices received in response to the solicitation);
2. Summary findings;
3. Detailed findings; and
4. Basis for the determination of fair and reasonable proposed subcontract prices.
c. For award of the IDIQ contract, “proposed subcontract prices” shall mean “fully loaded” hourly labor rates proposed by the subcontractor offeror to the (prime) offeror, or fully-loaded hourly labor rates negotiated between the subcontractor offeror and (prime) offeror.”
8) The Offeror shall complete blocks 12 through 18, as appropriate, of the SF 33. The Offeror shall acknowledge all amendments either by signing and returning the SF30 (i.e., cover page only) or by acknowledging the amendments in Block 14 of the SF33.
9) Offerors shall submit all information required under Section K of this solicitation, to include their active registration from System for Award Management (SAM.gov).
10) With their price proposal, the Offeror shall submit evidence of a Secret Facility Security Clearance Level. A valid and active Secret Facility Security Clearance is required prior to be eligible for award of this IDIQ.
