Appendix M – Drug and Alcohol Testing Protocols
Section 1 Background A. Contractor personnel supporting this contract are prohibited from using any drug or substance identified in 21 CFR, part 1308.11, Schedule I under the Controlled Substances Act (see http://www.deadiversion.usdoj.gov/21cfr/cfr/2108cfrt.htm). A substance need not be listed as a controlled substance to be treated as a Schedule I substance by the Government. A controlled substance analogue is a substance which is intended for human consumption and is structurally or pharmacologically substantially similar to or is represented as being similar to a Schedule I or Schedule II substance and is not an approved medication in the US. See 21 United States Code [USC] §802(32)(A) for the definition of a controlled substance analogue and 21 U.S.C. §813 for the schedule. Cannabis remains a controlled substance under Schedule I of Controlled Substances Act (CSA).
B. Contractor personnel supporting this contract are prohibited from using any non-Schedule I drug or substance that is identified in the other Schedules in 21 CFR part 1308 except when the use is prescribed by a licensed medical practitioner who is familiar with the individual’s medical history, is providing care to the individual, and who has certified to the DS/OPO/WPS that the substance will not adversely affect the individual’s ability to safely perform any one of the essential functions of the position(s) the individual has been DS/OPO/WPS-approved for or is carrying out under the WPS II contract. Androgenic anabolic steroids are controlled substances and classified as Schedule III drugs under CSA.
C. Contractor personnel supporting this contract are prohibited from using alcohol while at or en route to their TO place of performance, unless otherwise authorized in the TO.
Section 2 Testing Laboratory The Contractor and the Government shall/will use a laboratory with a current US Health and Human Services certification, with the capability to test for alcohol and the drugs and substances listed below in Section 5, Laboratory Specimen Drug and Alcohol Testing, for the testing of Contractor personnel urine specimens, exception being the use of the instant read “dip” urinalysis kit. See http://beta.samhsa.gov/workplace/lab-list for the current list of certified laboratories.
Section 3 Specimen Type As requested, Contractor personnel supporting this contract shall provide a urine specimen to be tested for drugs and/or alcohol use, or deep lung breaths for alcohol use. The quantity of the specimen(s) is test dependent.
Section 4 Specimen Collection Procedures A. After notification to submit to testing, Contractor personnel (also referred to as “donor”) shall immediately report to the specimen collection site. In this context, immediately means that after receiving notification all of the person’s actions must lead to the specimen collection site. Contractor personnel who fail to timely appear, as determined by this contract, for testing without an approved deferral from DS/RSO COR and/or DS/OPO/WPS COR will be considered to have refused to take a drug or alcohol test (see Appendix B, Definitions).
B. A brief description of the testing procedures and specimen validity tests performed on the donor’s specimen will be provided by the collector.
Section 5 Laboratory Specimen Drug and Alcohol Testing A. The HHS-certified laboratory shall conduct a 12-panel test on the donor’s urine specimen to determine the presence or absence of the following twelve (12) types of drugs or their metabolites:
1. Amphetamines & Methamphetamines
2. Barbiturates
3. Benzodiazepines
4. Cannabinoids
5. Cocaine
6. Opioids
7. Phencyclidine
8. Methadone
9. Propoxyphene
10. Methylenedioxyamphetamine
11. Methylenedioxyethylamphetamine
12. Methaqualone B. The laboratory shall also conduct a steroid panel on the donor’s urine specimen that is comparable to the World Anti-Doping Agency’s (WADA) testing program to determine the presence or absence of WADA’s current list of anabolic agents.
C. When requested by the Government, the laboratory shall also conduct tests on the donor’s urine specimen to determine the presence or absence of any ethanol related byproduct that the body produces when metabolizing alcohol.
Section 6 Test Results A. The laboratory’s certified test results will either be submitted to the Contractor, in the case of a pre-employment drug test, or to the Government-identified Medical Review Officer (MRO).
B. When a positive, adulterated, substituted, diluted, and/or invalid specimen certified result is returned by the laboratory the MRO will perform the duties set forth in the Federal Register, 73 FR, 71858 (November 25, 2008), http://www.gpo.gov/fdsys/pkg/FR-2008-11-25/pdf/E8-26726.pdf.
C. The MRO’s final determination/verified result will be reported to DS/OPO/WPS COR and CO, and subsequently to the Contractor.
