The responsibilities of Government quality control program includes, but are not limited to: inspecting the work to ensure compliance with the contract requirements; documenting, through written inspection reports, the res-ults of all inspections conducted: conferring with Contractor representatives regarding any problems encountered in work perform-ance, and generally assisting the COR in meeting contract requirements.
E.3. QUALITY STANDARDS
The Contractor shall ensure that the required services specified in this contract, meet the quality standards outlined therein. All work performed under this contract shall be of the highest quality standards, consistent with best industry practices, to assure timely provi-sion of services, optimum DoS satisfaction, and adequate protection of Government assets.
E.4. GOVERNMENT QUALITY CONTROL
The Government may use a variety of inspection methods to evaluate the Contractor's performance, and more than one (1) inspection method may be used. Examples of inspections are:
(a) Planned (periodic) surveillance of service work items (daily, weekly, monthly, quarterly, semiannually, or annually).
(b) 100% inspection of service work items.
(c) Management Information System Data.
(d) Unscheduled inspections.
(e) Process monitoring.
(f) Unscheduled audits.
(g) Random inspection.
(h) Sampling inspection.
E.5. CRITERIA FOR EVALUATING PERFORMANCE
(a) If DoS inspection reports indicate performance deficiencies, the COR may require the Contractor to explain, in writing, why per-formance was unacceptable, how performance shall be returned to acceptable levels, and how recurrence of the problem(s) shall be prevented in the future. The COR will evaluate the Contractor's explanation and take appropriate action.
(b) At the sole election of the COR, and upon notification to the Contractor, the Contractor may be required to re-perform or perform late any or all defective work disclosed by Government inspection, including incomplete performance. Where the Government so elects, the Contractor shall be notified promptly after inspection that specified defective services must be re-performed or performed late, and completed within a reasonable time, as specified by the Government. In such cases, the Government will re-inspect work designated for re-performance or late performance, and the Contractor may be held liable for any damages sustained by the Govern-ment including, for example, the costs associated with re-inspection.
(c) Re-performance, and the acceptance of re-performance (or late performance), will be determined by the CO or COR on an indi-vidual service work item basis.
(d) Except as otherwise provided by paragraph B and C, above, the services required by this contract are such that defective or incom-plete performance is not normally subject to correction by re-performance or late performance. As such, the Contractor shall not ex-pect permission to re-perform, perform late, or otherwise correct defective services merely to improve an existing inspection rating or avoid a reduction in the full monthly contract payment.
(e) When performance by the Contractor is found to consistently meet and/or exceed performance standards, the Government may elect to reduce the number of inspections made on services performed.
E.6. PERFORMANCE EVALUATION
During the life of the contract, Contractor performance will be documented by means of written inspections, minutes of meetings, DoS/customer surveys, contract compliance reviews, non-refuted deductions, and records which will be retained as part of the official contract file.
Effectiveness of Quality Control:
(a)General: The Government will assess the effectiveness of the Contractor’s Quality Control Program through review of reports re-quired of the Contractor, Service Delivery Information, Customer Response, Surveys, Interim Performance Evaluations, and Disin-centives.
(b) Service Delivery: 1. The quality and timeliness of the Contractor’s (including subcontractor) performance, as well as customer re-sponse will be used to assess the overall service delivery. 2. If the Contractor’s performance remains less than satisfactory or fails to adhere to the contract specifications, the government may contract for the services and charge the contractor for all costs incurred, in-cluding administrative costs.
(c) Inspections: DoS will make tours and inspections throughout and around the buildings and other areas covered by this contract, to ascertain the level of services being performed. The Government may use Contractor Compliance Reviews for all services to be provided by the Contractor. For example, completion of Service Calls, Maintenance Repairs, Preventive Maintenance, operational test, custodial services, snow removal operations, pest control, landscaping, refuse collection, and all other services described within this requirement.
(d) Customer Surveys: DoS may solicit building customers by generating custodial customer feedback surveys, requesting feedback on services being performed, i.e. trash pickup, recycling, room cleaning, restroom cleaning, attitude and professionalism of custodial personnel, etc.
(e) Contract Compliance Review: Facilities Management Services (FMS), on an annual basis, conducts Contractor Compliance Re-views at all their facilities. These reviews are performed, with checklists developed from the signed Contract document, with an on-site review conducted by FMS personnel.
(f) Deductions from QASP or Deduction Table: DoS will assess deductions based on unsatisfactory performance of performance not completed.
(g) Interim/Final Performance Evaluation Report: Prior to completion of the Contract, the Government will summarize all available performance information and prepare an interim evaluation report. (Section C, Exhibit 5). These reports may have a bearing on con-sideration of the contractor for award of future contracts. Failure of the Contractor to pay Subcontractors in a timely manner will res-ult in an unsatisfactory performance rating and may affect the contractor’s ability to receive future government awards and may be subject to termination.
E.7. PERFORMANCE EVALUATION MEETINGS
The Contractor's project manager is required to meet at least weekly with the COR during the contract performance period. However, at the Contractor's, CO's, or COR's request, a meeting may he held whenever a significant contract performance discrepancy is no-ticed. The written minutes of all meetings (prepared by the COR) shall be signed by the Contractor's project manager (or on-site su-pervisor) and the COR. Should the Contractor not concur with the minutes, the Contractor shall identify any areas of nonoccurrence in writing to the CO within one (1) week of receipt of the signed minutes. These weekly meetings may be postponed or discontinued for a period of time if, in the opinion of the COR, contract performance is being provided at an acceptable level by the Contractor.
E.8. DEDUCTIONS
Inadequate performance is just as undesirable as non-performance. The Deduction Table in Section C, Exhibit 4B and 4C, set forth deduction calculations based on categories of non-performance. Any inquiries regarding payment shall be directed to the COR.
