SECTION B — SUPPLIES OR SERVICES AND PRICES/COSTS

B.1 TYPE OF CONTRACT (05/95)

This is an Indefinite-Delivery Indefinite-Quantity (IDIQ) contract to procure comprehensive telecommunications network services for cable and conduit installation repairs at CLASSIFIED and

UNCLASSIFIED Government and Non-Government Facilities. Work on this contract shall commence through the issuance of individual delivery orders/task orders. Contract types for the individual delivery orders/task orders will fall under one or more of the following: Fixed-Price, Labor-Hour, and/or Time-and-

Materials. Some delivery orders/task orders may be performance-based. Performance-based requirements, when applicable, will be conveyed and administered at the delivery order/task order level.

Orders issued against this contract shall be placed in writing in accordance with Sections G.3, which addresses

Task Order procedures and the applicable Section I clauses. U.S. Department of State warranted Contracting

Officer(s) are the only individuals authorized to issue delivery orders/task orders under this contract. Section

G.5 provides specific payment instructions for invoice payments.

B.2 PRICES/COSTS

The structure of the IDIQ contract will replicate the structure of the Time-and-Materials contract type, whereby the Government and the offeror will negotiate fully-loaded fixed hourly labor rates for the labor categories (see below schedule). (For this requirement, the Government has provided RFP-specified not-to-exceed (NTE) costs for the non-labor/Materials elements.)

For this requirement, only one fully-loaded fixed hourly labor rate will be negotiated for each labor category, and the negotiated fully-loaded fixed hourly labor rates will be used on the resultant delivery/task orders. No other fully-loaded rates for these labor categories will be used on the resultant delivery/task orders.

Labor hours for each labor category will be paid at the same negotiated fully-loaded fixed hourly labor rate, regardless of whether the individual performing the labor works (either as an employee or consultant) for the prime contractor or a subcontractor.

If a delivery/task order is awarded in year 1 of the IDIQ contract and has a period of performance that extends into year 2 of the IDIQ contract, the applicable negotiated fully-loaded fixed hourly labor rates for labor hours performed in both year 1 and year 2 must be used in the delivery/task order. The same is applicable if occurring in future years. Non-funded extensions that will cause existing task orders to extend into a subsequent rate period would not typically involve a change in the allowable negotiated fully-loaded fixed hourly labor rates under that delivery/task order; funded extensions that add new work to a task order normally would allow the subsequent year’s negotiated fully-loaded fixed hourly labor rates to apply.

Under these circumstances, all changes in the allowable rates are subject to the contracting officer’s discretion.

The offeror may recover, pursuant to FAR 31.2, allowable, reasonable, and allocable actual incurred costs under cost-reimbursement-type CLINs or delivery/task orders (including the Materials component of a

Time-and-Materials CLIN or delivery/task order).

For cost evaluation purposes only, the Government has provided RFP-specified estimated hours for CLINs

X001 through X010. The Government does not commit to usage of these hours.

For cost evaluation purposes only, the Government has provided RFP-specified not-to-exceed (NTE) costs for CLINs X011 through X015 below. The Government does not commit to expenditure of these costs.
