About this file
This is an administrative policy document from the Suffolk County Sheriff's Department establishing uniform procedures for receipt of process and service of legal documents. The policy, designated S152 and effective as of March 2016, applies to all legal documents requiring the Department, County, Sheriff, or Department personnel to appear or perform official acts. The policy establishes authorization protocols for accepting service of process, designating the Office of the General Counsel (OGC) to handle all process served on the Department, the Custody Assessment Division (CAD) to manage process served upon inmates, the Records Office to accept court requests for inmate records, the Health Services Administrator to respond to inmate medical record requests, and the Human Resources Division to handle employee record requests. Authorization is limited to representatives from these designated offices, with specific procedures established for acceptance during normal business hours (9:00 AM – 5:00 PM), after hours, weekends, and holidays.
The policy outlines distinct procedures for different categories of process service, including routine documents such as writs of habeas corpus, immigration or federal marshal detainers, restraining orders, and warrants. Service on inmates may be performed by Suffolk County deputy sheriffs or other authorized process servers with prior Superintendent approval. Employees receiving process in their official capacity must immediately notify their Shift Commander, division manager, or Superintendent and deliver copies to the OGC within twenty-four hours. Special provisions allow the Special Investigations Division to accept service from the Suffolk County District Attorney's office in cases involving prosecution of inmates for assault on Department staff, with distribution to affected employees and required documentation to the Superintendent and General Counsel. The policy explicitly prohibits lobby officers and Central Control personnel from accepting service and requires all fees accompanying subpoenas to be forwarded to the Director of Financial Services.
