About this file

This is an Administration and Management Policy document (Policy #S132) issued by the Massachusetts Department of Corrections establishing requirements for contract services personnel. The policy, effective January 2015, applies to all consultants, contractors, and employees of external public and private agencies providing services to the Department. The policy establishes mandatory screening, orientation, and supervision procedures for all contract personnel regardless of service duration or nature.

Contract personnel must undergo criminal records review and SID background clearance prior to commencing work, sign written agreements to comply with Department policies and CORI confidentiality provisions, and complete Department orientation if providing services on a regular basis with likely inmate contact. The orientation curriculum includes the inmate guide, disciplinary procedures, Department conduct and sexual abuse/harassment policies, emergency response and evacuation procedures, and facility tours. Contract managers must maintain current contract documentation, and supervising managers must monitor ongoing compliance with contractual terms and Department policies, submitting regular compliance reports to division managers. The policy emphasizes proper supervision and documentation of all contract personnel to ensure accurate accounting of work performed and consistent adherence to contractual obligations.

II. All contract personnel shall be subject to the policies and procedures of the Department.

III. All contract personnel shall undergo a criminal records review prior to commencing work.

IV. All contract personnel shall be informed of the confidentiality provisions in G.L. c.6, the

Criminal Offender Records Information (CORI) statute, and shall agree in writing to abide by its terms.

Procedures

A. The use of contract personnel is subject to the terms and conditions established by a contract, memorandum of understanding, or other written agreement.

B. The contract manager, in collaboration with the division manager assigned supervisory responsibility over the contractor personnel, must complete and process the contract documents in accordance with the Department procurement requirements.

C. The contract manager must maintain a copy of the current contract and associated documentation for all contract personnel providing services to the Department.

I. Screening Process

A. The division manager, or the chief executive officer of the public or private agency engaged to provide services to the Department, is responsible for ensuring that all individuals employed under contract have:
