About this file
This is a Sole-Source Determination Memo issued by the Oregon Department of Human Services (ODHS) Office of Contracts & Procurement on January 8, 2025. The ODHS Director's Office and Central Services division is seeking consulting services for organizational change management and business operational support to streamline operations and increase efficiency across ODHS and its divisions. The procurement involves a Phase 2 engagement following a previously completed Phase 1 assessment conducted by Human Services Group (HSG). Phase 1 included extensive data gathering, staff focus groups with agency leadership and frontline staff, document review, and benchmarking with comparable organizations in other states. Phase 2 will complete the intelligent process redesign with technical support. The prospective contractor is Human Services Group, a legal entity located at 10814 Rainier Avenue South, Seattle, Washington 98178, with contact Kelly Harder. Protests to this sole-source determination must be submitted within seven calendar days after the first date the notice is posted on OregonBuys to the Office of Contracts and Procurement, 500 Summer Street NE, Salem, Oregon 97301.
The estimated total contract value is currently $1,384,446.00. The sole-source justification is based on ORS 279B.075(2)(d), asserting that HSG is the only practical source due to the advanced and in-depth knowledge of ODHS processes and infrastructure acquired during Phase 1. The memo acknowledges that while another vendor could theoretically gain this expertise, doing so would require duplicative work and additional expenditures that are not fiscally responsible. The agency reserves the right to purchase additional services or extend current services based on the complexity of work produced and any unexpected or unresolved issues uncovered during delivery. The procurement authority derives from DHS OAR 125-247-0275 and OAR 125-246-0170(2), with delegation authority under DAS Delegation 649-11, as amended.

Description of goods or services: Consulting Services
1. Background: This sole source justification applies to the purchase of:
In September 2024, ODHS entered into a contract with a Vendor to provide organizational change management and business operational support services in its efforts to streamline operations and increase efficiency in the core services ODHS and its divisions provide to Oregonians. The original vendor subsequently subcontracted the Work to Human Services Group (“HSG”), the prospective contractor we intend to contract with to complete the Project.
The Work of HSG consisted of gathering input from ODHS leadership to develop and implement a detailed project work plan, then collect and analyze current service delivery and organizational structure data from the various ODHS divisions and districts to develop coordinated recommendations and scenarios. Efforts included extensive data gathering, which included service delivery metrics, resource allocation, budgetary information, and geographical needs; conducting staff focus groups with key interest holders, agency heads, district administrators, local representatives and frontline staff; reviewing documents, including policies, procedures, rules and law;
and conducting benchmarking with comparable human services organizations in other states to identify best-practices.
A report at the end of this Phase 1 was produced for ODHS by HSG.
Because of the in-depth knowledge gained by HSG during this Phase 1, it is ODHS intent to Contract with HSG to conduct Phase 2, which will complete the intelligent process redesign, including technical support.

Agency reserves the right to purchase additional services or to extend current services based on the complexity of the Work being produced and unexpected or unresolved issued uncovered during the production of the Work product.
3. Written findings of fact (market research):
The findings below must include factual information supporting the determination that meet the sole source requirement in statute.
Pursuant to ORS 279B.075, Agency must conduct market research that supports the assertion that there is only one source that can provide the goods or services. Market research includes utilization of the internet, trade journals, agency vendor lists, professional organizations, studies, catalogs/industrial periodicals, vendor sources, yellow pages, etc.
Agency must select at least one of the findings and prepare the determination as it specifically relates to the good or service being procured. More than one finding can be addressed. The findings are as follows:
Pursuant to ORS 279B.075 (2)(d): Any other findings that support the conclusion that the goods or services are available from only one source.
Through its completion of Phase 1, the vendor, HSG, has gained advanced and in-depth knowledge of the processes and infrastructure of ODHS and its divisions to be able to provide intelligent and expeditious process redesign of its service delivery to Oregonians. Although the knowledge can be gained by another vendor, it’s not in the State’s best interest to wait for that expertise to be gained by another vendor, nor is it fiscally responsible to pay for that duplicative Work.
