About this file

This is a Right-of-Entry Form for the City of Valdosta, Georgia, authorized under the Georgia Emergency Management Act and the Robert T. Stafford Disaster Relief and Emergency Assistance Act. The form grants the City of Valdosta, its departments, and authorized contractors access to private property for the specific purpose of removing storm-related debris from waterways, including fallen trees and vegetative obstructions that impede water flow, endanger public infrastructure, or pose safety risks. The right-of-entry remains in effect for 180 days from the date of execution, unless extended in writing by mutual agreement. Property owners are required to provide their name, street address, city, state, phone numbers, and Assessor's Parcel Number (APN), and must notify the City or contractor of any known utilities on the property, including sewer lines, septic tanks, and water lines.

The agreement contains a hold harmless clause requiring property owners to indemnify and release the United States Government, Federal Emergency Management Agency, United States Army Corps of Engineers, Natural Resources Conservation Services, Inc., the State of Georgia, the City of Valdoza, and all contractors and their respective agents from liability for damages to property or persons. No compensation is provided to property owners for debris removed or for granting access. Property owners must represent that they have full authority to execute the agreement, and information collected will be shared with government agencies, contractors, subcontractors, and voluntary agencies for official use related to debris removal operations directly affected by Hurricane Helene.
