52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (AUG 2025)

(DEVIATION 25-21) (effective November 28, 2025)

a. A single purchase order will be made to a responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government using the evaluation factors listed below (best value trade off method). The non-price factors are listed in descending order of importance.

Factor 1: Proximity to Andrews Air Force Base

Factor 2: Technical Approach

Factor 3: Organizational Past Performance

Factor 4: Price

Non-price factors, when combined, are more important than price. As vendors approach equality in confidence rating on non-price factors, price will become increasingly important.

b. Factor 1 Proximity to Andrew’s Airforce Base will be evaluated on a pass/no pass basis. Only the vendors that pass Factor 1 will be eligible for evaluation of Factors 2-4.

c. Factor 2 Technical Approach will be evaluated based on the Confidence Rating method. A confidence rating will be assigned based on the content of the Technical Approach Summary that demonstrates the Government’s confidence in the quoter’s proposed approach to successfully perform the services outlined in the SOW.

d. Factor 3 Organizational past performance is a measure of the degree to which the quoter satisfied its customers in the past

(e.g., how well a quoter performed). To assign the Organizational Past Performance confidence rating, the Government will evaluate past performance based on recency, relevancy, and customer satisfaction. Recency is defined as current or previous work within the last five (5) years of the solicitation issue date. Relevancy is defined as work similar to the SOW requirements. The Government is seeking assurances of consistently successful performance.

If the quoter does not have recent and relevant organizational past performance, it will receive a neutral rating instead of a confidence rating. A neutral rating does not give an advantage or disadvantage to the quoter; however, the Government may, in a technical/price tradeoff, determine that a high confidence or some confidence past performance rating is worth more than a neutral past performance rating.

The Contracting Officer has the discretion to retrieve information via quoter supplied references, commercial sources and federal sources including, but not limited to: Contractor Performance Assessment Reporting System (CPARS), and System for Award Management (SAM). The Government may conduct additional outreach and research to include reviews of articles and other publications for timely and relevant news about a quoter’s performance or business integrity, and such findings will be used to assess the quoter’s performance risk. If any negative past performance information is obtained during the past performance evaluation process, the quoter will be provided an opportunity to provide comments, if the quoter has not had an opportunity prior to proposal submission. Note: It is presumed that quoters have previously had an opportunity to respond to adverse past performance for ratings that were entered in the CPARS; therefore, quoters will not be provided another opportunity to address adverse past performance found in CPARS. The Government may review CPARS records that are older than five (5) years of the solicitation issue date

e. The Government will utilize the following confidence rating table in its evaluation for Factors 2 and 3. Each non-price factor will receive its own confidence rating.

Confidence Rating Table

High Confidence

The Government has high confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful in performing the contract with little or no Government intervention.

Some Confidence

The Government has some confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful in performing the contract with some Government intervention.

Low Confidence

The Government has low confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful in performing the contract even with Government intervention.

Neutral (used only for organizational past performance, as needed)

No performance record is available to allow the Government to assign a confidence rating.

f. Factor 4 Price will be evaluated for fairness and reasonableness. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement.

To account for the option periods possible under 52.217-8 (maximum of six months), Option to Extend Services, the

Government will evaluate the option to extend services by adding six months of the quoter’s final option period price to the quoter’s total price. This amount will be the total evaluated price. The price for the effort associated with FAR 52.217-8 will not be included in the total awarded price at the time of award.

If, at the end of the purchase order’s period of performance (the end of the base period or any option period) and within the time period established in the clause, the Government chooses to exercise this option, the pricing will be pursuant to the rates specified in the purchase order for the preceding performance period.

Evaluation of options will not obligate the Government to exercise the options.

The Government may determine that the price quote is unacceptable if there is any significant price imbalance among the periods of performance.

g. The Government intends to evaluate quotes and award a delivery order without discussions with quoters. Therefore, the quoter’s initial quote should contain the best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may request clarifications on quotes without entering into discussions. Clarifications are limited exchanges to resolve minor irregularities or obvious clerical errors (e.g., a missing page, arithmetic errors etc.).

h. A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote).
