The Request for Quotation (RFQ) 25-391 is issued by New Smyrna Beach Utilities in Florida, seeking a licensed and insured HVAC contractor to remove and replace a 6-ton rooftop air conditioning system at their Central Office Building located at 200 Canal Street in New Smyrna Beach. Specific requirements include installing a new 6-ton AC unit (Carrier, Trane, or Tempstar), a matching electric heater, new thermostat, condensate safety switches, and hurricane tie-down clips. The mandatory site visit is scheduled for May 1, 2025, at 9:00 am, with quotations due on May 8, 2025, at 2:30 PM, and all work to be completed on weekdays between 7:00 AM and 4:00 PM.

The contractor will provide a one-year labor warranty and one-year manufacturer parts warranty, with a five-year compressor warranty. The quote tabulation form requests pricing for the rooftop unit, permitting, electrical work, and roofing work, with vendors required to specify the SEER rating, manufacturer, installation and delivery lead times, days to complete, and warranty details. Quotations having erasures or corrections must be initialed in ink by the Vendor. In the event of an extension error(s), the unit price will prevail. Written amounts shall take precedence over numerical amounts.

9. DELIVERY OF QUOTATIONS. Quotations shall be addressed and mailed or delivered as specified on page 1.

10. REJECTION OF QUOTATIONS. To ensure consideration of your quotation, please follow these instructions. Quotations not in compliance with conditions specified herein are subject to rejection.

17. CONSIDERATION OF QUOTATIONS. Commission reserves the right to award the contract to the vendor(s) that Commission deems to offer the best overall quotation. The commission is therefore not bound to accept a quotation on the basis of the lowest price. In addition, Commission at its sole discretion reserves the right to cancel this Solicitation, to reject any and all quotations, to waive any and all informalities and/or irregularities, to re-advertise with either the identical or revised specifications, or not award a contract at all if it is deemed to be in the best interest of Commission to do so. SECTION 2. CHANGES IN THE SCOPE OF WORK.

2.1 The Commission may make changes in the Services at any time by giving written notice to Vendor. If such changes increase, decrease or eliminate any amount of work, Commission and

Vendor will negotiate any change in total cost or schedule modifications. a. Vendor shall require each of its subcontractors to provide the Vendor with an affidavit stating that the subcontractor does not employ, contract with, or subcontract with any unauthorized alien. Vendor shall maintain a copy of the subcontractor’s affidavit as part of and pursuant to the records retention requirements of this Agreement.

b. The Commission, Vendor, or any subcontractor, upon good faith belief that a person or entity with which it is contracting knowingly violated section 448.09(1), Florida Statutes, or the provisions of this section, shall terminate the contract with the person or entity.

c. The Commission, upon good faith belief that a subcontractor knowingly violated the provisions of this section, but the Vendor otherwise complied, shall promptly notify the

Vendor and the Vendor shall immediately terminate the contract with the subcontractor.

d. A contract terminated under the provisions of this section is not a breach of contract and may not be considered as such. Any contract terminated under the provisions of this section may be challenged pursuant to section 448.095(2), Florida Statutes. Vendor acknowledges that upon termination of this Agreement by the Commission for a violation of this section by Vendor, Vendor may not be awarded a public contract for at least one (1) year. Vendor further acknowledges that Vendor is liable for any additional costs incurred by the

Commission as a result of any contract for a violation of this section.

e. Vendor or subcontractor shall insert in any subcontracts the clauses set forth in this section, including this subsection, requiring the subcontractors to include these clauses in any lower tier subcontracts. The vendor shall be responsible for compliance with any subcontractor or lower tier subcontractor with the clauses set forth in this section.
