PROJECT NP-FOOT 8G16, 8H10

REHABILITATION OF FOOTHILLS PARKWAY WEST (SECTIONS 8G AND 8H)

REQUEST FOR PROPOSALS

RFP No. 693C73-22-R-000001

Project Description: The project consists of pavement rehabilitation of Foothills Parkway West (Section 8G and 8H). The project begins near MP 55.27 at the existing gate west of the interchange with connector roads to State Route 73/US Route 321 (E Lamar Alexander Parkway) and has many scenic pull-offs along its 17-mile length. The roadway ends at MP 72.21 at the intersection with U.S. Route 129 (Calderwood Highway). The work includes full depth reclamation of Foothills Parkway, scenic pull-offs and parking areas; removal of existing pavement markings, installation of permanent pavement markings, replacement and repairs of drainage structures including: culverts, ditches and paved waterways; replacement of damaged sections of existing steel-backed timber guardrail; bridge maintenance repairs; repair of stone masonry parapet walls; removing and replacing sidewalks and resetting stone curbs; reseeding shoulders; replacing existing signs; constructing ADA ramps, replacing gates and traffic loop detectors and other miscellaneous work. The project is located in Blount County, Tennessee.

The construction cost for the project is estimated to be more than $10,000,000.

Scope of Work: The detailed scope of work to be undertaken by the successful Offeror under the contract for this project is outlined in the Request for Proposal (RFP) solicitation documents.

These include the Plans, Special Contract Requirements (J Pages), and supplemental Government Furnished Information.

Procurement Overview of the Project: In accordance with Federal Acquisition Regulation (FAR) Part15, the Eastern Federal Lands Highway Division (EFLHD) is conducting a Best Value Trade-off Source Selection Process for this project. Under this Notice, the EFLHD (also referred to as “the Government”) is soliciting all eligible Contractor firms/teams (Offerors) to participate in a two-step RFP process. The two steps will include the submittal of two proposal packages; a Technical Proposal and a Price Proposal. A description of these proposals and their requirements can be found in the RFP’s Proposal Instructions (B Pages).

During step one, a selection evaluation board will review and evaluate the technical proposals submitted by all interested, responsive Offerors. The selection committee will select qualified Offerors based on a confidence rating evaluation criteria as stated in the RFP’s Proposal Instructions - Evaluation of Proposal Documents (B Pages). Offerors should submit technical proposals that are acceptable without additional explanation or information. The Government may make a final determination regarding a technical proposal’s acceptability solely on the basis of the technical proposal as submitted. The Government may proceed with the second step (trade-off evaluation) without requesting further information from any Offeror; however, the

Government may request additional information from any Offeror with a technical proposal considered reasonable and close to acceptable, and may discuss any technical proposal with any Offeror. Only one technical proposal may be submitted by each Offeror. The step one technical proposal shall not include any prices or pricing information.

During step two, the Government will select the offer that represents the best value to the Government by using the trade-off process described in FAR Part 15. This process permits tradeoffs between price and technical (“noncost” factors and allows the Government to accept other than the lowest priced offer. The award decision will be based on a comparative analysis and an integrated assessment of proposals against all source selection criteria in the solicitation.

All evaluation factors other than cost or price, when combined, are weighted equal to cost or price. The Government is concerned with striking the most advantageous balance between technical merit (“quality”) and cost to the Government (i.e., the price). The degree of importance of price could become greater depending upon the equality of the technical proposals. If competing technical proposals are determined to be essentially equal, price could become the controlling factor. Only one price proposal may be submitted by each Offeror and the price proposal must be based upon the Offeror’s own technical proposal.

As stated in FAR Clause 52.236-1, the Contractor shall perform on the site, and with its own organization, work equivalent to at least 15% of the total amount of work to be performed under the contract.

Contract award is anticipated to be no earlier than December 2021, with Notice to Proceed anticipated to be issued after the receipt of valid Performance and Payment Bonds (see Block 12a of the SF-1412 and FAR Clause 52.228-15), and the anticipated start of construction activities to be no earlier than March 2022. Other traffic control restrictions are specified in Subsection 108.01 of the Special Contract Requirements (J Pages). The Contractor is fully responsible for acquiring all environmental permits for this project.

It is not the intent of EFLHD to receive project specific design or engineering recommendations as part of the step one technical proposal. Offerors should limit their technical proposal to the information required by this Notice, and other information that may be relevant to the qualifications and experience of the Offeror. No reimbursement will be made for any expenses associated with the preparation of a step one technical proposal or a step two price proposal.

Obligation to Keep Team Intact: In connection with the services covered by this procurement process, any in-house personnel, subcontractors, and outside associates will be limited to the individuals or firms that are specifically identified during the step one technical proposal. The Contractor shall obtain the Contracting Officer’s written consent before making any substitution for these designated in-house personnel, subcontractors, or outside associates.

Supplemental Work: Offerors are expected to provide qualified and experienced staff to develop appropriate pre-construction or construction protocols as designated by Federal, state, and local regulations/guidelines, including but not limited to the following:

• Work Plan

• Accident Prevention Plan

• Health and Safety Plan

• Environmental Management Plan

• Waste Management Plan

• Recycling Plan

Submittals: Each Offeror must provide the required number of Technical and Price Proposals as described below to EFLHD in separate, sealed envelopes/boxes clearly addressed and identified for “Project No. NP-FOOT 8G16, 8H10.”

Submit one (1) bound paper copy, one (1) unbound copy, and one (1) CD-ROM copy of the Technical Proposal. Submit the Technical Proposal copies separately from the Price Proposal in a sealed envelope/box and clearly labeled as the “Technical Proposal.”

Submit two (2) unbound paper copies and one (1) CD-ROM copy of the Price Proposal. Submit the Price Proposal copies separately from the Technical Proposal in a sealed envelope and clearly labeled as the “Price Proposal.”

Federal Highway Administration Eastern Federal Lands Highway Division Quantum Park 22001 Loudoun County Parkway Building E-2, Suite 300 Ashburn, Virginia 20147 Attn: C. Shawn Long / ACQUISITIONS

The estimated price is expected to be more than $10,000,000.

Responsibility of bidders shall be evaluated in accordance with the information provided on the Bidder's Qualification Form, which can be downloaded from the Contract Opportunities website located at http://SAM.gov. FP-14 versions can be downloaded at the FHWA web site located at http://flh.fhwa.dot.gov/resources/specs/.

Basis for Award:

EFLHD intends to award a fixed price contract without discussions with offerors (except http://sam.gov/ http://flh.fhwa.dot.gov/resources/specs/ clarifications as described in FAR 15.306(a)); therefore, the offeror's technical and price proposal should be clear and complete and contain the offeror's best terms. The Government reserves the right to conduct discussions if later deemed necessary. The Government further reserves the right to reject any or all offers if such action is in the Government's best interest.

The Government will select the offer that represents the best value to the Government by using the trade-off process described in FAR Part 15.101-1. This process permits tradeoffs between price and technical “non-cost” factors and allows the Government to accept other than the lowest priced offer. The award decision will be based on a comparative analysis and an integrated assessment of proposals against all source selection criteria in the solicitation.

Evaluation of Award:

All evaluation factors other than cost or price, when combined, are approximately equal in their importance when compared to cost or price. The Technical Proposal of the Offeror awarded the contract will be incorporated into the contract by reference and the Contractor shall be bound by its contents. The technical proposal evaluation factors will be weighted as follows: Factor 1 = 35%. Factor 2 = 35%. Factor 3 = 30%.

Please Note:

This solicitation is a Request for Proposal (RFP). Therefore, there will not be a public bid opening and proposals are not available for review.

will be based on the Unit Bid Price.

To be eligible for award, Offerors must submit prices for each pay item.

Review Subsection 109.05 of the FP (standard specifications book) regarding scope of payment for direct and indirect payment work.

Fill in the Bid Total(s) for each individual Schedule of Work as directed on the Cost Proposal Summary page. Fill in the Evaluation Total Price of Project in the space provided on the Cost Proposal Summary page.

The Offeror’s Price Proposal is considered to be a combination of the completed Bid Schedule (pages B-1 to B-12) and the completed Cost Proposal Summary page (page B-13).

The amount in Block 17 of the SF 1442 should be completed as follows:

Schedule A - $ Schedule B - $ Schedule C - $ Schedule D - $ Schedule E - $ Schedule F - $

SCHEDULES OF WORK

The Bid Schedule is comprised of the following separate schedules and options of work:

Schedule A (Base Contract) - Pages B-1 thru B-4 Schedule B (Government Option 1) - Pages B-5 thru B-6 Schedule C (Government Option 2) - Page B-7 Schedule D (Government Option 3) - Pages B-8 thru B-9 Schedule E (Government Option 4) - Pages B-10 thru B-11 Schedule F (Government Option 5) - Page B-12

The Government will award the project as a Base Contract (Schedule A) with the option to award Schedules B, C, D, E and F (Government Options 1, 2, 3, 4 and 5); see FAR Clause 52.217-5.

The purpose of the multiple schedules and options is to give the Government maximum flexibility in completing the project in a timely manner and at a cost-effective price, by proper utilization of programmed funds and upon receipt of any additional funds required to award the contract. If complete funding is in place at the time of award of Schedule A (Base Contract), the Government may award Schedules B, C, D, E or F (Government Options 1, 2, 3, 4 or 5) at that time. If additional funding is required for the award of Schedules B, C, D, E or F (Government Options 1, 2, 3, 4 or 5), and is received after the award of Schedule A (Base Contract), the Government has the right to exercise Schedules B, C, D, E and F (Government Options 1, 2, 3, 4 and 5) at the unit prices bid no later than the completion date of Schedule A.

COMPLETION OF WORK

If the Government awards the contract as Schedules A + B + C + D + E + F all at the same time, the performance period to complete all contract work will be 493 calendar days.

If the Government awards the contract as Schedule A plus a combination of one or more of the Government Options, the performance period of the contract will be the total time of the individual performance periods of each awarded schedule as specified below. For example, if Schedules A + B + C are awarded, the performance period of the contract will be XX calendar days (XX+XX+XX).

Schedule A: 196 calendar days Schedule B: 95 calendar days Schedule E: 132 calendar days

The government assumes Schedules C, D, and F will be completed concurrent to the activities associated with Schedules A, B, and E and as such, no additional time will be given for Schedules C, D, and F.

If any of the remaining Government Options are exercised after the award of the original contract, the number of calendar days specified above will become the performance period for that Government Option and will be added to the performance period of the original contract.

In developing a construction schedule to determine the number of calendar days, the Government considered and included the work limitations shown in Sections 108 and 156 of the FP and Special Contract Requirements (SCR’s). Specific work limitations may be (but are not limited to): National legal holidays, weekends, rush hours, night work, specified no work periods, work or traffic control phasing, etc. The Government also considered those work items that are weather sensitive and when those work items will be performed.
