The award will be procured using negotiated procedures, as it has been determined in accordance with FAR 6.401 to be the most appropriate method of contracting for the construction project.

3. The project magnitude is between $100,000 and $250,000 for the base item. (Reference FAR 36.204 Disclosure of the magnitude of construction projects)
III. EVALUATION
A. BASIS FOR AWARD
1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest price. Therefore, proposals should be submitted initially on the most favorable price and technical terms.
2. The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
3. The best value continuum source selection process to be used for this acquisition is the Lowest price technical acceptable process as described in FAR 15.101-2. An overall non-price factor rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factor proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factor rating of “UNACCEPTABLE” makes a proposal ineligible for award.
4. The Government reserves the right to make award to an Offeror that satisfies the general responsibility standards of FAR 9.104-1. If a Contractor is determined non-responsible and their proposal is acceptable, the non-responsible determination makes their proposal ineligible for award. The Contracting Officer may either make a responsibility determination without requesting any information from an Offeror or require the Offeror provide information to substantiate that it satisfies the general responsibility standards of FAR 9.104-1. The particular information requested from an Offeror will be specific to that Offeror. The Contracting Officer may consider an Offeror’s inability to promptly respond to a request for information as an indication the Offeror is non-responsible since FAR 9.103(c) obligates prospective Contractors to affirmatively demonstrate their responsibility.
Note: When the Contracting Officer requests responsibility information, the Contracting Officer’s request, the Offeror’s response, and all related communications between the Government and Offeror are solely for the purpose of determining whether the Offeror is responsible. These communications will not constitute discussions within the meaning of FAR 15.306 since the Offeror will not be given an opportunity to revise its proposal.
B. EVALUATION FACTORS FOR AWARD
1. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be the lowest price technically acceptable. The solicitation requires the evaluation of price and the following non-price factor:
FACTOR 1 – Past Performance
2. The non-price factor is approximately equal to price.
3. Basis of Evaluation and Submittal Requirements for each Factor.
(a) PRICE
Provide one (1) electronic copy via e-mail of the solicitation submittal requirements for pricing.
(i) Executed SF 1442. Offerors shall provide information requested under Proposal Submittal Instructions and insert price for line item 0001 in Section 00010. Price shall be considered available for award no later than November 30, 2020.
(ii) Completed price proposal spreadsheet.
(iii) Acknowledgement of all amendments, if applicable.
(iv) Proof of the Offeror’s filled out Representations and Certifications and Active and Inactive Exclusions from the System for Award Management (SAM).
(v) Provide payment bond in the amount of 100 percent of the total bid price; and submit irrevocable letter of credit (see Clauses 52.228-13 Alternative Payment Protections and 52.228-14 Irrevocable Letter of Credit).
Note: The payment bond, SAM registrations must be in the name/CAGE/DUNS of the offeror identified on the DD 1155.
(vi) Basis of Evaluation: The Government will evaluate price based on the total price. Total price consists of the basic requirement. Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:
o Comparison of proposed prices received in response to the RFP.
o Comparison of proposed prices with the IGE.
o Comparison of proposed prices with available historical information.
o Comparison of market survey results.
(b) NON-PRICE
Provide one (1) electronic copy via e-mail of the solicitation submittal requirements for non-price.
Factor 1 – Past Performance
(i) If a completed Contractor Performance Assessment Reporting System evaluation is available for a previous HVAC project, it shall be submitted with the proposal. If a CPARS evaluation is not available Contractor shall provide brief narrative of two (2) previous HVAC projects for other customer/clients; to include customer/client name, title, company or agency name, phone number, and e-mail address of customer/client. The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references may affect the Government’s evaluation of this factor.
Offerors may provide any information on problems encountered and the corrective actions taken on previous projects. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
Performance award or additional information submitted will not be considered.
(ii) Basis of Evaluation: This evaluation will consider how well the Offeror’s team performed on previous relevant projects and may also consider past performance on other projects currently documented in known sources.
The Government will consider the project date, relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s team’s past performance will be used as a means of evaluating the Offeror’s team’s probability to successfully meet the requirements of the RFP.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance. Offeror will receive a rating of unknown.

52.225-9 BUY AMERICAN—CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. As used in this clause--
Commercially available off-the-shelf (COTS) item—
(1) Means any item of supply (including construction material) that is--
(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4) such as agricultural products and petroleum products.
Component means an article, material, or supply incorporated directly into a construction material.
Construction material means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site.
Materials purchased directly by the Government are supplies, not construction material.
Cost of components means--
(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or
(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.
Domestic construction material means--
(1) An unmanufactured construction material mined or produced in the United States;
(2) A construction material manufactured in the United States, if--
(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or
(ii) The construction material is a COTS item.
Foreign construction material means a construction material other than a domestic construction material.
United States means the 50 States, the District of Columbia, and outlying areas.
(b) Domestic preference.
(1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.
(2) This requirement does not apply to…
