Proposers may not contact members of the evaluation committee except at the City of Wausau's request.

Preliminary Evaluation of Mandatory Requirements The proposals will be initially reviewed to determine if mandatory requirements are met. Mandatory requirements in this RFP include minimum vendor experience and qualified resources as described in Section 3. Failure to meet mandatory requirements shall result in the proposal being rejected. If all proposers do not meet one or more of the mandatory requirements, the City of Wausau reserves the right to continue the evaluation of the proposals that most closely meet the mandatory requirements of this RFP.

Right to Reject Proposals The agency reserves the right to reject any and all proposals.

Proposal Scoring Accepted proposals will be reviewed by an evaluation committee and scored against the stated criteria. The committee may review references, request interviews/presentations, conduct demonstrations and/or conduct on-site visits. The resulting information will be used to score the proposals. The evaluation committee's scoring will be tabulated, and proposals ranked based on the numerical scores received. The City of Wausau reserves the right to seek clarification of any information received. Proposers may be requested to answer additional questions. If these additional questions are asked, they will be evaluated against stated criteria, scored and ranked.

Evaluation Criteria The proposals will be scored using the following criteria:

Ability to provide hardware to specifications
250
Ability to provide software to specifications

Total Possible Points

Interviews/Presentations and/or Site Visits Top-scoring proposers, based on the evaluation of the written proposal, may be required to have interviews/presentations to support and clarify their proposals, if requested by the City of Wausau. The city will make every reasonable attempt to schedule each interview/presentation at a time and location that is agreeable to the proposer. Failure of a proposer to complete a scheduled interview/presentation to the city may result in rejection of that proposer's proposal. The city may conduct site visits of proposer and/or references’ facilities to clarify or confirm proposal information.

Final Evaluation Upon completion of any interviews and/or presentations by proposers, the City of Wausau's evaluation team will review their evaluations and adjust the scores based on the information obtained in the interview/presentation, demonstration, possible reference checks, and any other pertinent proposer information.

Award and Final Offers Award will be granted in one of two ways. The award may be granted to the highest scoring responsive and responsible proposer after the original evaluation process is complete.

Alternatively, the highest proposer or proposers may be requested to submit best and final offers. If the city requests best and final offers, they will be evaluated against the stated criteria, scored, and ranked by the evaluation committee. The award will then be granted to the highest scoring proposer following that process. However, a proposer should not expect that the city will request a best and final offer.

Notification of Intent to Award All proposers who respond to this RFP will be notified in writing of the City of Wausau's intent to award the contract(s) as a result of this RFP. After notification of the intent to award is made, and under the supervision of agency staff, copies of proposals will be available to the public.

Negotiate Contract Terms The agency reserves the right to negotiate the terms of the contract, including the award amount, with the selected proposer prior to entering into a contract. If contract negotiations cannot be concluded successfully with the highest scoring proposer, the agency may negotiate a contract with the next highest scoring proposer.

Appeals Process Irrespective of whether a Proposer/offeror submits a protest before or after contract award, the protester must exhaust all administrative remedies with the procuring agency before pursuing a protest with the City of Wausau, WisDOT, or FTA.

Based on alleged apparent improprieties in a solicitation and violation of a statute or a provision of the Wisconsin Administrative Code, an intent to protest must be filed no later than five (5) working days after the notices of intent to award is issued. The protest must be filed with the procuring agency no later than ten (10) working days after the notice of intent to award are issued. In all other cases, protests must be filed no later than 10 days after the basis of protest is known or should have been known, whichever is earlier.

Notices of intent to protest and protests must be made in writing. Protestors should make their protests as specific as possible and should identify statutes and Wisconsin Administrative Code provisions that are alleged to have been violated. Failure to substantially comply with any of these provisions may be grounds for dismissal of the protest.

Must include the following information:

a. The protestor’s name, address, fax and telephone numbers.

b. Solicitation or contract number.

c. Detailed statement of the legal and factual grounds for the protest, including a description of resulting prejudice to the protester.

d. Copies of relevant documents.

e. Request for a ruling by the subrecipient.

f. Statement as to the form of relief requested.

g. All information establishing that the protester is an interested party for the purpose of filing a protest.

h. All information establishing the timeliness of the protest.

Protests shall be filed in writing to the procurement officer of this RFP.

The procurement officer will issue a decision on the protest within 10 working days of receiving the written protest. A copy of the decision will also be provided to the WisDOT Transit Procurement Manager.

If the Proposer/offeror is not satisfied with the outcome following the review of the initial protest by the procuring agency, the Proposer/offeror can pursue remediation directly with the Wisconsin Department of Transportation (WisDOT). WisDOT’s review will be limited to whether there were improprieties in the solicitation process or if there was a failure of the procuring agency’s procurement system.

If the protestor had alleged a violation of a statute and specific provision(s) of Wisconsin Administrative Code and the decision of this formal process fails to resolve the complaint, the complainant, within five (5) working days of the issuance of that decision, may refer the matter to the Director, Bureau of Transit and Local Roads, Wisconsin Department of Transportation, P. O. Box 7913, Madison, WI 53707-7913 with a copy of such appeal filed with the Procurement Administrator.
