Notes:

1. Prices shall be in the United States dollar.

2. Multiple awards will not be made.

3. See Document 00 22 00 for the Price Evaluation. The total price for all CLINs (0001 through 0007) will form the basis for the evaluation noted in Document 00 22 00.

4. A firm-fixed-price is required for all line items. The following NAVFAC language applies:

ALL OR NONE OFFERS - Offers are solicited on an “all or none” basis and FAR 52.215-1, INSTRUCTIONS TO OFFERORS-COMPETITIVE ACQUISITION in Document 00 21 16, is hereby modified. Failure to submit offers for all line items listed shall be cause for rejection of the offer.

5. In the event there is a difference between a unit price(s) and the extended total(s), the unit price(s) will be held to be the intended offer and the total(s) recomputed accordingly. If an offer provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.

6. Payment for SLIN 0001AB, 0001AC, 0001AD, 0001AE, 0001AF, 0001AG, and 0001AH shall be for actual quantities only. The unit prices will be used to adjust the contract price for any increase or decrease in the estimated quantities subject to the clause FAR 52.211-18, VARIATION IN ESTIMATED

QUANTITY (APR 1984).

7. The basis of pricing for SLIN 0001AB to 0001AE Landfill Zone Management must be as follows: 5% of material by volume must be treated as Asbestos Containing Material (ACM) and be removed from site in accordance with the drawings and specifications, 35% of material by volume must be treated as Waste Material and be removed from site in accordance with the drawings and specifications, and 60% of material by volume must be treated as Landfill Soil Material and excavated, tested, and compacted as backfill in landfill area (within areas outside of the zone of influence for the Aircraft Apron) in accordance with the drawings and specifications. Refer to specification 31 23 00.00 20 and Construction Environmental Management Plan (CEMP) for additional Landfill Zone Management requirements.

8. The following notes apply to CLINs 0004 and 0007 for Furniture, Fixtures, and Equipment (FF&E):

a. Government Estimated Amount for FF&E. The Government Estimated Amount for FF&E, as shown above (SLIN 0004AA and 0007AA), includes the material cost, freight and installation charges. The Government Estimated Amount has been identified to provide Offerors with the projected magnitude of effort for FF&E. The total CLIN 0004 and 0007 amounts shall include all costs to procure, install and store the Furniture, Fixtures, and Equipment and includes the Prime Contractor’s proposed Handling and Administrative Rate (HAR).

b. Prime Contractor Handling and Administration Rate (HAR). Offerors may propose a HAR fee in SLIN 0004AB and 0007AB, up to but not to exceed 5%, for the handling and administration of the FF&E. This fee will account for all administrative costs; overhead; bonding fees, if any;

administration of subcontractors; profit; and any other costs associated with and related to the coordination and processing of the procurement and installation of the FF&E. The prime contractor’s proposed HAR mark-up will be applied to the Government Estimated Amount to derive a total proposed price for CLIN 0004 and 0007.

RFP NO. N62742-24-R-1308

FY23 MCON P-923 AIRCRAFT PARKING APRON,

FY25 MCON P-941 MAINTENANCE SUPPORT FACILITY,

c. The prime contractor’s HAR percentage rate will be incorporated into the contract as proposed and will not be adjusted regardless of fluctuations in the Government Estimated Amount. The HAR is a fixed percentage rate that will be utilized in calculating the final price for the planned modification. When the final FF&E package is priced, the contractor’s proposed HAR percentage rate, as incorporated into the contract, will be applied to the selected supplier/vendor’s quote to arrive at a total proposed price for final negotiation of the planned modification.

d. It is anticipated that a planned modification will be awarded at least nine months prior to the completion of the work. The planned modification will be issued after receipt of appropriate funding. A minimum of nine months is required for the contractor to purchase, deliver and install the FF&E without impacting the overall completion date of the project. No schedule extensions will be granted if the planned modification is awarded at least nine months prior to the contract completion date. If the Government decides to negotiate and award the planned modification less than nine months prior to the contract completion date, the contractor may be entitled to a contract extension.

9. For evaluation purposes only, in the event of a discrepancy between the extended price for the HAR and the actual calculation of the HAR percentage proposed multiplied by the Government Estimated Amount, the Government will use the percentage proposed and will adjust your proposal accordingly.

10. The total price for CLINs 0001 through 0003, and CLINs 0005 through 0006 shall be exclusive of the

Australian Goods and Services Tax. See Section 01 11 00 General Requirements, Australian Requirements Schedule, paragraph 10 GST, for tax reimbursement procedures.

11. DFARS 252.247-7023, TRANSPORTATION OF SUPPLIES BY SEA. Within 30 days of each shipment, the Contractor is required to provide an electronic copy of the carrier’s bill of lading to the Contracting Officer and to MARAD via email. MARAD email: Cargo.MARAD@dot.gov (attn.: MIL team). In addition, the Contractor shall notify the Contracting Officer when oceanic shipments have been initiated within 3 working days of shipment.

(a) Definitions. As used in this provision-

Discussions are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer’s discretion, result in the offeror being allowed to revise its proposal.

In writing, "writing," or "written" means any worded or numbered expression that can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.

Proposal modification is a change made to a proposal before the solicitation’s closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.

Proposal revision is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.

Time, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.

(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).

(c) Submission, modification, revision, and withdrawal of proposals. (2) The first page of the proposal must show–

(i) The solicitation number;

(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);

(ii) (A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and-

(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(3) It is the only proposal received.

(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.

(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of items.

(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.
