J&A No. 24-003
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
Department of the Navy, Naval Facilities Engineering Systems Command (NAVFAC), Pacific, Joint Base Pearl Harbor-Hickam, Hawaii.
2. Description of the Action Being Approved
The purpose of this Justification and Approval (J&A) is to include proprietary specifications for Det-Tronics Triple Infrared (IR) Optical Flame Detectors in Fiscal Year 2024 MCON P-949 Aircraft Maintenance Hangar, RAAF Darwin, Australia. The brand name description is essential to the activity’s requirements, thereby precluding consideration of a product manufactured by any other company. This J&A is to cover only the portion of the acquisition that relates to this brand-name specification. The brand name item has been determined to be available from only the following source: Det-Tronics, located at 6901 West 110th Street, Minneapolis, MN 55438, Phone +1 (952) 941-5665. The brand name specification is for:
Four (4) Det-Tronics X3301 Multispectrum IR Flame Detectors
3. Description of Supplies/Services
The primary purpose of the project Fiscal Year 2024 MCON P-949 Aircraft Maintenance Hangar, RAAF Darwin, Australia, is to construct a Type II Aircraft Maintenance Hangar to support MV- 22 Osprey, CH-53E Sea Stallion, UH/AH-1 Venom Viper, Marine Heavy Helicopter (HMH) and Marine Light/Attack Helicopter (HMLA) and construction of an area distribution nod or telecommunications distribution facility.
The project is being delivered in conjunction with the following projects:
Fiscal Year 2023 MCON P-923 Aircraft Parking Apron and Infrastructure, RAAF Darwin, Australia
Fiscal Year 2024 MCON P-941 Maintenance Support Facility and Armory, RAAF
Darwin, Australia
The Det-Tronics X3301 is a multispectrum infrared flame detector. It provides unsurpassed detection of fires from light to heavy hydrocarbon fuels combined with the highest degree of false alarm rejection. The detector has Division and Zone explosion-proof ratings and is suitable for use in indoor and outdoor applications. The Det-Tronics X3301 Multispectrum IR Flame Detector contains three IR sensors with their associated signal processing circuitry. The standard output configuration includes fire alarm, fault and auxiliary relays, with an isolated 0– 20 mA output model with optional HART communication. The detector provides superior performance in applications that are at the extremes and where background infrared radiation is a normal condition.
The estimated total cost for each individual X3301 Multispectrum IR Flame Detector is
, bringing the estimated total cost for four (4) X3301 Multispectrum IR Flame Detectors to . This comprises approximately of the total project cost of . The type of funds used for the entire project are Fiscal Year 2025 Military Construction funds. The intent is to award the project by March 2025.
4. Statutory Authority Permitting Other Than Full and Open Competition
The statutory authority permitting the use of other than full and open competition procedures is Title 10, U.S.C. 3204(a)(1). One source or limited sources, as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. Rationale Justifying Use of Cited Statutory Authority
Unified Facilities Criteria (UFC) 4-211-01, “Aircraft Maintenance Hangars”, Section 7-6.4, requires hangars to be provided with Det-Tronics X3301 Multispectrum IR Flame Detectors for releasing service of the low-level trench nozzle system via a releasing service fire alarm control unit (RSFACU). The requirement for the low-level trench nozzle system in hangars was removed by NAVFAC Interim Technical Guidance Fiscal Year 2023-02 (ITG), “Navy and Marine Corps Facilities with Aqueous Film Forming Foam (AFFF) Fire Suppression Systems”, dated June 1, 2023, to comply with the phase out of all foam fire extinguishing agents in NAVFAC hangars in accordance with the 2020 National Defense Authorization Act approved by Congress. The ITG still requires Triple Infrared Optical Flame Detectors be provided; however, they are not required to be tied to a RSFACU, but should instead be connected to the building fire alarm system.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
On 7 December 2023, an announcement was published on the public-facing website for all federal contracting opportunities – the System for Award Management (SAM) website – in accordance with DFARS 206.302-1, to identify other potential responsible sources of supply that can provide a Triple Infrared Optical Flame Detector that has the same requirements as a Det- Tronics X3301 Multispectrum IR Flame Detector:
a. Equipment shall be UL listed and/or FM approved.
b. Equipment shall be an optical flame detector utilizing the triple infrared principal.
c. Equipment shall be immune to radar and radio frequency emissions.
d. Equipment shall be for detecting carbonaceous fuels.
The announcement closed on 21 December 2023 and no responses were received. Furthermore, on 28 December 2023, a review of market research undertaken to meet a similar requirement was conducted. Fiscal Year 2018 P-260 Corrosion Control Hangar, North Ramp, Andersen Air Force Base, Guam issued a Sources Sought Notice on 22 December 2016 for an identical Triple Infrared Optical Flame Detector. One response was received from but the Government concluded that was unable to provide a viable alternative to the Det-Tronics X3301 Multispectrum IR Flame Detector.
As the requirements of UFC 4-211-01, Section 7-6.4 specifically identify the use of Det-Tronics X3301 Multispectrum IR Flame Detectors and no other known manufacturers of Triple Infrared Optical Flame Detectors with the same requirements responded to the SAM announcement, the Government concluded that there are no other known manufacturers of Triple Infrared Optical Flame Detectors that can meet the Government’s needs and requirements.
7. Determination of Fair and Reasonable Cost
Based on market research conducted by the Government, competition is currently unavailable for this product. There are no comparable pieces of equipment with which to compare prices. The absence of the Det-Tronics X3301 Multispectrum IR Flame Detectors would create unacceptable safety risks to the P-949 site as the Det-Tronics X3301 Multispectrum IR Flame Detector is the only known solution which provides unsurpassed detection of fires from light to heavy hydrocarbon fuels combined with the highest degree of false alarm rejection from radar and radio frequency emissions from hand held equipment or equipment on-board the aircraft. As such, the Contracting Officer has determined the anticipated cost of for services covered by this J&A to be fair and reasonable.
8. Actions to Remove Barriers to Future Competition
This is a one-time procurement. This J&A applies to the design and construction of MCON P-949 Aircraft Maintenance Hangar, RAAF Darwin, Australia, for which a market survey to ascertain the availability of new technology that may provide for other sources to meet the Government’s needs has been conducted as referenced above. Should any other offers for compatible Triple Infrared Optical Flame Detectors be submitted during the source selection process, the Government will consider each as applicable.

JUSTIFICATION AND AUTHORIZATION
FOR OTHER THAN FULL AND OPEN COMPETITION
USE OF PROPRIETARY SPECIFICATIONS
5. Rationale Justifying Use of Cited Statutory Authority
Utilizing the Romteck Fire Alarm Signaling Equipment meets the requirements of “UFGS 28 31 76, Interior Fire Alarm and Mass Notification System, Addressable”, while simultaneously meeting the Host Nation requirement to interface with the existing RAAF Base Darwin fire monitoring network, which is managed by Air Services Australia.
Specification Section UFGS 28 31 76, Interior Fire Alarm And Mass Notification System, Addressable requires the devices and equipment for fire alarm service to be listed by ActivFire, which provides the Evidence of Suitability as required by the Building Code of Australia. Under the ActivFire Scheme, products are processed according to their certification classification and verified as complying with relevant standards, technical specifications and/or the requirements of recognized conformity assessment bodies.
The purpose of the ActivFire listing is to ensure quality, suitability, and reliability of the equipment, with the objectives of the ActivFire Scheme for certification and listing of active fire protection equipment including the following outcomes:
To verify the conformity (compliance) of equipment through physical testing and appraisal to relevant and endorsed standards and specifications (reference criteria);
To verify and recognize approvals and certifications by other national and international bodies;
To provide an effective and transparent mechanism for appraisal, testing, certification and listing of emerging and new technologies in the field of active fire protection equipment and systems;
To provide reference documentation and information which supports the various building regulation and authority requirements for "Evidence of Suitability" for equipment used in building construction;
To maintain a continuing process that provides means by which the conformity of changes to products can be submitted and verified; and
To maintain a Register of Fire Protection Equipment to publicly list and promulgate, products which meet established reference criteria for listing.
The ActivFire listing ensures that either the equipment or material meet appropriate standards or has been tested and found suitable for use in a specified manner, however, provides no assurance that fire detection and prevention equipment is compatible with other proprietary equipment. A fire alarm system comprised of mixed manufacturer’s equipment is not known to have been approved to date. The possibility of using non- Romteck equipment to interface with the existing base fire detection and prevention equipment may diminish fire protection capabilities, and therefore, has the potential to endanger life and property. The requirement for Romteck Alarm Signaling Equipment ensures reliable fire alarm protection for the personnel and new assets to be installed under this project.
Installation of non-Romteck alarm signaling equipment will result in substantial duplication of cost to the Government that is not expected to be recovered through competition. If a non-Romteck ASE was procured for this project, NAVFAC Pacific would subsequently need to procure a non-Romteck base wireless alarm monitoring network, using Private Cellular WAN and 3G/4G services, to replace the existing system. It will cost the RAAF Darwin base in excess of to upgrade the entire installation’s fire notification system to service/operate non-compatible devices on the P-923, P-941 and P-949 projects. The cost of this change in base infrastructure, training, and operational costs of maintaining multiple systems far outweighs the cost of per unit for the Romteck Australia Pty Ltd, ASE model RM3118-IP-WIP-ASE.
Installation of non-Romteck alarm signaling equipment will also result in unacceptable delays in fulfilling the agency’s requirements. Installation of non-Romteck alarm signaling equipment will prevent approval by the Fire Department at RAAF Darwin, which will delay the commissioning and handover to operations.
JUSTIFICATION AND AUTHORIZATION
FOR OTHER THAN FULL AND OPEN COMPETITION
USE OF PROPRIETARY SPECIFICATIONS
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
On 26 December 2023, an announcement was published on the System for Award Management (SAM) website, in accordance with DFARS 206.302-1 to identify other potential responsible sources of supply that can provide an ASE that can meet the Government’s requirements for Projects P-923 Aircraft Parking Apron, P-941 Maintenance Support Facility, and P-949 Aircraft Maintenance Hangar at RAAF Base Darwin, Northwest Territories, Australia. The announcement closed on 9 January 2024 with no responses received. had listed itself as an interested vendor, however no technical data was provided. On 9 January 2024, an effort was made to request detailed technical data from however, no response was received. Therefore, is not considered. As such, it can be interpreted that there are currently no other responsible sources of supply, other than Romteck, that can meet the Government’s requirements for Projects P-923 Aircraft Parking Apron, P-941 Maintenance Support Facility, and P-949 Aircraft Maintenance Hangar at RAAF Base Darwin, Northwest Territories, Australia. Therefore, the Romteck Australia Pty Ltd, ASE model RM3118-IP-WIP-ASE is the only ASE that meets the Government’s requirements.
7. Determination of Fair and Reasonable Cost
