About this file
This is an example project development lease document from the Michigan Department of Natural Resources (DNR), Forest Resources Division, authorizing the design, construction, and maintenance of utility-scale solar photovoltaic (PV) systems on state-owned land. The lease grants the lessee rights to explore, construct, and operate solar energy production facilities, including the right to ingress and egress, construct necessary buildings and structures, make excavations, install powerlines, and develop roads and other improvements required for utility-scale renewable energy production and sale. The lease term consists of a primary period of five years from execution, with potential extensions available at the lessor's sole discretion upon written application by the lessee. All operations require separate written permissions from the lessor and any applicable local, state, or federal governmental agencies, with specific site locations and land descriptions subject to lessor approval.
The lessee shall pay annual rental at a rate of $XX.00 per acre per year, with the first year's rental due upon lease execution and subsequent payments due annually in advance. A performance bond of $10,000.00 is required as security for faithful performance of lease conditions. The lessee bears responsibility for all taxes and assessments on the leased premises and improvements thereon, worker's compensation insurance as required by state law, and liability insurance in amounts customary for similar operations, with proof of insurance required before operations commence. The lessor reserves the right to grant rights-of-way and easements across the premises and retains the ability to cancel the lease with 30 days' written notice if the premises are no longer used for stated purposes, if the lessee provided false or fraudulent information, or if the lessee fails to cure material breaches within 30 calendar days of written notice. The lessee must maintain the premises in good order and repair throughout the lease term and provide an independent environmental assessment upon or by lease inception.
