About this file
This is Addendum #4 to a Request for Proposals issued by the State of Michigan Department of Natural Resources for Utility-Scale Solar Energy Development Leases (RFP# 200000001868). The addendum addresses vendor questions and answers regarding project requirements and terms. The document clarifies that fencing requirements apply only during the surface use lease term covering construction and operations phases, not during the development lease period. Additionally, the contractor's representation regarding premises condition is required at the time of the operational surface use lease execution rather than during the development lease phase. The successful bidder will have the opportunity for further diligence after RFP award before making such representations.
The addendum provides clarification on financial requirements, confirming that bidders must post a $50,000 bond during the project development lease term, not the $10,000 amount referenced in an example schedule. Regarding environmental considerations, the Michigan Department of Natural Resources has not conducted a wetlands evaluation on either proposed site; however, the successful bidder is required to comply with all applicable regulatory requirements, including those administered by the Michigan Department of Environment, Great Lakes and Energy (EGLE), if regulated wetland areas will be disturbed during project development or operations.

State of Michigan, Department of Natural Resources Utility-Scale Solar Energy Development Lease RFP# 200000001868 – Addendum #4, Vendor Questions and Answers Q1. Schedule A 1.2.2: The document states "Fencing (6 ft. height chain link) shall be installed around the project area to exclude other uses.". Can you please confirm this is only during the Surface Use Lease term (construction and operations) and not early development?
A1. Yes, this requirement is only during the term of the surface use lease, not during the term of the development lease.
Q2. Schedule A 1.2.2: The document states "Contractor stipulates, represents, and warrants that Contractor has examined the premises, and that they are at the time of this lease in good order, repair, and in a safe, clean, and tenantable condition." When do we have to make this representation? Will we have the opportunity for further diligence after RFP award?
A2. This would be done at the time of the operational surface use lease, not the development lease.
Q3. Schedule A 1.4: Schedule A and Exhibit C seem to conflict. Can you confirm whether the successful bidder will be required to post $50,000 or $10,000 during the term of the project development lease?
A3. Schedule C was only intended as an example. The $50,000 requirement in Schedule A is the correct number.
Q4. Schedule A 7: Can DNR could confirm the presence or absence of wetlands on either site? If wetlands are present, are they subject to the typical permitting process (via EGLE) or is there special consideration given the prior use of the sites?
A4. DNR has not evaluated potential wetlands on either site. The successful bidder would be required to meet all necessary regulatory requirements if any regulated wetlands areas will be disturbed for the project.
