The lump sum prices for road reconstruction Items 13(a) Mobilization, 13(b) Soil Erosion and Pollution Control and 13(l) Temporary Traffic Control shall be awarded based on the percentage of Item 13(g) Road Reconditioning miles awarded.

The award amount for optional Item 14 Fall and Leave Individual Hazard Trees shall be based on a rough percentage of the total Unit acreage awarded. Payment for this item shall be based on the actual number of trees fallen.

SPECIAL REQUIREMENTS:

A. Service Contract Act minimum wages applies to all fuels management work and road maintenance work. See Wage Determination in Section J.

B. The road reconstruction work required within Mandatory Items 6(a-u) and Optional Items 13(a-l) is subject the the Construction Wage Rate Requirements (see Wage Decision in Section J) and related regulations, formerly referred to as Davis-Bacon (i.e. certified payroll submission).

C. A Bid Guarantee is required in an amount equal to 20% of the total price offered for the Mandatory and Optional Construction Items only. BID BONDS MUST BE PROVIDED WITH THE INITIAL OFFER. See FAR 52.228-1 Bid Guarantee (SEP 1996) (DEVIATION MAY 2023) in Section I.

D. Payment and Performance Bonds shall be required in an amount equal to 100% of the awarded value of road reconstruction work. See Section I. FAR 52.228- 1\Performance and Payment Bonds -- Construction (JUN 2020) (DEVIATION MAY 2023). Bonding costs shall be included in the prices quoted for Mobilization. No separate payment for bond premiums shall be made.

E. As service requirements, fuels management and road maintenance work are not subject to bonding requirements.

F. A Draft Small Business Subcontracting Plan is required with any proposal from a large business. Refer to FAR 52.219-9 Small Business Subcontracting Plan for requirements.

Performance of land management activities shall be in accordance with the Project Description and Work Specifications. Payment for Land Management Work Activities in Schedule of Items will be made in Stewardship Credits and Appropriated Funds.

All Base Work Activities (Mandatory) shall be performed. Optional activities are not listed in order of planned priority. Award may be made for optional items in any order that the Contracting Officer determines is in the best interest of the Government.

SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

CLAUSES C.1-C.8 APPLY TO ALL WORK

C.1 BACKGROUND

The BCLH Stewardship IRSC Phase 3 shall be awarded under stewardship contracting authority.

This authorizes the U.S. Forest Service (Government) to enter into stewardship contracts or agreements to achieve land management goals for the National Forests or public lands that meet local and rural community needs.

Roadside hazard tree mitigation will be performed within the Opal Creek Scenic Recreation Area as part of this contract. Legislation designating the Opal Creek Wilderness and the Opal Creek Scenic Recreation Area (SRA) was passed in 1996 and established November 1998. The Opal Creek SRA is 13,538 acres. It includes Elkhorn Creek, a Wild and Scenic River. The Opal Creek Wilderness is 20,827 acres and includes the 8,000 acres of the Bull of the Woods Wilderness, located within the Willamette National Forest Boundary. Management for the SRA is under the Opal Creek Management Plan for the SRA which is now part of the Willamette National Forest Land and Resource Management Plan.

Per the SRA Management Plan, timber harvesting and cutting and selling of trees, including salvage sales, within the SRA are prohibited. The cutting of trees in the SRA is only occurring in cases for public safety such as removal of hazardous trees along roads and trails and controlling spread of fire, and activities related to administration of the SRA. No commercial product removal is allowed to occur within the SRA. Only tribal uses of non-traditional forest products and limited personal use generally associated with recreation activities takes place within the SRA. These restrictions include the sale of firewood.

C.2 SCOPE OF CONTRACT

The objectives of this project are to reduce the risks of hazardous fuels that have fallen across or remain standing along important access routes of the 2020 fire-affected road system so that access to and through the burned area can be restored. Fire severity varied across the treatment areas; burn severity maps and tables are included for planning purposes.

Activities include performing mitigation of risk along roads from fire killed/damaged trees, reduction of roadside fuel accumulation and essential maintenance and reconstruction of roads.

This will be done by accomplishing the following:

• Cut and remove fire killed timber within 100 feet of roads from the Contract Area.

Hazard trees to be cut are Designated by Prescription. Mechanized equipment shall operate on existing road prisms only (bottom of ditch to base of outside fill slope).

• Fall hazard trees within Special Measure Areas (SMAs). SMAs may include Riparian Reserves, cultural resource areas, wildlife habitat protection areas or other areas that requires special protections such as the Opal Creek Scenic Recreation Area. This work is located within 100 feet of the road. SMAs do not overlap acres that require the cutting and removal of fire killed trees.

• Within unit boundaries, fall and leave hazard trees that can strike the road outside of the 100-foot fuels removal area.

• Perform small fuels treatment within 30 feet of roads.

• Perform road reconstruction within the Contract Area.

• Perform pre-haul, during-haul and post-haul road maintenance on designated roads within the Contract Area.

• Yard and deliver fish logs to specified deck locations.

• Fall and leave individual hazard trees that are outside of unit boundary but within striking distance of the road.

The Contractor shall furnish the necessary personnel, material, equipment, services and facilities (except as otherwise specified), to perform the Statement of Work and Specifications referenced in Section J.

Any resultant contract will be a construction contract with service requirements and requirements for timber removal. Under this contract, “Contractor’s Operations” shall include activities of or use of equipment of Contractor, Contractor’s employees, agents, Subcontractors, or their employees or agents, acting in the course of their employment in operations hereunder on National Forest lands or within Forest Service protection boundary (unless acting under the immediate supervision of Forest Service). Contractor’s Operations shall be conducted in a workmanlike and orderly manner. The timing of required Forest Service designation of work on the ground and the performance of other Forest Service work shall not be such as to cause unnecessary delay to Contractor.

C.3 PROJECT LOCATION

The BCLH Stewardship IRSC Phase 3 project is located approximately 1 to 5 miles west of Detroit, OR within the burn scars of the Beachie Creek Fire and Lionshead Fire, both of which occurred in 2020. Portions of the Contract area also fall within the Opal Creek Wilderness and Scenic Recreation Area (16 U.S. Code § 545b). The total project area is 1,843 acres in size and is located on the Detroit Ranger District of the Willamette National Forest. Access to the project is via FSR 46. The ground to be treated is within Sec 23-28, 32-34 & 36, T08S, R04E; Sec 31, T08S, R05E; Sec 2-5, & 11, T09S, R04E; Sec 6-8, 13-17, 20-26, 28, 35, & 36, T09S, R05E; Sec 19-29, T09S, R06E; Willamette Meridian, Surveyed & Unsurveyed, Marion County, Oregon.

See maps included as attachments to the solicitation. These maps are geo-referenced for practical application using Avenza. Shapefiles have also been provided in a zip folder. A shapefile is a simple, nontopological format for storing geometric location and attributes information of geographic features. GIS (Geographic Information System) software is required to open and

C.4 TECHNICAL SPECIFICATIONS

Technical specifications for service work are found in Appendix A. Technical specifications for timber removal are found in Appendix B. Road maintenance technical specifications are located in Appendix C and technical specifications for road reconstruction are found in Appendix D.

Appendix D includes signed construction drawings and Forest Service Supplemental Specification to tailor the FP-14 standard specifications.

Standard Specifications for Construction and Bridges on Federal Highway Projects, FP-14, U.S.

Customary Units apply to the road reconstruction work and are included in this solicitation by reference only. The requirements contained in these Specifications are hereby made a part of the solicitation and any resultant contract. Copies of the Specifications are available by performing an internet search for the FP-14.

C.5 CONTRACT AREA MAP

The boundaries of restoration activities and their approximate acreages are identified in Appendices A, B, C, and D as well as Subdivisions and any cutting units thereof, are as shown on the attached "Contract Area Map," which is made a part hereof, and were, before solicitation, designated on the ground by Forest Service to meet the anticipated needs of the parties.

Subdivisions may be revised and additional ones may be established only by written agreement of both parties. Where applicable, the following are also identified on Contract Area Map:

(a) Identified claims limiting Contractor's rights

(b) Boundaries of cutting units

(c) Areas where leave trees are marked to be left uncut

(d) Roads listed

(e) Sources of base course, rock riprap and surface rock

(f) Roads where log hauling is prohibited or restricted

(g) Roads and trails to be kept open

(h) Improvements to be protected

(i) Locations of known historical sites

(j) Maximum stump heights when more than one height is listed by areas

(k) Skidding or yarding methods specified

(l) Streamcourses to be protected

(m) Other features required by Appendix B; and

(n) Boundaries of stewardship work activities.

C.6 OPERATING PLAN AND SCHEDULE

The Contractor will provide, as part of the technical proposal, a detailed timeline of when the contract requirements will be accomplished while conforming to the requirements within Section F. The operating plan should indicate the sequence of activities that will take place to

FAC 2025-03 January 17, 2025 accomplish the tasks described within the solicitation, Appendix A, Appendix B, Appendix C, and Appendix D including proposed start and completion dates.

Depending upon how the contractor proposes accomplishing the activities within the solicitation, the Operating Plan and Schedule may be developed by indicating when and how all work activities within individual units will be completed, when and how individual tasks will be completed, or a combination of when and how units or tasks will be completed. The contractor should be able to display through an operating plan and schedule that all the contract activities will be accomplished in a timeline that will meet the contract requirements.

C.7 SUSTAINABLE ACQUISITIONS

The Contractor shall comply with the Agricultural Act of 2014; the Food, Conservation and Energy Act of 2008 (FCEA), 7 U.S.C. 8102; the Farm Security and Rural Investment Act of 2002 (FSRIA), 7 U.S.C. 8102; the Federal Acquisition Regulation; Executive Order (EO) 13514, “Federal Leadership in Environmental, Energy and Economic Performance,” dated October 5, 2009; EO 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” dated January 24, 2007; and Presidential Memorandum, “Driving Innovation and Creating Jobs in Rural America through Biobased and Sustainable Product Procurement,” dated February, 2012 to provide biobased products.

In compliance with FAR Part 23.4 through performance of this contract, the Contractor shall make maximum use of EPA designated and USDA designated biobased in accordance with FAR clause 52.223-2 Affirmative Procurement of Biobased Products under Service and Construction Contracts and 52.223-17 Affirmative Procurement of EPA-designated Items in Service and Construction Contracts

The Contractor shall utilize products and material made from biobased materials (e.g. biobased greases, biobased hydraulic fluids, biobased absorbents) to the maximum extent possible in the performance of this contract without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. Information about this requirement and a catalog of products are available at the Bio-Preferred Web Site.

The Contractor shall utilize products and material to the maximum extent possible in the performance of this contract from EPA’s list of designated products and the accompanying recommendations for post-consumer content and recovered materials content in the following eight categories: Construction products, Landscaping products, Non-paper Office Products, Paper and Paper Products, Park and Recreation products, Transportation Products, Vehicular Products, and Miscellaneous Products.

7.1.1 Bio Preferred Products:

a Diesel Fuel Additives

(1) Any substance, other than one composed solely of carbon and/or hydrogen, that is intentionally added to diesel fuel (including any added to a motor vehicle's fuel system) and that is not intentionally removed prior to sale or use.

(2) Neat biodiesel, also referred to as B100, when used as an additive. Diesel fuel additive does not mean neat biodiesel when used as a fuel or blended biodiesel fuel (e.g., B20). 90% - Minimum Biobased Content.

b Hydraulic Fluids - Mobile Equipment Hydraulic fluids formulated for general use in nonstationary equipment, such as tractors, end loaders, or backhoes. 44% - Minimum Biobased Content.

c Penetrating Lubricants Products formulated to provide light lubrication and corrosion resistance in close tolerant internal and external applications including frozen nuts and bolts, power tools, gears, valves, chains, and cables. 68% - Minimum Biobased Content.

d Greases - Truck Lubricants composed of oils thickened to a semisolid or solid consistency using soaps, polymers or other solids, or other thickeners. Lubricants that are designed for use on the fifth wheel of tractor trailer trucks onto which the semi-trailer rests and pivots. 71% - Minimum Biobased Content.

e Gear Lubricants Products, such as greases or oils, that are designed to reduce friction when applied to a toothed machine part (such as a wheel or cylinder) that meshes with another toothed part to transmit motion or to change speed or direction. 58% - Minimum Biobased Content.

f Fuel Conditioners Products formulated to improve the performance and efficiency of engines by providing benefits such as removing accumulated deposits, increasing lubricity, removing moisture, increasing the cetane number, and/or preventing microbial growths within the fuel system. 64% - Minimum Biobased Content.

C.8 DEFINITIONS

Acceptable Quality Level: The allowable leeway or variance from a standard before the government will reject the specific service. As long as the percent of defective performance does not exceed the AQL, the service will not be rejected by the government. The contractor, however, must re-perform the defective service when possible.

Biobased Products: See Sustainable Acquisitions

Contracting Officer (CO): Individual with authority to bind the government with their signature on the contract.

Contracting Officer Representative (COR): Individual(s) designated to act on the behalf of the CO within the delegation given them in writing.

Period of performance (also Performance period or Contract time): All calendar days allowed for completion of contract work. Includes all days of the week including weekends and holidays.

Quality Assurance: Those actions taken by the government to check goods or services to determine that they meet the requirements of the Statement of Work (SOW).

Quality Assurance Surveillance Plan (QASP): An organized written document used for quality assurance surveillance. The document contains information about how the government will assess performance, checklists, and may contain decision tables.

Quality Control: Those actions taken by a contractor to control the production of goods or services so that they will meet the requirements of the Performance Work Statement. Refer to Inspection and Acceptance 52.246-4 or 52.246-12 and Contractors Quality Control Plan as described in Section E.

a. Biobased Products: Managed by the U.S. Department of Agriculture (USDA), the goal of the BioPreferred program is to increase the purchase and use of biobased products. The BioPreferred program was created by the 2002 Farm Bill and reauthorized and expanded as part of the Agricultural Act of 2014 (the 2014 Farm Bill). The program's purpose is to spur economic development, create new jobs and provide new markets for farm commodities.

The increased development, purchase, and use of biobased products reduce our nation's reliance on petroleum, increase the use of renewable agricultural resources, and contribute to reducing adverse environmental and health impacts. Information on biobased/bio-preferred products can be found at the BioPreferred Site . The Contractor shall comply with the clause at FAR 52.223-2, Affirmative Procurement of Biobased Products Under Service and Construction Contracts and the provision at FAR 52.223-1, Biobased Product Certification.

EPA-designated items: Products that are or can be made with recovered material. The Comprehensive Procurement Guideline (CPG) program is part of EPA's continuing effort to promote the use of materials recovered from solid waste. Buying recycled-content products ensures that the materials collected in recycling programs will be used again in the manufacture of new products. The contractor shall comply with the clause at FAR 52.223-17 Affirmative Procurement of EPA-designated Items in Service and Construction Contracts.

SECTION E--INSPECTION AND ACCEPTANCE

CLAUSES E.1-E.2 APPLY TO ALL WORK

E.1 CONTRACTOR QUALITY CONTROL INSPECTION SYSTEM

The Contractor shall identify the quality control inspection system it will use to ensure that contract specifications will be achieved. At no time shall the contractor rely upon Government inspections to provide notification of unsatisfactory performance. The Contractor shall produce written inspection records in a format and at times and places satisfactory to the Contracting Officer. Inspection records shall be made available upon request of the Contracting Officer and be maintained until the date of contract closure. The Contracting Officer may observe the Contractor's inspection at any time and shall otherwise have unlimited access to the inspection data.

Quality Control Plan. The Contractor shall provide a general Quality Control Plan (QCP) with the technical proposal. The Contractor shall supplement the QCP within 7 days before start work based on items awarded to the Contractor and Government comments. The contractor shall conduct quality control inspections on all aspects of work. The field inspections shall be performed on each item and sub-item listed in the Schedule.

The general Quality Control Plan must demonstrate how the Contractor will assure quality meets the requirements and specifications of the contract. The Plan shall describe how quality will be monitored to assure the performance standards are met, the supervision of crew and work, and personnel that will be performing the quality control.

Contractor Quality Control Inspection. At no time shall the contractor rely upon Government inspections to provide notification of unsatisfactory performance. The Contracting Officer may observe the Contractor's inspection at any time and shall otherwise have unlimited access to the inspection data. Inspection procedures must provide the following information:

E.3 FAR 52.246-4 Inspection of Services- Fixed Price (AUG 1996)

E.4 ACCEPTANCE OF SERVICES

The Contractor shall provide a written request for inspection and submit inspection sheets in accordance with the QCP. The Government will conduct an inspection and up to one re-inspection for each unit. If the contractor fails to meet the minimum AQL (acceptable quality level), the contractor shall rework the unit. Anytime more than two inspections are required per unit, the contractor may be assessed for additional inspections, which will include mileage and hourly rate of the COR. If follow-up inspections indicate that the minimum AQL was not met, FAC 2025-03 January 17, 2025 the work will be deemed unsatisfactory and a deduction in payment may result (Appendix A, Section V). Acceptance may be made for all or portions of work.

SECTION F--DELIVERIES OR PERFORMANCE

CLAUSES F.1-F.5 APPLY TO ALL WORK:

F.1 FAR 52.242-14 Suspension of Work (APR 1984)

F.2 FAR 52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 10/15/2028 for the Mandatory Work Items excluding Item 7 and 10/15/2029 for the Optional Items awarded.

Mandatory Item 7(a-c): Yard and Deliver Fish Logs to Deck Locations shall be completed not later than 10/15/2026.

** No operations will occur between October 16 – May 14 except as detailed for Unit BC-4.

See F.4 Contract Operations Schedule below.

**Due to construction work planned on FSR 4600000 under a separate construction contract, haul of fish logs is anticipated to be restricted in the summer of 2025.

Timber removal activities shall be scheduled and carried out in accordance with the Timber Removal Specifications in Appendix B and C and as approved by the Contracting Officer. The road reconstruction activities shall be scheduled and carried out in accordance with Appendix D.

The time stated for completion shall include final cleanup of the premises.

The effective period of this contract is from date of award through 10/15/2029.

F.4 CONTRACT OPERATIONS SCHEDULE

Hazard tree falling can occur year-round on FSR2209000 road. Wet weather operational rock shall be applied during the dry season, before any operations can occur during the wet season. No hauling of fish logs may occur in between October 16 – May 14. The roadway and drainage features must be kept clear during operation.

Opal Creek Ancient Forest Center (OPAFC) employees shall be given access to their Jawbone Flats inholding on FSR 2209000 for the duration of the contract. The OPAFC shall be contacted 1 week in advance if a road closure longer than 4 hours expected.

Private land access

Ground-based operations and haul on aggregate surface roads will be suspended during wet periods when soil moisture is high and after heavy or prolonged rain.

Additional measures for clarification:

Ground-based operations would temporarily cease when:

• Precipitation ≥ 0.3” for 3 consecutive days or more.

• Precipitation ≥ 0.6” per 4 hours.

• Precipitation ≥ 1.0” per 24 hours.

• Precipitation ≥2.0” per 72-hours.

Ground-based operations may continue after a shutdown if both of the following conditions are met unless otherwise approved to resume by the COR:

• No rainfall in 48-hours.

Precipitation be measured according to a running average of the data measured from the appropriate Remote Automated Weather Station

(RAWS).

Additional visual indicator factors that may require a temporary cessation of operations are visible signs of road damage as described in the 2016 Willamette Road Rules

Road reconstruction as specified in Appendix D shall occur during the dry season (May 15 through October 15). Live stream crossings shall only be replaced during the designated ODFW In- Water-Work Window (June 1 to August 31) for the watershed unless a variance is authorized by ODFW and the FS Fish Biologist.

Except for wet weather operation rock placed on FSR-2209000, no road reconstruction work is required prior to timber falling and haul.

To minimize erosion and sediment to streams

Unless agreed to by the contracting officer, fuel treatments shall be completed within one year from when trees are fallen.

Fire safety
