ATTACHMENT 1 - APPENDIX A
PERFORMANCE WORK STATEMENT FOR SERVICE ITEMS
SECTION I – DESCRIPTION OF WORK:
The objectives of this project are to reduce the risks of hazardous fuels that have fallen across or remain standing along important access routes of the 2020 fire-affected road system so that access to and through the burned area can be restored. Fire severity varied across the treatment areas; burn severity maps and tables are included for planning purposes.
Activities include performing mitigation of risk along roads from fire killed/damaged trees, reduction of roadside fuel accumulation and essential maintenance and reconstruction of roads. This will be done by accomplishing the following:
• Cut and remove fire killed timber within 100 feet of roads from the Contract Area. Hazard trees to be cut are Designated by Prescription. Mechanized equipment shall operate on existing road prisms only (bottom of ditch to base of outside fill slope).
• Fall hazard trees within Special Measure Areas (SMAs). SMAs may include Riparian Reserves, cultural resource areas, wildlife habitat protection areas or other areas that requires special protections such as the Opal Creek Scenic Recreation Area. This work is located within 100 feet of the road. SMAs do not overlap acres that require the cutting and removal of fire killed trees.
• Within unit boundaries, fall and leave hazard trees that can strike the road outside of the 100-foot fuels removal area.
• Perform small fuels treatment within 30 feet of roads.
• Perform road reconstruction within the Contract Area.
• Perform pre-haul, during-haul and post-haul road maintenance on designated roads within the Contract
Area.
• Yard and deliver fish logs to specified deck locations.
• Fall and leave individual hazard trees that are outside of units but within striking distance of the road.
SECTION II – WORK ITEMS
The following requirements apply to work items 1-3, 8-10 and 14:
1. GENERAL FELLING AND YARDING SPECIFICATIONS
• Notwithstanding Appendix B, provisions B6.41, B6.411, B6.5 and B6.61, felling objectives shall be accomplished in accordance with the requirements detailed below.
• To protect streams and streambanks from damage, trees that are adjacent to Riparian Reserves should be felled away from, or parallel to, the Riparian Reserve.
• Within Riparian Reserves, fall trees larger than 16 inches in diameter into stream channels but do not block the inlet or outlet of a culvert or create a road side hazard.
• Fuel and other petroleum products must be stored and refueling must occur at least 150 feet from any stream or other waterbody.
• Skidding logs down roadways is prohibited.
• Cut stumps to a maximum height of 12 inches, or 1/3rd of stump diameter.
• Yarding and decking operations (i.e., log loader) must avoid blocking drainage features (i.e., ditch lines, cross drain culverts, stream crossings) to the maximum extent possible. Log decks shall not be placed in ditch lines or within 100 feet of a defined stream course (i.e., showing annual scour).

• Where slopes do not allow for decking off the road on the uphill side, decking is to occur on the downhill side of the road, off the road. “High Stumping” is required to allow logs to be decked on the downhill side in a safe manner. After logs are removed, cut stumps off at 12 inches and leave the “high stump” on the ground.
• Whole tree yarding is required.
The following requirements apply to work items 1-3, 8-10 and 14:
2. CUTTING AND REMOVAL SPECIFICATION FOR HAZARD TREES
DESIGNATION BY PRESCRIPTION. Within Subdivision(s) or cutting unit(s) Mandatory: BC-2, BC-3, BC-4, BC-5 and Optional: BC-2A, BC-2B, BC-2BB, BC-6, BC-7, LH-10, LH-7, LH-73, LH-7A, LH-7AA, LH7AB, LH-7B, LH-7C, as shown on Contract Area Map, the following criteria describing the desired end results shall be used by Contractor to designate trees and other products for cutting and removal that meet Utilization Standards:
Pertains to all Subdivisions:
• Acceptable Range of Down Wood Retention: 7 trees per acre.
• Down Wood Retention trees shall avoid being retained in clumps and should be dispersed across the acre.
These trees shall be felled perpendicular to the slope and behind existing stumps if available. Down trees should be no closer than 20’ from the road, where possible.
• Ground-based operations are required and are restricted to the road prism in all units.
• Where slopes are less than 40%, Hazardous Fuel trees on the uphill and downhill side of the road will be felled if they are within one tree height distance of the road edge.
• Where slopes are greater than 40%, Hazardous Fuel Trees on the uphill side of the road will be felled if they are within one and a half tree height distance of the road edge. On the downhill side of the road trees will be felled if they are within one tree height distance of the road edge.
• Hazardous Fuel Trees felled beyond the 100’ distance from the roadway will be left in place.
• Trees with greater than 25% lean away from the road shall NOT be cut.
• Trees with no green needles shall be cut.
Indicators of Hazardous Fuel Trees
• Live trees with greater than 50% of the bole cross-sectional area burned and consumed or at least one quadrant of burned and consumed structural roots shall be cut.
• Trees with greater than 50% of the structural roots undermined or severed on a road cut bank shall be cut.

These units are the exception to removal prescription above. No commercial product removal is allowed to occur within the portions of these units located within Opal Creek Scenic Area.
ALL SMA-2
Riparian reserve widths are defined as 344’ from both sides of designated fishbearing streams. Reserve widths for all non-fishbearing streams and ponds are 172’ all sides. Refer to Tree Removal Guideline Maps for reserve widths.
All Riparian Reserves must be delineated by the contractor prior to starting work in a unit. This requirement does not apply to the portions of units within the Opal Creek Scenic Area because no removal is allowed by law.
Note that Riparian Reserves are based on the National Hydrologic Data flow layer and that they may be incorrect on the ground. Any defined stream channel has a Riparian Reserve associated with it.
Clarify questionable sites with the COR prior to starting work.
All trees less than 16” DBH and meeting Appendix B, A.2 Timber Subject to Agreement specs within 100’ of the road edge. A minimum of 1-end suspension is required for removal.
Trees exceeding 16” DBH may only be removed in the following situations with COR prior approval:
• tree cannot be safely felled away from the road, or
• if left, tree would disrupt flow in a road drainage feature, or
• if left, tree would cause an unsafe condition for travel along a road.
Avoid dragging logs except over newly felled logs (do not drag over rotten logs, vegetation, or displaceable biomass).

SMA-3 • No included timber.
Prescription Definitions:
• 25% Lean: A tree has a 25% lean when a plumb line from the top lands a distance equal to 25% of the tree’s height from the stump. For example, a 60-foot tree with its top 12 feet from the stump has a 20% lean (12 ÷ 60); at 16 feet, the lean is 27% (16 ÷ 60). Lean is measured perpendicular to the road.
• Included Timber: Included Timber is material to be removed from National Forest Land.
• Fine Fuels: Fine Fuels is material less than 16 inches diameter.

1 Tree Height Distance:
• When on the uphill side of the road: Tree height distance means any individual tree can be up to its total height away from the road based on slope distance when corrected for horizontal distance. So, a 100-foot-tall tree is within 1 tree height distance if it is 90 feet away from the road, however it is outside of 1 tree height distance if it is 110 feet away from the road.
• When on the downhill side of the road: Tree height distance means any individual tree can be up to its total height away from the road based on slope distance. So, a 100-foot-tall tree is within 1 tree height distance if it is 90 feet away from the road, however it is outside of 1 tree height distance if it is 110 feet away from the road.
1.5 Tree Height Distance:
• When on the uphill side of the road: Tree height distance means any individual tree can be 1.5 times its total height away from the road based on slope distance when corrected for horizontal distance. So, for example, a 100-foot-tall tree on an 83% slope which is 195 feet slope distance from the road is included (100 x 1.3 slope factor x 1.5).
• When on the downhill side of the road: Tree height distance means any individual tree can be up to its total height away from the road based on slope distance. So, for example, a 100-foot-tall tree which is 150 feet slope distance from the road is included (100 x 1.5).
Slope Corrected for Horizontal Distance: For trees on the uphill side of a road, the distance a tree can be from the road is adjusted by an adjustment factor to account for slope. The formula is the Horizontal Height (tree height) times the slope adjustment factor = the horizontal distance corrected for slope. For example, a 100-foot-tall tree above the road on a 75% slope can be 100 x 1.25 = 125 feet from the road.

Mandatory Item 4: Small Fuels Treatment <16” DBH 0-30 Feet from Road Edge (271.9 acres)
• Small fuels treatment includes existing downed, tops and limbs from trees cut and removed under Mandatory Item 1, Optional Item 8 and Timber Subject to Agreement removed from SMAs, or cut trees less than 16-inch DBH that do not meet fuel loading standards within 30 feet on each side of the road edge.
• Fuels may be be chipped, lopped and scattered, and/or removed from NFS lands to meet fuels standards.

• If the offeror chooses to chip, material may be chipped and left on site or hauled off National Forest Land.

• Slash disposal of woody debris will include 525 fish logs of various sizes and 350 cubic yards of slash (woody debris less than 8-inch DBH) staged for fish habitat restoration at the following locations and quantities.
o Fish Logs may include logs that are either merchantable or non-merchantable (i.e. does not meet merchantable standards in Division A, Appendix B).
o Fish Logs must be Decay Classes 1 and 2. Decay Classes 3, 4, and 5 are not acceptable. Fire damaged, dead and dying trees that still meet Class 1 and 2 with or without significant amounts of char are acceptable.
o Fish Logs must be delimbed and processed to the dimensions described in the tables below.
o The staging areas will be staked or flagged by the Forest Service and this material will not be scaled. If Optional Unit BC-6 is awarded, the Contractor shall remove fish logs from this unit BC-6 first, to assist with restoration of recreation facilities.
o At staging locations, sort logs and debris into separate log decks and woody debris piles according to the size classes listed in the tables below.

Optional Item 14: Fall and Leave Individual Hazard Trees >100 Feet from the Road (up to 1500 individual trees)
• Adjacent to the listed units there may be fire killed trees that are located outside the unit boundary, but are still tall enough to fall and strike the road.
• The Contractor shall survey along the outside boundaries of each unit and identify trees that meet the cutting prescription. Payment will only be made for trees that meet the cutting prescription.
• Trees felled into the 100-foot removal area will count towards the downed wood requirement.
• Contractors will track individual trees that are felled with a log of GPS points and date for COR approval and acceptance.
SECTION III – CONTROL OF WORK
The Contractor agrees to conduct its operations under this contract and other related business activities in compliance with Federal, State, and local statutes, standards, orders, permits and other regulations.
The Contractor shall meet all State and local environmental quality laws applicable to National Forest system lands.
Work may be done any time during the term of the contract, except under the following conditions:
1. The government reserves the right to prioritize the order in which Units are treated.
2. When conditions are such that operations shall be restricted or ceased due to increased fire risk.
3. When seasonal operating restrictions for Nesting Habitat, Nest Patches, or Harlequin Ducks are in effect. All SMA-2 areas of restriction are shown on the Tree Removal Guideline Maps and/or listed in the solicitation under F.4 Contract Operations Schedule. Restrictions would apply if new nests are discovered.
4. When soil moisture conditions create excessive risk of damage to the soil.
5. When snow depth creates a situation where requirements cannot be met and/or work cannot be inspected, as determined by the COR.
6. If any cultural or archeological sites are discovered during operations of this contract, work will be suspended in the immediate vicinity of the site until a reconnaissance survey is completed by a professional, qualified archeologist. Areas excluded from treatment shall be deleted from the contract.
SECTION IV – INSPECTION AND ACCEPTANCE
For All Work Items:
At any point during the project, the Contractor and/or Project Manager may request (documented through email, text, or hand-written request) an in-field consultation with the Forest Service to inspect work progress, review contract specifications, or clarify issues. The Forest Service shall respond to Contractor’s request within 5 working days, excluding weekends and federal holidays.

GOVERNMENT QUALITY ASSURANCE SURVEILLANCE PLAN
General Government Inspection Procedures - The COR, or a designated inspector (GTM), will make periodic inspections while work is in progress, usually daily at first, and then as needed to assure work is proceeding satisfactorily. The Contractor shall notify the COR when units or performance requirements are started, when problems are encountered and when contract work needs government oversight.
1. Each unit/mile of road maintenance will be inspected as a separate unit. Units/miles will not be averaged with other units for acceptance or payment.
2. When performance requirements are completed and ready for government inspection, Contractor’s designated Project Manager shall request an inspection in writing unless other methods of communication are agreed to, prior to moving out of the general area.
3. The COR, or designated inspector, will determine compliance with contract specifications through informal visual inspections. In the event visual inspection indicates work to be in non-compliance with specifications, prompt corrective action and/or rework shall be required.
Specific Government Inspection Procedures – Timber and Fuels Treatments (Items 1-4, 8-11 and 14)
1. In the event visual inspection indicates work and/or rework to be in non-compliance with contract specifications, a series of verification plots/Browns transects shall be installed by the Government to determine compliance with specifications and percent of satisfactory work for treatment of each unit not meeting specification as observed with visual inspection.
2. Government verification plots will consist of a series of fixed area or variable radius plots along transects to record whether the guidelines in the Designation by Prescription have not been met, along with other requirements within contract.
3. Plots and grid will be distributed so that a representative sample is obtained.
4. The COR or designated inspector will mark the center of each plot on the ground using flagging, stakes, or pin flags. Additional flagging will be hung near the plot center so that it may be seen from a distance. The inspector will include the plot number, their initials and date on the flagging.
5. Plots will be numbered to correlate with the inspection form and transects on a unit map.
6. The minimum number of verification plots, per treatment unit, shall be as follows:

7. Determination of acceptability of the work performed will be based on Government verification inspections and will be considered conclusive.
8. At each plot for Items 1-3 and 8-10, the Government will examine the plot area and record findings of non-compliance for failing quadrants.

9. At each plot for Items 4 and 11, Small Fuels Treatment, the Government will examine the plot area and record findings on the items listed below:
a. Plot number
b. Prescribed fuel loading tonnage to be left on plot to measured work quality.
10. Work quality for Small Fuels Treatments will be calculated on the form as follows (example only):

11. Unsatisfactory Cutting and Small Fuels Treatment
a. If the work quality falls below the minimum Acceptable Quality Level (AQL), the COR will immediately notify the Contractor, in writing the need for a rework.
b. If after rework has been performed and reinspected, and work quality still falls below minimum AQL percent, payment will either be made at a reduced rate, or not at all, as determined in SECTION V below.
c. Repeated failure to produce work quality at or above the minimum acceptable standard will be considered reason for contract termination for default.
Specific Government Inspection Procedures – Road Maintenance and Reconstruction (Items 5-6 and 12-13)
1. The COR, or designated inspector, will determine compliance with contract specifications through informal visual inspections and/or as specified within Section 109 Acceptance of the FP-14 Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects as supplemented by the USFS. In the event visual inspection indicates work to be in non-compliance with specifications, prompt corrective action and/or rework shall be required.
Specific Government Inspection Procedures – Yard and Deliver Fish Logs to Deck Locations (Item 7)
1. The COR, or designated inspector, will determine compliance with contract requirements through visual inspection and spot measurements of DBH and lengths and verification of delivered logs and woody debris to delivery locations.
2. Delivered logs will be counted.
3. Delivered woody debris will be measured using the following formula:
a. Debris piles will be cubed and not include trailing ends or material extending from body of pile.
b. Measure the length, width, and height of the debris pile. A 30% error factor will be applied to account for irregular pieces, trailing ends and air gaps.
c. Calculate the volume using the formula: Length × Width × Height × 30%.
d. Convert cubic feet to cubic yards by dividing by 27.
i. Ex: 15’ Length x 10’ Width x 8’ Height *30% = 360 cubic Feet
ii. 360 Cubic Feet / 27 = 13.3 Cubic Yards

Reinspection Upon Contractor Request
1. If Government inspection results are unacceptable to the Contractor, a reinspection may be requested, in writing, within 5 business days after receipt of notice of said inspection results. The same inspection procedure will be used; however, the inspection pattern will be shifted so that new inspection plots will not overlap previously inspected plots.
2. If reinspection results – rounded up to the nearest whole percent – indicate a variance of more than 5 percent from the initial inspection, the results of the second inspection will be used to calculate work quality and payment, and the Government will bear the cost of reinspection.
3. If reinspection results – rounded up to the nearest whole percent – are within 5 percent of the first inspection, plots from the initial inspection and the reinspection will be combined and used to calculate work quality and payment, and the Contractor shall bear the cost of reinspection.

SECTION V – PAYMENT METHODS
Acceptance and Payment – Items 1-3 and 8-10
1. If informal visual inspection indicates acceptable work quality, the Contractor will be paid 100 percent of their bid rate for the acres treated. The acreages are all estimates. The Contractor shall be paid based on the actual number of acres treated. For instance, if no hazard trees require cutting or an area was previously treated by a third party, no payment would be made for this area.
2. In the event that formal inspections are used, the rate of payment to the Contractor will be calculated as follows:

a) A 2% adjustment shall be applied to measured work quality percentage to account for statistical variation.
b) For work quality of 98 percent or higher, the Contractor will be paid 100 percent of their unit price.
c) For work quality from 92 to 97 percent, the Contractor will be paid the total multiplied by the unit price unless the contractor opts to rework the acres.
d) Acreages below 92 percent shall be reworked.
e) If, after rework, if the percentage of satisfactory work is still below 92 percent, no payment will be made for each acre not meeting AQL.
Acceptance and Payment – Items 4 and 11
1. If informal visual inspection indicates acceptable work quality, the Contractor will be paid 100 percent of their bid rate for the acres treated. The acreages are all estimates. The Contractor shall be paid based on the actual number of acres treated. For instance, if no hazard trees require cutting or an area was previously treated by a third party, no payment would be made for this area. For Item 14, the Contractor shall be paid for the actual number of trees felled that meet the cutting specifications.
2. In the event that formal inspections are used, the rate of payment to the Contractor will be calculated as follows:
a) A 5% adjustment shall be applied to measured work quality percentage to account for statistical variation.
b) For work quality of 95 percent or higher, the Contractor will be paid 100 percent of their unit price.
c) For work quality from 89 to 94 percent, the Contractor will be paid the total multiplied by the unit price unless the contractor opts to rework the acres.
d) Acreages below 89 percent shall be reworked.
e) If, after rework, if the percentage of satisfactory work is still below 89 percent, no payment will be made for each acre not meeting AQL.
Acceptance and Payment- Item 5 and 12, Road Maintenance of Haul Routes
If informal visual inspection indicates acceptable work quality, the Contractor will be paid 100 percent of their bid rate. One rework opportunity will be allowed for this item.
Acceptance and Payment- Item 6 and 13, Road Reconstruction of Haul Routes
1. Measurement and payment will be in accordance with the applicable section in FP-14 for each line item.
2. If informal visual inspection indicates acceptable work quality, the Contractor will be paid 100 percent of their bid rate.
Acceptance and Payment – Item 7, Yard and Deliver Fish Logs to Deck Locations 1-3
1. Full payment will be made when measurement inspection meets 100% AQL.
Acceptance and Payment – Item 14, Fall and Leave Individual Hazard Trees (up to 1500 individual trees)
1. Contractors will track individual trees felled with a log of GPS points and the date of felling for use by the COR during inspection and acceptance. Compensation shall only be made for the individual trees cut in accordance with the cutting prescription. Payment will be based on the actual quantity of individual trees cut.
The number of trees needing treatment shall be estimated at time of award. This is a ceiling amount and is not a guarantee. Funds remaining after all work is done shall be de-obligated.
* Stewardship Credits will be earned first, whenever practical. Forest Service Funds will be used if the availability of Stewardship Credits is exhausted or if appropriated dollars are obligated to a specific item.

SECTION VI – DEFINITIONS
BROWNS TRANSECT: A line intercept method for measuring the amount of fuel on the ground
CAM: Contract Area Map
CIRCULAR PLOT: A sample plot within a thinning unit that is used to determine the number of desirable trees and other contract specifications.
COARSE WOODY DEBRIS: Woody material left on the ground to meet wildlife habitat requirements.
CUT TREES: Trees that do not possess the characteristics of desirable leave trees and are required to be cut. As described by the contract or otherwise marked to be cut.
CUTTING UNIT: See Treatment Unit definition.
DBH: Diameter at breast height, measured at a point of 4.5 feet above the ground level on the uphill side of the tree.
DECAY CLASS 1: Logs in this class are the least decomposed, with most having leaves still attached and all having intact bark, fine twigs and branches. Logs originating from cutting may not have branches and twigs, but the cuts appear fresh and have not yet turned gray due to sun bleaching.
DECAY CLASS 2: Logs in this class are starting to decompose, leaves largely are absent, and many of the fine twigs have fallen off the larger branches. Bark is typically loose but only starting to fall off the log. An exception would be for the genera Betula (common name birch) and Prunus (common identifier: stone fruit trees), which tend to retain bark throughout decomposition. For all species there is evidence the surface layers of the wood are decomposing, but the inner, central region of the wood is undecayed unless previously infected with heart rots.
For logs originating from cutting, the ends are gray from sun bleaching.
DECAY CLASS 3: Logs in this class have only a few large branches remaining, often in the form of stubs, the bark is falling off in large patches, and evidence of sloughing of sapwood is also evident. The outer wood is easily crushed by hand, although the inner portions can appear completely sound. Despite the large amount of decay, Decay Class 3 logs can support their own weight along most of their length. For certain genera with decay resistant heartwoods, such as Calocedrus (common name incense cedar), Quercus (common name oak) and Thuja (common name arborvitae or cedar), decayed sapwood may fall off to the extent that relatively sound heartwood may form the outer surface.
DECAY CLASS 4: Logs in this class cannot support their own weight and most of their length conforms to the contours of the underlying ground. Although circular cross-sections can remain, much of the log forms an elliptical cross-section. Branches, if present, are short stubs, which move when pulled. This indicates decay has spread to the innermost portions of the log and has weakened the wood considerably. Bark, if present, is in small loose patches on the log and found in piles alongside or under the log. In the case of the genera Betula (common name birch) and Prunus (common identifier: stone fruit trees) the bark is loosely surrounding the inner, highly decomposed wood.
DECAY CLASS 5: Logs in this class are the most decomposed, of elliptical shape (the long axis is often many times that of the short axis) and are beginning to be incorporated into the forest floor. The wood is extremely decayed, usually in the form of cubical brown rot that can be easily crushed by hand. Bark is not evident from the surface (except for the genera Betula (common name birch) and Prunus (common identifier: stone fruit trees)), and in most cases underlies the extremely decomposed wood.

DESIGNATION BY PRESCRIPTION (DXP): A prescription for cutting and retention of coarse woody debris based on criteria which have a range of acceptable outcomes.
DIB: Diameter inside bark.
FISH LOGS: Logs >8 inch DBH to be moved to designated disposal sites. See Mandatory Work Item #7 for specification on size and quality of log requirements.
GREEN BIO CV: All non-merchantable material within 100 feet of the road. Includes slash and trees which do not meet the sawtimber tree criteria.
LEAVE TREE: Trees that possess desirable characteristics and that serve to create the basis for designated spacing requirements or are otherwise designated to be left.
NON-SAWTIMBER TREE: All trees (conifer and deciduous) not within the sawtimber tree specifications, identified in Appendix A & Division B.
PILING: Material moved to an agreed upon location shall be piled for future treatment by Forest Service.
PROGRESSION OF WORK: Work conducted in a progressive, workmanlike and orderly manner by the Contractor.
SAWTIMBER TREE: Included timber meeting sawlog size specifications as defined in Appendix B, Division A.2.
SLASH: Woody material existing or created that has accumulated on the forest floor. Woody material includes logs, pieces of logs, tops, and branches.
UNIT: See Treatment Unit.
TEMPORARY ROADS: Non-permanent roads that are constructed by Contractor for the purpose of treatment unit access.
TREATMENT UNIT: An individual area on the ground in which activities will be performed and which may appear as a separate pay item in the Schedule of Items.
WHOLE TREE YARDING: Whole tree logging includes cutting tree and removing the entire tree, including tops and branches, to the landing.
WILDLIFE TREE: Standing tree marked to be reserved as a wildlife tree. Used by birds and small mammals for shelter, nesting, perching, etc.
