SECTION 1: GENERAL INFORMATION
1.1 INTRODUCTION & PROJECT OVERVIEW
The State of Oregon, acting by and through its Oregon Housing and Community Services Department
(“Agency”) is issuing this Request for Application (“RFA”) as its Affordable Rental Housing (“ARH”), pursuant to its statutory authority and procurement regulations, to establish and maintain a Qualified
Appraiser List for multifamily affordable housing development projects throughout Oregon. This RFA seeks qualified individual appraisers and appraisal firms (hereinafter referred to as "Applicants") to provide appraisals developers may use in undertaking OHCS-funded or OHCS-financed multifamily affordable housing projects.
Anticipated Award: The intent of this RFA is to create a statewide list of qualified, certified general appraisers and appraisal firms with demonstrated expertise in multifamily housing valuation, particularly in the context of HUD Multifamily Risk-Sharing (HUD Risk-Share), Low-Income Housing Tax
Credit (LIHTC) projects, HOME-funded initiatives, and other affordable housing programs. This list will be made available to housing developers, nonprofits, and for-profit entities seeking OHCS financing or funding for multifamily affordable housing development projects.
Agreement Term: Successful Applicants will then be invited to enter into an agreement with the Agency to set forth the terms and conditions that govern the Award (“Agreement”). The initial term of the Agreement is anticipated to be an initial five (5)-year term from Agreement execution, with the option to extend the Agreement up to five (5) additional one (1) year terms, or as deemed necessary by Agency.

Multifamily Affordable Housing: Rental residential properties with five or more units, with affordability restrictions benefiting low- and moderate-income household
LIHTC: Low-Income Housing Tax Credit program under Internal Revenue Code Section 42.
HOME: Community Development Block Grant – HOME Investment Partnerships Program under 24 CFR Part 92.
USPAP: Uniform Standards of Professional Appraisal Practice issued by The Appraisal Foundation.
Section 542(c) HUD Multifamily Risk-Sharing: Section 542(c) enables the U.S. Department of Housing and Urban Development (HUD) and State and local housing finance agencies (HFAs) to provide new risk-sharing arrangements to help those agencies provide more insurance and credit for multifamily loans.
2.3 OVERVIEW AND PURPOSE
Background: OHCS administers multiple funding programs for affordable multifamily housing development, including but not limited to HUD Risk-Share, LIHTC allocations, HOME funds, and state-financed programs. Federal law (IRC §42, HUD Section 542(c)) and HOME program regulations (24 CFR §92) require independent third-party market analyses and appraisals for income-restricted projects. Additionally, underwriting best practices and due diligence demand comprehensive market and valuation assessment prior to project approval and financing.
Purpose: OHCS seeks to maintain a curated list of qualified appraisers and firms with demonstrated expertise in:
• Multifamily affordable housing valuation
• LIHTC and HOME program compliance appraisals
• HUD-FHA multifamily lending program compliance appraisals
• USPAP-compliant reporting
This approved roster will enable OHCS to:
1. Streamline developer procurement: Under an agreement between OHCS and the Appraiser Firm or Appraiser, developers may engage pre-qualified appraisers with confidence in professional standards.
2. Ensure consistent quality: All listed professionals meet minimum education, licensing, and experience thresholds.
3. Support statewide projects: Identify appraisers with geographic and experience diversity across Oregon regions.
4. Reduce underwriting time: Developers and OHCS staff reference established professionals rather than conducting individual vetting.
2.4 SCOPE OF SERVICES
Appraiser Firms and Appraisers may contract with OHCS to provide comprehensive appraisal and market analysis services on housing projects, including but not limited to the following activities:
2.4.1. Independent Appraisals

6.4 AGREEMENT NEGOTIATION
6.4.1 Negotiation
By submitting an Application, Applicant agrees to comply with the requirements of the RFA, including the terms and conditions of the Sample Appraisal Services Contract (Attachment H), with the exception of those terms reserved for negotiation such as the Scope of Work and Insurance Requirements. Applicant must review the attached Sample Appraisal Services Contract (Attachment H) and note exceptions. Unless Applicant notes exceptions in its Application, Agency intends to enter into an Appraisal Services Contract (Attachment H) with the successful Applicant substantially in the form set forth in the Sample Appraisal Services Contract (Attachment H). It may be possible to negotiate some provisions of the final Contract;
however, many provisions cannot be changed. Applicant is cautioned that Agency has determined that modifications to the standard provisions constitute increased risk and increased cost to the State.
Therefore, Agency may consider the scope of requested exceptions in the evaluation of Applications.
In the event that the parties have not reached mutually agreeable terms within 30 calendar days, Agency may terminate Negotiations.
6.5 AGREEMENT REQUIREMENTS
Upon approval and before receiving OHCS referrals, selected appraisers/firms must execute an Appraisal Services Contract (Attachment H) that incorporates:
1. Scope of services and deliverables
2. Fee schedule and payment terms
3. Turnaround time and performance standards
4. Quality assurance and USPAP compliance
5. Confidentiality and data protection
6. Insurance and indemnification
7. Nondiscrimination and equal opportunity
8. Compliance with federal and state affordable housing program requirements
9. Indemnification of OHCS for negligence, errors, or omissions
SECTION 7: ADDITIONAL INFORMATION
7.1 GOVERNING LAWS AND REGULATIONS
This RFA is governed by the laws of the State of Oregon. Venue for any administrative or judicial action relating to this RFA, evaluation and award is the Circuit Court of Marion County for the State of Oregon;
provided, however, if a proceeding must be brought in a federal forum, then it must be brought and conducted solely and exclusively within the United States District Court for the District of Oregon. 7.2 PUBLIC INFORMATION
All Applications are public record and are subject to public inspection after Agency issues the Award. If an Applicant believes that any portion of its Application contains any information that is a trade secret under ORS Chapter 192.345(2) or otherwise is exempt from disclosure under the Oregon Public Records Law (ORS
192.311 through 192.478), Applicant must complete and submit the Disclosure Exemption Affidavit (Attachment C) and a fully redacted version of its Application.
An Applicant is cautioned that budget information generally is not considered a trade secret under Oregon Public Records Law (ORS 192.311 through 192.478) and identifying the Application, in whole, as exempt from disclosure is not acceptable. Agency advises each Applicant to consult with its own legal counsel regarding disclosure issues.
If Applicant fails to identify the portions of the Application that an Applicant claims are exempt from disclosure, the Applicant has waived any future claim of non-disclosure of that information.
7.3 CANCELLATION OF RFA; REJECTION OF APPLICATION; NO DAMAGES.
Agency may reject any or all Applications in-whole or in-part, or may cancel this RFA at any time when the rejection or cancellation is in the best interest of the State or Agency, as determined by Agency.
Neither the State nor Agency is liable to any Applicant for any loss or expense caused by or resulting from the delay, suspension, or cancellation of the RFA, award, or rejection of any Application.
7.4 COST OF SUBMITTING AN APPLICATION
Applicant must pay all the costs in submitting its Application, including, but not limited to, the costs to prepare and submit the Application, costs of samples and other supporting materials, costs to participate in demonstrations, or costs associated with protests.
