About this file
This is a Questions & Answers document (#7) issued by the State of Oregon's Department of Administrative Services State Procurement Services (DAS SPS) and Oregon Department of Education (ODE) in response to proposer inquiries regarding Request for Proposal S-DASOBO-00013701 for USDA Child Nutrition Program Food Distribution Agreements. The document clarifies key contractual and administrative requirements for food processors seeking to establish price agreements with Oregon. The solicitation targets processors capable of manufacturing processed end-products from USDA-approved apples, beef, cheese, chicken, fish, peanuts, pork, and turkey for use in Oregon's K-12 Child Nutrition Programs. Proposals were due on November 18, 2025, at 2:00 PM PT, with the deadline for clarifications and questions passing before the document's publication. The anticipated initial contract term will begin in February 2026, with potential yearly renewals extending up to a cumulative maximum of 5 years. DAS SPS intends to award multiple price agreements, with only one agreement per unique end-product.
The Questions & Answers document addresses three critical administrative inquiries regarding invoicing and contractual documentation. Specifically, it clarifies that the "Statement of Work" encompasses Exhibit A—Description of the Goods and Prices from the Sample Price Agreement, which contains product specifications and pricing information that individual vendors will submit with their proposals. The document explains that the Price Agreement number, assigned by DAS SPS to each awarded vendor, is used for tracking billing and administrative tasks and must be included on invoices. Additionally, the ordering instrument number, assigned by the Recipient Agency to each Purchase Order, is required on invoices for billing confirmation and will only apply after Price Agreements are awarded and Recipient Agencies submit purchase orders to vendors. The annual finished end-product value is estimated to exceed $1 million, with proposers evaluated on qualifications, technical plans, sodium content, and value pass-through systems across a total of 215 possible points.

Request for Proposal (RFP) S-DASOBO-00013701
USDA Child Nutrition Program Food Distribution Agreements
Question #1:
It was mentioned that the reference to “Statement of Work” would be addressed in an upcoming addendum as the verbiage is misleading. Please direct me to where this was referenced as I do not see it in any of the addendums 1-4 that are posted on OR Buys. Please provide clarity on what you are considering the Statement of Work to be as that is the only item you are saying we can submit exceptions to.
Answer:
Addenda #4 expands “Statement of Work” to include Exhibit A – Description of the Goods and Prices of the Sample Price Agreement. This refers quite specifically to Exhibit A that is included in the Sample Price Agreement (Attachment A of the RFP). You’ll see referenced in Exhibit A that a document that will be named “Attachment A-1 Product Specs” that is the products and their specifications/prices that will be are awarded to individual Vendors. That cannot be included in a RFP as this is the list of products that every proposer will be submitting with their proposal. Please note, the deadline for clarifications and questions has now passed, I cannot clarify any further.
Question #2:
Attachment A Section 2.5, page 12 – Verbiage states that invoice must include Price Agreement number and Ordering Instrument number. Please advise if a purchase order number will be acceptable to meet the requirements detailed on the invoices – What is a price agreement number?
Answer:
The Price Agreement number will be assigned by DAS State Procurement Services to each awarded vendor. Each Price Agreement will have its own individualized number. This number is used for tracking of billing and other administrative tasks.

Question #3:
Attachment A Section 2.5, page 12 – Verbiage states that invoice must include Price Agreement number and Ordering Instrument number. Please advise if a purchase order number will be acceptable to meet the requirements detailed on the invoices – What is an ordering instrument number?
Answer:
The ordering instrument number is a number assigned to each Ordering Instrument (Purchase Order).
This number is assigned by the Recipient Agency and used for confirmation of billing. This number will only come into play once Price Agreements are awarded and a Recipient Agency submits an Ordering Instrument (aka Purchase Order) to an awarded Vendor.
