About this file

This document is a Clean Air and Water Certificate from the Oregon Department of Education, applicable to contracts exceeding $100,000 or where the Contracting Officer determines that orders under an indefinite quantity contract will exceed $100,000 in a single year. The certificate requires both the agency and contractor to agree to comply with the Clean Air Act and Federal Water Pollution Control Act, including requirements related to inspection, monitoring, entry, reports, and information.

The certificate mandates that no work will be performed in facilities listed on the Environmental Protection Agency's List of Violating Facilities, and requires the contractor to use best efforts to comply with clean air and water standards at the facility where the contract is being performed. The document defines key terms such as "Air Act," "Water Act," "Clean Air Standards," "Compliance," and "facility," and includes provisions for inserting these requirements into any non-exempt contracts or subcontracts. Signature lines are provided for both the agency's and contractor's authorized representatives to execute the certificate.
