SECURITY SOLUTIONS AND MANAGEMENT
PURCHASE, INSTALLATION, AND PROGRAMMING
FOR SOTF
1. CONTRACTING AGENCY:
US Army Corps of Engineers, Wilmington District
2. DESCRIPTION OF ACTION:
SOTF requests a brand name sole source justification to use only Security Solutions & Management (SSM) integration into the existing security network which SSM operates.
The product will be part of a new competed firm fixed price contract to construct PN 88658 SOF Operations Facility project. The electronic security systems are a small portion of this project and require Security Solutions & Management (SSM) integration into the existing security network which SSM operates. The Government projects award for June 2021 and fiscal Year 2021. MILCON Funds will be used.
3. DESCRIPTION OF SUPPLIES OR NATURE OF CONSTRUCTION:
This Operations Facility includes administrative, mission planning areas, vehicle bays, climate-controlled pallet storage with lift, Petroleum, Oil and Lubricants storage, arms vaults, individual unit caged storage, engineering workshops, latrines with lockers, and laundry. Also includes space for a Secure Compartmentalized Information Facility with administrative area, 50-person classroom, operations center, and Special Access Programs. Project will also provide fire alarm/mass notification, fire suppression system, telephone and advanced unclassified and classified communications networks, intercom system, closed circuit surveillance and electronic access control systems, integrated commercial intrusion detection system, cable TV, a protected distribution system, and connection to the energy management control system. Department of Defense (DoD) principles for high performance and sustainable building requirements will be included in the design and construction of the project in accordance with federal laws and Executive Orders. The estimated value of the entire contract is $43,000,000 but the estimated value of the sole-source portion that requires SSM is $520,000.
4. AUTHORITY CITED:
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2) and 6.302-1(c), Only one responsible source and no other supplies or services will satisfy agency requirements, and brand name descriptions.
5. REASON FOR AUTHORITY CITED:
As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited;
and shall be justified and approved in accordance with FAR 6.303 and 6.304.
FAR 6.302-1:
Security Operations Training Facility (SOTF) is a one of a kind facility whose capabilities are not duplicated within the Department of Defense. The US Army Special Operations Command (USASOC) elements housed at SOTF are of vital interest to the Department of Defense. Therefore, ensuring that this project includes SSM to program the project security features is essential to maintaining operational security (OPSEC).
From their extensive experience working on the classified systems at SOTF, SSM has detailed knowledge of SOTF. Allowing another contractor to have access to this information is a severe OPSEC risk, and threatens the national security by endangering the mission of SOTF. SSM maintains an active Top Secret-SCI facility clearance to allow them to work on the classified systems. Additionally, all employees have the active Top Secret-SCI security clearances necessary to work on the systems. Hiring any contractor other than SSM risks jeopardizing the nature, organization, and mission of the units housed at SOTF.
a. Background:. Subject project includes new construction of support areas which require locking and monitoring systems compatible with existing facilities at SOTF. SSM is an integral partner in the development and upgrades of the comprehensive security and monitoring systems for over 15 years. As technological capabilities and requirements have grown, SSM has been a key part of keeping SOTF current with ever emerging threats to the security of the facility. SSM’s in-depth knowledge of both hardware and software is critical in the operations, programming, and maintenance of the classified systems. SSM’s in-depth knowledge of the SOTF security systems is not duplicated in the Market
b. Alternatives: CISCO System Inc and IBM Corp are both companies that offer similar products as Security Solutions. These companies could be considered for providing the IDS equipment but due to security reasons, alternatives should not be used for IDS equipment. Security Solutions has been under a Sole Source Contract since 2005 with the SOTF Engineering Squadron to install all IDS equipment and connections into the existing SOTF security network. Security Solutions is also the only contractor with Top Secret-SCI clearance to access the PBX. From their extensive experience working on the classified systems at SOTF, SSM has detailed knowledge of SOTF. Allowing another contractor to have access to this information is a severe OPSEC risk, and threatens the national security by endangering the mission of SOTF. SSM maintains an active Top Secret-SCI facility clearance to allow them to work on the classified systems.
Additionally, all employees have the active Top Secret-SCI security clearances necessary to work on the systems. Hiring any contractor other than SSM risks jeopardizing the nature, organization, and mission of the units housed at SOTF.
c. Justification: FAR 6.302-1 (c) allows for limiting competition to those sources who can provide a brand name product.
d. Prior Acquisitions: No prior in house listings.
e. Impact: If this Brand Name Justification is not approved additional efforts and maintenance will be required if components from various manufacturers are combined into a single system. Compatibility will have to be verified with any recommended alternative to an existing proprietary security system.
6. EFFORTS TO OBTAIN COMPETITION:
a. No effort will be made to obtain competition. Increasing competition would require firms to be provided full access to the security systems currently overseen by SSM which is a severe OPSEC risk.
b. Effective Competition: Effective competition will be achieved. The solicitation for
PN 88658 will be solicited on an unrestricted basis. Each offeror will independently price the required equipment.
7. ACTIONS TO INCREASE COMPETITION:
No further effort to increase competition will be taken for this requirement. Due to the strict security requirements, no part of the work designated as sole-sourced can be done by other than the sole source subcontractor SSM. All data and software are currently available within the system, so no further data provision is required.
8. MARKET RESEARCH:
No market research was conducted.
9. INTERESTED SOURCES: This is a brand name justification. This justification will be provided to the public at the time of solicitation as required by 6.302-1©(ii)(C).
Because this justification is for a portion of the acquisition, neither the sources sought nor the synopsis will provide a meaningful opportunity for interested sources to respond prior to solicitation.
10. OTHER FACTS:
Procurement history: Paragraph 5 provides the historical results of prior acquisitions that did not limit competition on the component subject to this justification.
