About this file

This is a Utility Clearance Letter prepared by AECOM for the Arizona Department of Transportation (ADOT) regarding the I-40 Kingman Crossing Boulevard Traffic Interchange project (ADOT Project #040 MO 54 H7147 01C, FED-AID Project ID 040-B(AUE)). The project, located in Mohave County between Milepost 54.46 and 55.85 within the City of Kingman, consists of constructing a new traffic interchange with associated bridges, 0.33 miles of new arterial street, grading and drainage work, AC and PCCP pavement, concrete improvements, pipe and box culverts, storm drain systems, signage, lighting, fencing, guardrails, and traffic signals. AECOM has recommended a Type 2 Conditional Clearance, indicating that utilities will be cleared or relocated prior to bid opening. The project is eligible for bid release with respect to utility adjustments.

The utility clearance letter identifies three utility companies with facilities in the project area: UniSource Energy Services (overhead and underground power lines), Frontier Communications (underground fiber optic and telephone lines), and the City of Kingman Engineering Department (existing waterline and sanitary sewer). Frontier Communications has one facility in conflict with the proposed construction—an underground cable along the north I-40 right-of-way line from station 2861+94 to 2902+20—which the company anticipates relocating before construction commences. The abandoned cable will remain in place once relocated. ADOT's Special Provisions require contractors to notify utility companies at least two working days prior to commencing work and to determine exact utility locations before construction. The letter also establishes significant financial sanctions for unplanned sanitary sewer line breakages, ranging from $5,000 to $40,000 per 24-hour period depending on discharge volume, with reduced rates of half the standard amount for subsequent periods until full site remediation is completed.

PROJECT: I-40 Kingman Crossing Boulevard Traffic Interchange FED-AID Project ID. 040-B(AUE) LOCATION: Kingman – Ash Fork Hwy (I-40)

AECOM has reviewed this project and recommends the following clearance:

• Type 2 - Conditional Clearance. Utilities will be cleared or relocated prior to bid opening.

The work proposed for this consists of a new traffic interchange, new bridges for the traffic interchange and 0.33 miles of new arterial street. Work will include grading and draining, constructing of AC Pavement, PCCP, concrete curb & gutter, sidewalk, pipe culverts, concrete box culverts, storm drain system, signing and pavement marking, lighting, fencing, guardrail, traffic signals and other miscellaneous work. This project is located in Mohave County, on Interstate 40, 1.5 miles east of the I- 40/SR 66-Andy Devine traffic interchange, and extends from Milepost 54.46 to Milepost 55.85 within the City of Kingman.

All utilities within the project limits have been addressed, and we do not anticipate any utility conflicts with construction of the above referenced project.

In addition to your stored specifications under section 107.15, please include the following in the Project Special Provisions:

SECTION 107 LEGAL RELATIONS AND RESPONSIBILITY TO PUBLIC:

Specifications is modified to add:

Copies of existing ADOT permits, subject to availability, may be obtained from the ADOT Area Permit Supervisor as listed below:

(928) 681-6010 Kingman, AZ 86401

107.15(F) Sewage Discharge Damage Assessments: of the Standard Specifications is revised to read:

The Department will assess sanctions in accordance with the Table 107.15-1 below for each 24-hour period, or portion thereof, for each unplanned breakage that occurs in an active sanitary sewer line as a result of the contractor's operation. The rate of these sanctions is based on the type and quantity of effluent discharged as determined by the Engineer.

These sanctions do not relieve the contractor from any of its responsibilities under the contract, including any liquidated damages that may be assessed under Subsection 108.09 of the specifications for late completion of the project.

The sanctions specified in this subsection will be independent of any penalties imposed by others.

The contractor acknowledges that Regulatory agencies may assess or impose civil or criminal penalties on the contractor resulting from sewer discharges.

The Department will not be responsible for any civil or criminal penalties, fines, damages, or other charges imposed on the contractor by any regulatory agency or court for sewage discharges that are a result, directly or indirectly, of the contractor’s work performed under this contract.

TABLE 107.15-1

SANCTIONS

(EACH 24-HOUR PERIOD, OR PORTION THEREOF)

Volume of Discharge Raw Sewage or Industrial Wastewater

Treated Effluent

Less than 10,000 gallons $5,000 $1,000 10,000 to 99,999 gallons $10,000 $2,000

100,000 to 1 million gallons $25,000 $3,000

Greater than 1 million gallons $40,000 $5,000

These sanctions will be assessed for each 24-hour period, or portion thereof, until the contractor has completed all of the following tasks:

(1) Stopped the discharge;

(2) Repaired the damaged pipe;

(3) Restored normal service; and

(4) Fully cleaned and disinfected the site to the satisfaction of the Engineer.

Upon completion of tasks (1), (2), and (3) above, and prior to completion of Task (4), the sanctions for the current 24-hour period will be at the rate shown in Table 107.15-1. However, for each subsequent 24-hour period, the assessment will be 1/2 of the rate shown in Table 107.15-1.

The sanctions will continue at the reduced rate until the site has been fully cleaned and disinfected to the satisfaction of the Engineer.

As an example, the amounts assessed each 24-hour period for an unplanned discharge of 20,000 gallons of raw sewage, in which the contractor completes tasks (1), (2), and (3) within the second 24-hour period but does not complete full cleanup until the third 24-hour period, will be as follows:

First 24-hour period: $10,000 Second 24-hour period: $10,000 Third 24-hour period: $5,000

For this example, the total sanction will be $25,000 ($10,000 + $10,000 + $5,000).
