Form L08
Introduction In accordance with NEXCOM V3 Radio SIR Sections L.3.1, L.3.3, L.3.4, L.4.1, Table L-3, SIR Attachments M01 {Operational Capabilities Test (OCT) Plan} and M02 (VOTER Testing Requirements), Offerors are required to participate in a NEXCOM V3 Radio OCT at FAA’s William J. Hughes Technical Center (WJHTC) in Atlantic City, New Jersey (NJ).
Instructions for accessing the FAA WJHTC are provided in SIR Attachment L03 (WJHTC Facility Access Instructions).
OCT Equipment Submission Compliance Review After proposals have been submitted, the Government will conduct a compliance review in accordance with Section M.3.1. This compliance review verifies Offerors submissions are complete and compliant with the instructions in Section L. As part of this compliance review, the Government will verify that Offerors have submitted all NEXCOM OCT-required equipment and materials, and are fully committed to participate in the OCT as instructed in the NEXCOM V3 Radio SIR Attachments M01 (OCT Plan) and M02 (VOTER Testing Requirements). If an Offeror’s OCT equipment submission is found to be incomplete or non-compliant, the Offeror will be precluded from participating in an OCT-conduct and deemed ineligible for award.
Offerors may select from two options for their OCT Equipment Submission Compliance Review, namely:
(A) Government OCT Equipment Compliance Review. Government in-person review of the Offeror’s OCT equipment submission with a Offeror representative(s) at the WJHTC within 10 business days after the proposal due date (the FAA CO will assign the exact date and time), or
(B) Offeror OCT Self-certification. Offeror certifies that all OCT equipment submission requirements have been met. With this option, Offerors must wait until their OCT equipment submission is Government verified during the Offeror’s OCT Installation and Checkout {see SIR Attachment M01 (OCT Plan), Section 5.2.1.1}, which could be many months (i.e., potentially greater than 6 months) after the proposal due date depending on the number of compliant Offerors and when each compliant Offeror is randomly assigned their respective start/duration dates to conduct their OCT.

OCT EQUIPMENT SUBMISSION COMPLIANCE REVIEW FORM
The Government’s preference is that Offerors select Option A, so they are aware earlier—(e.g., within 15 business days of the proposal due date) -- that their OCT equipment submission is compliant or not. However, selecting Option B will not count against the Offeror’s evaluation rating.
Selection of OCT Equipment Submission Compliance Review
All Offerors must complete this L07 Form, regardless of which type of OCT Submission Compliance is selected and email to the CO in accordance with Section L.3.3.

| The Offeror (you), in fulfilling the OCT requirements (check applicable block), |
(A) ☐ accepts the Government’s offer to perform an in-person OCT Equipment Submission Compliance Review during the proposal compliance review period, within 10 business days after the proposal due date. By accepting this option, the Offeror understands and agrees to the following:
· The Government will notify the Offeror within 5 business days of its scheduled Compliance Review date and time. The Offeror’s OCT Equipment Submission Compliance Review may begin as soon as 5 business days after the proposal due date.
· The Offeror must have at least one representative present at the scheduled date and time to unpack or unseal some or all of its OCT equipment submission in order to verify that the items delivered meet all OCT equipment submission requirements. The representative(s) must also repack or reseal any opened boxes at the end of the review in the manner preferred by the Offeror. Due to the limited compliance review timeframe, Government vetting of International visitors to the WJHTC is not possible; therefore, the Offeror’s representative must be a U.S. Citizen.
· Eligible Offerors understand that their OCT equipment must reside at the WJHTC until an award announcement has been made, which could potentially be up to 18 months after the proposal due date.
· Offerors who did not meet the OCT equipment submission requirements will be ineligible for award and must remove their equipment from the WJHTC within 10 business days after the CO has sent an official notification of non-compliance.
· In accordance with Section L.3.5, the Government will not pay or reimburse any costs incurred by the Offeror associated with the OCT.
(B) ☐ declines the Government’s offer to perform an in-person OCT Equipment Submission Compliance Review during the proposal compliance review period. By declining the OCT Compliance Review, the Offeror understands the following:
· Self-certification. The Offeror represents that it has submitted all required NEXCOM V3 Radio OCT equipment and materials as required in Sections L.3.1, L.3.3, L.3.4, L.4.1, Table L-3, SIR Attachments M01 (OCT Plan) and M02 (VOTER OCT Plan) by the proposal due date and time. With this option, the Offeror also waives any right to dispute the Government’s findings during Compliance Review.
· The Offeror understands that the results of their OCT equipment-submission compliance review may not occur for many months (i.e., potentially up 6 months) past the proposal due date depending on the number of compliant Offerors and when each compliant Offeror is randomly assigned their respective start date and duration dates to conduct their OCT.
· Eligible Offerors understand that their OCT equipment must reside at the WJHTC until an award announcement has been made, which could potentially be up to 18 months after the proposal due date.
· Offerors who did not meet the OCT submission requirements will be ineligible for award and must remove their equipment from the WJHTC within 10 business days after the CO has sent an official notification of non-compliance.
· In accordance with Section L.3.5, the Government will not pay or reimburse any costs incurred by the Offeror associated with the OCT.
