Clauses and Provisions Incorporated in Full Text The version in effect on the date of the issuance of the Screening Information Request (SIR) release is applicable unless otherwise specifically noted.

3.2.2.3-4 Samples (October 2018)

(a) ‘Samples' are item samples the Offeror (you) must provide to show characteristics of your products that cannot be described adequately (for example, balance, ease of use, or pattern)

(b) You must provide samples required elsewhere in this SIR as part of your offer by the time specified for receiving offers. The FAA may reject offers that do not provide samples on time (see provision 3.2.2.3-14 - "Late Submissions, Modifications, and Withdrawals of Offers").

(c) The Contracting Officer (CO) will evaluate samples to determine if they comply with all the characteristics listed in this SIR. The CO may reject offers if they do not provide samples meeting the requirements.

(d) Unless otherwise specified in the SIR, you must:

(1) Provide samples at no expense to the FAA, and

(2) Pay for the samples to be returned if you want them back.

(e) The CO may waive the requirement to provide samples; if

(1) You provided the same product to us on a previous acquisition,

(2) The CO determines that your product was accepted or tested and found to be technically acceptable, conforming in every material respect with those of this SIR, and

(3) You will produce the product offered under this SIR at the same plant where you produced the previously acquired or tested product.

(End of provision) 3.2.2.3-5 Descriptive Literature (July 2004)

(a) "Descriptive literature" means information (for example cuts, illustrations, drawings, and brochures) submitted as part of an offer. The FAA (we) may need descriptive literature to evaluate details of the product. These details may be about:

(1) Design;

(2) Materials;

(3) Components;

(4) Performance characteristics; or

(5) Methods of manufacture, assembly, construction, or operation.

(b) Descriptive literature includes only information the FAA needs to determine that the Offeror (you) will provide technically-acceptable products.

(c) The Offeror (you) must mark or highlight the items you are submitting as descriptive literature so we can readily find them in your offer.

(d) The Contracting Officer (CO) may reject offers that fail to submit descriptive literature on time (see the "Late Submissions, Modifications, and Withdrawals of Offers" provision of this SIR) or in which the descriptive literature does not show that the product offered conforms to the SIR requirements.

(e) The CO may waive the SIR requirement for descriptive literature if you indicate in subparagraph (e)(1) below that you supplied a comparable product under an earlier FAA contract and the CO determines that the product meets this SIR’s requirements.

(1) You represent that you [ ] have, [ ] have not [check applicable box] supplied a product to us, the FAA, under an earlier FAA contract that is the same as the product offered under this SIR.

(2) If you checked 'have' in paragraph (e)(1), and seek a waiver of the requirement for descriptive literature, submit the following information as part of your offer:

Earlier contract number _____________________________________ Date of earlier contract ______________________________________ Contract line item number of product supplied ___________________ Name and address of government activity to which you delivered the product _________________________________ Date of final delivery of product _______________________

(f) You must submit offers on the basis of required descriptive literature or on the basis of a product you supplied previously under paragraph (e). Once you submit an offer on one of these two bases and the deadline for us to receive offers has passed, you may not elect to have your offer considered on the alternative basis. The Government will disregard your request for a waiver under paragraph (e) above if you have submitted the descriptive literature this SIR requires.

(End of provision) 3.2.2.3-20 Offers (January 2018)

(a) The offeror (you) must submit responses to this SIR by the following electronic means: See L.3.2 – Electronic Proposal Submission. Your offer must arrive at the place and by the time specified in the SIR.

(b) Such offers must refer to this SIR and include, as applicable, the item or sub-items, quantities, unit prices, time and place of delivery, all representations and other information required and a statement specifying the extent of your agreement with all the FAA's (we) terms, conditions, and provisions.

(c) We may decline to consider offers that do not include required information, or that reject any of the terms, conditions and provisions of the SIR.

(d) Send your offer to See L.3.2 – Electronic Proposal Submission.

(e) We will not be responsible for any failure attributable to transmitting or receiving the offer, unless it falls under section (a) of AMS provision 3.2.2.3-14 "Late Submissions, Modifications, and Withdrawals of Submittals".

(End of provision) 3.2.2.3-38 Alternate II Requirements for Certified Cost or Pricing Data or Data Other Than Certified Cost or Pricing Data (Jan 2022)

(a) The FAA does not require a submission of certified cost or pricing data.

(b) The Offeror must provide the following data:

1. Catalog or Market Prices (Only if requested by the Contracting Officer): Information must include, at a minimum, appropriate data on the prices at which the same or similar items have been sold previously. The Contracting Officer will specify the information to be submitted and format required if requested.

2. Sales to non-governmental and governmental entities (Only if requested by the Contracting Officer): Information must include, at a minimum, appropriate data on the prices at which the same or similar items have been sold previously. The Contracting Officer will specify the information to be submitted and format required if requested.

(End of clause) 3.2.4-1 Type of Contract (April 1996) The FAA contemplates award of an Indefinite Delivery/Indefinite Quantity contract resulting from this Screening Information Request. Delivery Orders will primarily be issued as Firm-Fixed Price (FFP) or Time and Materials (T&M); however, the Government reserves the right to use other contract types, as appropriate.

(End of provision) 3.6.1-17 North American Industry Classification System (NAICS) Code (October 2022) The North American Industry Classification System (NAICS) code for this procurement is 334220.

The small business size standard as defined by the Small Business Administration (SBA) is the following:

For NAICS codes based on SBA’s calculation of annual receipts, the annual average receipts cannot exceed N/A .

For NAICS codes based on the number of employees, the average number of employees over the last 24-month period cannot exceed 1250.

(End of provision) 3.9.1-3 Protest (January 2020) AS A CONDITION OF SUBMITTING AN OFFER OR RESPONSE TO THIS SIR (OR OTHER SOLICITATION, IF APPROPRIATE), THE OFFEROR OR POTENTIAL OFFEROR AGREES TO BE BOUND BY THE FOLLOWING PROVISIONS RELATING TO PROTESTS:

(a) Protests concerning Federal Aviation Administration Screening Information Requests (SIRs) or awards of contracts shall be resolved through the Federal Aviation Administration (FAA) dispute resolution system at the Office of Dispute Resolution for Acquisition (ODRA) and shall be governed by the procedures set forth in 14 C.F.R. Parts 14 and 17, which are hereby incorporated by reference. Judicial review, where available, will be in accordance with 49 U.S.C. 46110 and shall apply only to final agency decisions. A protestor may seek review of a final FAA decision only after its administrative remedies have been exhausted.

(b) Offerors initially should attempt to resolve any issues concerning potential protests with the Contracting Officer. The Contracting Officer should make reasonable efforts to answer questions promptly and completely, and, where possible, to resolve concerns or controversies. The protest time limitations, however, will not be extended by attempts to resolve a potential protest with the Contracting Officer.

(c) The filing of a protest with the ODRA may be accomplished by mail, overnight delivery, hand delivery, or by facsimile or if permitted by order of the ODRA, by electronic filing. A protest is considered to be filed on the date it is received by the ODRA during normal business hours. The ODRA's normal business hours are from 8:30 am to 5:00 pm Eastern Time

(d) Only an interested party may file a protest. An interested party is one whose direct economic interest has been or would be affected by the award or failure to award an FAA contract. Proposed subcontractors are not "interested parties" within this definition.

(e) A written protest must be filed with the ODRA within the times set forth below, or the protest shall be dismissed as untimely:

(1) Protests based upon alleged improprieties in a solicitation or a SIR that are apparent prior to bid opening or the time set for receipt of initial proposals shall be filed prior to bid opening or the time set for the receipt of initial proposals.

(2) In procurements where proposals are requested, alleged improprieties that do not exist in the initial solicitation, but which are subsequently incorporated into the solicitation, must be protested not later than the next closing time for receipt of proposals following the incorporation.

(3) For protests other than those related to alleged solicitation improprieties, the protest must be filed on the later of the following two dates:

i. Not later than seven (7) business days after the date the protester knew or should have known of the grounds for the protest; or

ii. If the protester has requested a post-award debriefing from the FAA Product Team, not later than five (5) business days after the date on which the Product Team holds that debriefing.

(f) Protests shall be filed at:

(1) For filing by hand delivery, courier or other form of in-person delivery:

Office of Dispute Resolution for Acquisition Federal Aviation Administration 600 Independence Avenue SW., Room 2W100 Washington, DC 20591; or

For filing by U.S. Mail:

Office of Dispute Resolution for Acquisition Federal Aviation Administration 800 Independence Avenue SW Washington, DC 20591 [Attention: AGC-70, Wilbur Wright Bldg. Room 2W100]; or

Telephone: (202) 267-3290 Facsimile: (202) 267-3720 Alternate Facsimile: (202) 267-1293; or

(2) Other address as specified in 14 CFR Part 17.

(g) At the same time as filing the protest with the ODRA, the protester shall serve a copy of the protest on the Contracting Officer and any other official designated in the SIR for receipt of protests by means reasonably calculated to be received by the Contracting Officer on the same day as it is to be received by the ODRA. The protest shall include a signed statement from the protester, certifying to the ODRA the manner of service, date, and time when a copy of the protest was served on the Contracting Officer and other designated official(s).

(h) Additional information and guidance about the ODRA dispute resolution process for protests can be found on the ODRA Website at http://www.faa.gov.

(End of provision) Questions, Concerns, and Clarification The NEXCOM V3 Radio FAA Contracting Officer (CO), alessha.m.mason@faa.gov, and FAA Contract Specialist (CS), shaun.miles@faa.gov, are the points of contact for this acquisition.

Offerors are instructed to direct general questions, concerns, and clarifications to the CO and CS, identified above, by email. All Offeror questions, concerns, and clarification requests specific to the SIR must be made in writing using the clarification/question form provided with the SIR announcement (i.e., SIR Attachment L06 Clarification/Question Form) and submitted to the CO and CS via email not later than the date specified in Section L.3.1, Table L-1.

Written inquiries received within this timeframe will be answered in writing, and provided to all Offerors, prior to the required date for submittal of Offerors proposals. If inquiries require a change to this SIR, amendments to applicable Sections or Attachments will be posted to the SIR announcement. The Government reserves the right to not answer any requests received outside of the above timeframe. Furthermore, Offerors should note that the proposal due date will not be extended solely on the basis of questions received within or beyond the timeframe mentioned above. The Government will not provide verbal responses to Offeror questions, concerns, and clarification requests initiated via Offeror telephone calls.

All requests for FAA documents referenced in this SIR must be received by the CO and CS no later than twenty (20) business days after the release date of this solicitation.

General Instructions Offerors must comply with the general instructions of this SIR.

1. Offerors proposal submissions, in response to this SIR, must be made via the secure FAA Electronic Source Selection Repository site. The FAA will not accept any Volume I, II, IV and V proposal submissions made by facsimile, telex, telegraph, email, or any other means.

1. Offerors must submit their request for FAA Electronic Source Selection Repository site registration no later than 5 business days after the release of the NEXCOM V3 Radio SIR.

1. Only Prime Offerors are eligible to register for an FAA Electronic Source Selection Repository site. Offerors must send an email requesting FAA Electronic Source Selection Repository site access to the Contracting Officer at alessha.m.mason@faa.gov and Contracting Specialist at shaun.miles@faa.gov and must register using instructions provided in the FAA’s response to the request.

1. Each Offeror’s site is limited to a maximum of three (3) users. Offerors will be notified via email when its FAA Electronic Source Selection Repository site has been established. If an email notification is not received within three (3) business days from the date of request, the Offeror must resubmit its request and notify the CO.

1. Once registered, Offerors are responsible for ensuring that their read/write access is available and permits the upload of proposal files until the submission date and time.

The submission of the Volumes specified in Section L constitute the Offeror’s acceptance of, and agreement to, the terms and conditions in this SIR and any attachments thereto. Prior to the proposal submission date and time specified in this SIR, Offerors may edit proposal documents posted to their assigned FAA Electronic Source Selection Repository site. However, through FAA Electronic Source Selection Repository site registration, the Offeror acknowledges and agrees that as of the submission date and time (as defined in Sections L.3.1 and L.3.3), all Offeror FAA Electronic Source Selection Repository sites will be locked, and files will become final, read-only, and represent the Offerors proposal.

Electronic upload of the Offeror’s proposal will be acknowledged as “Receipt only” or “Received” by the CO. This initial receipt-acknowledgement is separate from and does not represent compliance as defined in Sections L.3.4 and M.3.1.

Offerors are responsible for ensuring that the CO receives notice of any withdrawals of proposals.

Date, Place, and Time for Submission of Proposals and Equipment Offerors assume full responsibility and must ensure that all proposal Volume content and NEXCOM V3 Radio Operational Capabilities Test (OCT) equipment submissions (as defined in Section L.4.1, Table L-3) are received no later than 3:00 PM Eastern Time (ET) on proposal submission date specified in Section L.3.1, Table L-1.

Offerors are instructed to email the CO a completed SIR Attachment L07 (OCT Equipment Submission Compliance Review Form) to either accept or decline an in-person OCT equipment-submission compliance review, at least 10 business days prior to the specified proposal submission date in Section L.3.1, Table L-1. Instructions for accessing the FAA WJHTC are provided in SIR Attachment L03 (WJHTC Facility Access Instructions).

Offerors NEXCOM V3 Radio OCT equipment submission {as defined by Section 5.1.2.1 and 5.1.2.1.1 in SIR Attachment M01 and inclusive of four (4) paper copies of the OCT demonstration scripts, eight (8) paper copies of the OCT familiarization training material, and a paper copy of the OCT equipment packing list}, may be hand-carried by Offeror- representative(s) or delivered by the Offeror’s preferred shipping company to the address below:

Hughes Technical Center (WJHTC) Amelia Earhart Blvd, FAA Visitor Center aka Building 320 (Security Operations Center (SOC)) Atlantic City, NJ 08405 Attn: Doug Bancroft, ANG-E62 Telephone: (609) 485-8346 (office) or (267) 994-6982 (cell) Alternative Point of Contact: James DeLaurentis, ANG-E63 Telephone: (609) 678-7611 (cell) After arriving at the FAA Visitor Center (SOC) and having obtained a temporary visitor badge to access the FAA WJHTC, Offerors-representative(s) and/or Offerors-delivery personnel will call the numbers above and the FAA will provide further delivery instructions.

All Offerors provided Volume I, II, IV and V proposal submissions to this SIR must be made through the FAA Electronic Source Selection Repository site (as defined in Section L.3.2) and in accordance with the submission-instruction formats in Section L.4.1, Table L-3.

Proposals, which include the physical delivery of NEXCOM V3 Radio OCT equipment and associated OCT documentation (i.e., paper copies of OCT demonstration scripts, OCT familiarization training material, OCT equipment packing list), not submitted by the date and time specified in Sections L.3.1 and L.3.3 will not be accepted.

Offerors are instructed to review Section L.5.3 for Volume III (Past Performance Proposal) submission instructions which are applicable to the Offeror’s (your) past-customer references.

Compliance All submitted proposals will be screened initially for completeness, accuracy, and timeliness. A proposal that does not meet the initial screening criteria may be excluded from the competition. The CO will notify an Offeror if they are removed from further competition.

It is the Offeror’s (your) responsibility to ensure the completeness, accuracy and timeliness of the proposal. The initial screening of proposals, completed during Government compliance reviews (as defined in Section M.3.1), will be conducted on the basis of the organization of the information contained in the Offeror-provided Volume I, II, IV and V proposal submissions and the delivery of the NEXCOM V3 Radio OCT equipment-submission. The Government will not assume that an Offeror possesses any capabilities not specified in their NEXCOM V3 Radio proposal.

The proposal must be signed by an official who is legally authorized to obligate the Offeror to a contract.

After the FAA has verified that submitted proposals are complete, accurate, on-time, and are compliant in accordance with this SIR, the CO will schedule a time and date to conduct the NEXCOM V3 Radio OCT Equipment Submission Compliance Review at the WJHTC in accordance with SIR Attachment L07 (OCT Equipment Submission Compliance Review Form).

After the FAA completes the OCT equipment-submission compliance reviews, the CO will issue each compliant Offeror their respective start date and duration for the conduct of their respective OCT at the WJHTC.

Expenses Related to Proposal Costs and Submission The FAA is not responsible for and will not pay or reimburse any costs incurred by Offerors in the development or submission of any aspect of their proposal under this SIR regardless of circumstances including, but not limited to, SIR amendment or cancellation. This includes costs associated with any aspect of the proposal activity, including participation in the OCT activities and any research, studies, or designs carried out for the purpose of incorporation into any part of the proposal. It also includes any costs to acquire or contract for any services or products relating to the proposal development and submission.

Participation of Non-Government Personnel Offerors are notified that the Government may have responses to the SIR, to include any written technical proposals or other written information provided in response to this solicitation, reviewed by non-Government personnel (i.e., Contractor personnel) supporting the source evaluation. Companies participating in the source selection are listed in Table L-2. Offerors must not include these contractors as any part of their proposed team; doing so will create an Organizational Conflict of Interest (OCI).

Number of Awards The FAA intends to make a single award to one Offeror resulting from this SIR. The FAA reserves the right to not make an award.

Disposition of Proposals Proposal files will not be returned and a copy of each proposal will be retained in accordance with AMS Procurement Guidance Section T3.13.1(A)(7), Records Retention.

Alternate Proposals, Deviations, and/or Exceptions Wholly or substantially alternate proposals are not authorized to be submitted in response to this SIR and will not be evaluated. With respect to specific terms or conditions of this SIR, any objections (i.e., deviations, exceptions or combination thereof) to any of the terms and conditions of this SIR will constitute either a “Fail” rating-determination or a deficiency (as defined in the Table M-10 footnote), and will be evaluated in accordance with Section M. Additionally if an Offeror’s proposal is determined to take extensive deviations and/or exceptions it may render the proposal to be a substantially alternative proposal, which is non-responsive to this SIR, and will not be evaluated or considered for award.

Proposal Format Offerors are permitted to submit only one (1) proposal. Offerors must submit proposals according to the following:

a) Proposals must be provided in standard letter size 8-1/2 by 11-inch format. The font for text must be Times New Roman, size 12 point, with one-inch margins for the left, right, top and bottom of each page. The font for graphics, illustrations, and charts must be eight point or larger. Offerors may not use oversize pages. The proposal pages must be numbered sequentially. Any items embedded within a document must be objects only, not links.

b) A page is defined as one face of a sheet of paper containing information. Proposals must not exceed the page limitations listed in Table L-3. The following materials are excluded from the page count limitation: Volume Covers, Title Pages, Tabs, Tables of Content, Lists of Figures, Glossaries, Acronyms, Abbreviation Lists, a representative example of a Contractor Verification Reliability Traceability Matrix (CVRTM), Integrated Master Schedule Approach (IMSA) scheduling software documentation (ex. MS Project), COTS documentation, Contractor submittal letter and subcontractor commitment letters, if applicable, and transmittal letters. Any submission exceeding a page limitation may only be evaluated up to the established page limitation.

c) Proposals must contain comprehensive, concise, and factual information. General statements that Offerors (you) understand the requirements of the work to be performed or simple rephrasing or restating of the Government’s requirements will be considered inadequate. Similarly, submittals that contain omissions or incomplete responses to the requirements of this SIR, that merely paraphrase the Statement of Work (SOW) or that use nonspecific phrases such as "in accordance with standard procedures" or "well-known techniques" will also be considered inadequate. Proposal submissions of this kind will render the proposal non-responsive and may be cause for rejection of the offer.

d) Any trade secrets, copyright data, or financial information that Offerors or proposed subcontractors do not want disclosed must be marked in accordance with Clause 3.2.2.3-16, Restriction on Disclosure and Use of Data (July 2004).

e) Each proposal Volume/Part must be uploaded to the appropriate folder in the FAA Electronic Source Selection Repository (refer to Table L-3 Proposal Organization and Submission Requirements). The individual responses including attachments must be less than 50 MB. If Offerors compress (e.g., zip) any submitted files they must not be password protected. The file name must be no longer than 60 characters and adhere to the following naming convention using the Volume/Part names listed in Table L-3:

“Volume Part_Name”

Examples:

Vol I Part A_Analyses Vol V Part B_Price Narrative

Note: The file size limitation and naming convention does not pertain to the .zip files for Volume I, Part G: NEXCOM V3 Radio VOTER Test Results, IAW SIR Attachment M02 (see L.5.1.7).

f) A cover page must be affixed to each volume that clearly identifies each volume title, volume number, solicitation number, and Offeror’s name. Whenever practical, enclosed headings, subheadings, titles, sequences of material and a number identification system must be used. Information not in its appropriate section or not appropriately referenced may be assumed to have been omitted and potentially not evaluated.

g) All proposal volume parts must contain a table of contents, and glossary with the definitions of all acronyms and abbreviations used within the volume. These items do not count against the page limits (if applicable).

h) Cost or pricing information must not be included in any volume other than Volume V (Price Proposal).

i) The FAA will only use Adobe Acrobat Pro DC and Microsoft Excel software to read and evaluate Offeror proposals. The FAA has no special software or monitors to review diagrams, drawings, or illustrations such as those created using Computer Aided Design and Manufacturing (CAD/CAM). Submitted proposals that are not compatible with the Adobe Acrobat Pro DC and Microsoft Excel, will not be evaluated.

Volume Descriptions A description of the required contents of the numbered volumes is provided in the subsections below. All information must be provided in these volumes as specifically prescribed.

Volume I – (Factor 1, Technical Proposal) Offerors must provide the information for the Technical Proposal as described in the Elements below.

Part A – Analyses (Element 1.1) Not all technical requirements defined in SIR Attachment J01, FAA-E-37021, NEXCOM Version (V3) UHF/VHF Radio Product Description (PD), hereafter referred to as the NEXCOM V3 Radio PD, will use the Demonstration (D), Inspection (I), and Test (T) verification/evaluation methods during OCT.

The purpose of Element 1.1 is to gather supporting technical data, in the form of Offeror-provided Analyses (i.e., white papers, data analysis reports) to verify compliance to specific NEXCOM V3 Radio PD’s requirements. For requirements identified with an OCT verification/evaluation method of “Analysis (A)” in SIR Attachment M03 {OCT Verification Requirements Traceability Matrix (VRTM)} and listed in SIR Attachment L04 (NEXV3 Analyses Requirements), Offerors must provide supporting technical data IAW SIR Attachment M01 (OCT Plan, Appendix A5). Each Offeror’s Analyses (A), and any supporting documentation to support their responses, are to be submitted as Part A of the Volume I (Factor 1, Technical Proposal).

Any deviations taken against NEXCOM V3 Radio PD requirements must contain sufficient justification to permit evaluation. For each deviation taken against the NEXCOM V3 Radio PD requirements using the Analysis verification/evaluation method as well as any potential benefits to the FAA, if applicable, must be fully explained.

Offerors justification must be inclusive of detailed comparative analysis (or analyses) to clarify all the differences, between any proposed alternate standard(s) and the standards referenced the NEXCOM V3 Radio PD.

Offerors proposing alternate standards must demonstrate to the FAA that any such deviation still provides similar, the same or better performance or compliance required by the standards referenced by the FAA in the NEXCOM V3 Radio PD.

Part B – Conduct of Operational Capabilities Test (OCT) (Element 1.2) Offerors OCT Equipment Submittal, as defined in Section L.4.1, Table L-3, is to be submitted as Part B of the Volume I (Factor 1, Technical Proposal).
