L L-18 L.4.2

Proposal instructions L.4.2 f) states “A cover page must be affixed to each volume that clearly identifies each volume title, volume number, solicitation number, and Offeror’s name.” L.4.2 g) instructs “All proposal volumes must contain a table of contents, and glossary with the definitions of all acronyms and abbreviations used within the volume.”

Since each part of Volume I (Parts A through G) require separate file submissions, a volume cover page, table of contents, and associated information is not practicable. We assume, for Volume I, each part should have a cover page, table of contents, and glossary with the definitions of all acronyms and abbreviations used within the part. Please confirm this is the correct assumption.

Section L, L.4.2(g) updated to state "all proposal volume parts must contain a table of contents, and glossary with the definitions of all acronyms and abbreviations used within the volume."

3.2.1.1 3.4.1.8

There are several requirements verified at OCT by Analysis that per the SIR VRTM are verified by Test at FAT. We assume that due to the length of these tests, which may need to be performed at an external lab, the FAA will use a sampling plan rather than run, for example, all VHF Transmitters through all required tests. So we may adequately plan the schedule and costs, would the FAA please state the quantity of each item to be verified by test at FAT for ETSI EN300676-1 (PD 3.2.1.1.d), shock IAW MIL-STD-810H (PD 3.4.1.8.a), and vibration (PD 3.4.1.8.b)?

The 'sampling plan' (using your term) is the Contractor's responsibility to propose to the FAA via their specific approach as defined in the Contractor Master Test Plan (CMTP), Contractor Verification Requirements Traceability Matrix (CVRTM), Factory Acceptance Test (FAT) Plan, FAT Procedure deliverables. The Contractor's delivered Test CDRLs are reviewed, refined and approved by the FAA prior to test conduct. With this said, the FAA cannot state a specific quantity of each item to be verified by test at FAT for ETSI EN300676-1 (PD 3.2.1.1.d), shock IAW MIL-STD-810H (PD 3.4.1.8.a), and vibration (PD 3.4.1.8.b) because it is up to the contractor to develop and propose their CMTP/FAT approaches.

Section C &

Section G

C-38 G-6

C.3.9 G.8.2

C.3.9 states: Technical Support Services will be provided through Time and Materials (T&M) Task Orders IAW Sections G.6.2, G.6.2.1 and G.6.2.2. There are no Sections G.6.2, G.6.2.1 and G.6.2.2. Please confirm correct references are G.8.2, G8.2.1 and G.8.2.2

Section C, Statement of Work has been updated to correct references to Sections G.8.2, G.8.2.1, and G.8.2.2.

4.

Section

C C-17 C.3.6.4.1 C.3.4.d

C.3.6.4.1 Provisioning Conference refers to Section C.3.4.e. C.3.4.e is titled Program Management Reviews.

Please confirm the correct reference is C.3.4.d Provisioning Conference.

references to Section C.3.4.d.

5.

Section

C C-34 C.3.8.3

Section C.3.8.3 Factory Acceptance Test (FAT) states in the second sentence “The Contractor must conduct FAT on all V3 radio items identified in Section B of this contract.”

We assume that should read Section B.1 CLINs 0001A – 0001F OT units. Is that correct?

references to Section B.1 CLINs 0001A – 0001F, 0002, 0003, and 0004 OT units and not all V3 radio items.

6.

Section

C C-22 C.3.6.9.1

The last sentence of the first paragraph of C.3.6.9.1 (Environmental Occupational Safety and Health (EOSH)) appears to be the heading for the next paragraph. If this is correct, the heading should be:

C.3.6.9.2 Environmental Occupational Safety and Health

(EOSH)

This incrementally changes the following section heading numbers (e.g., 3.6.9.2 Training Development Plan (TDP) is now 3.6.9.3 Training Development Plan (TDP), etc.).

Is this a correct assumption?

Statement of Work has been updated to restore heading for C.3.6.9.2 (EOSH) and subsequent subheadings thereafter.

L L-18 L.4.2

Since there is no designation for a font type for graphics, illustrations, and charts (including tables) we assume an easily readable sans serif font, such as Arial 8 point or larger, is acceptable. Please confirm this is an accurate assumption.

Section L of the NEXCOM V3 SIR does not require a specific font type for graphics, illustrations, and charts/tables, however, font must be 8 point or larger.

8. Section J, Att

J01_PD

38 Table 3-17, Row 2

The default value for Radio Type II in Table 3-17 is "Single". Using that value would mean that the radio frequency cannot be changed. Is this the FAA's intent? Please clarify rationale for not enabling multiple frequency functional requirements.

Section J, Attachment J01 Product Description (PD) has been updated to change the default value for Radio Type II in Table 3-17 from Single to Multi-frequency.

9. Section L

L-7 L.1.1 3.2.2.3-38

Please clarify that AMS Policy 3.2.3.3 (9/2020), specifically 3.2.3.1 Policy, applies to this procurement IAW the text below:

“3.2.3.1.2 Policy Added 9/2020 “When the CO determines adequate price competition exists, certified cost or pricing data must not be requested. In situations with established catalog or market prices, prices set by law or regulation, or commercial items, price analysis is sufficient and the CO must not request cost data.”

Section L.1.1 states that certified cost and pricing data is required. Later in the document Section L.5.5 states that the Government anticipates that adequate price competition will exist, so Offerors are not required to submit certified

Per AMS clause 3.2.2.3-38(a)(1), "In lieu of submitting certified cost or pricing data, Offerors may submit a written request for exception by submitting the information described in paragraphs (a)(1)(i) and (ii) of this clause. The Contracting Officer may require additional supporting information, but only to the extent necessary to determine whether an exception should be granted, and whether the price is fair and reasonable."

10. Section B

B-73 B.7 Several tabs in the Section B Pricing Model are labeled "Other MISC Components, add rows as needed" but the file is locked and does not allow adding rows. Would the FAA update Section B Pricing Model file to enable offerors the opportunity to insert additional rows to address this pricing factor and unlock the worksheets accordingly?

Section B, Tab B instructions, Rows 3-4: Spelling error in row 4 should state “including”

The pricing model includes the following tabs for offeror to enter “Other Misc. Components” as NSP:

Also IAW Tab AH options, requires offeror to include pricing for specific order estimated quantities provided by the FAA with a roll-up of total price and no ability to insert rows identifying specific component cost that apparently are separately priced.

Please ensure changes made to the Excel version are also reflected in the PDF formatted version and visa versa.

11. Section F/ Section I

F-3 3.2.4-33 Clause 3.2.4-33 Option for Increased Quantity – Separately Priced Line Item.

Requested fill-in: “The Contracting Officer may exercise the option by written notice to the Contractor within a minimum of 30 calendar days prior to the start of the option period.”

Section F clause was a duplicate to the clause in Section I.

Clause has been removed from Section F.

Clause 3.2.4-33 fill-in has been updated in Section I accordingly.

12. Section I

I-3 3.2.4-4 Given the nature of the procurement as Best Value to the government and related to ongoing inflation and supply chain issues in this market sector, we request the FAA include (on Page I-3) an additional contract clause to the benefit of both the offeror and the government, per below:

“3.2.4-4: Fixed-Price Contracts with Economic Price Adjustment-Labor and Material (Oct 2019)

The FAA will not incorporate AMS clause 3.2.4-4 Fixed- Price Contracts with Economic Price Adjustment-Labor and Material into the NEXCOM V3 SIR.

(2) increase the page count for Part B to support Offeror demonstration of its understanding of all NEXCOM V3 program milestones and requirements in order that these details may be adequately addressed.

14. Section L

L-30 L.5.6.6 Section L.5.6.6, Part F – Subcontracting Plan, states that a subcontracting plan is required for all Offerors who are not small businesses and who will subcontract a portion of the work. Will the FAA accept use of a Comprehensive Subcontracting Plan approved under the Test Program of 15 U.S.C., 637 note?

Refer to AMS clause 3.6.1.-4 Small Business Subcontracting Plan for acceptable subcontracting plan types. Offerors must ensure subcontracting plans submitted are in accordance with all requirements AMS clause 3.6.1- 4 and the NEXCOM V3 SIR.

15. Section K

K-19 K.3 Contractors are to identify the country that it will manufacture each “end product”. Does “end product” include ancillaries and software/firmware or just the Operational Test (OT) and Production radios?

"The "end products" are not ancillaries or software/firmware, the intent of Section K.3's certification is applicable to the country where the V3 OT radios and V3 production radios are manufactured.

16. Section H

AGREEMENT

Please clarify the following:

1. How is the extent of the contractor’s responsibility determined, and who makes that determination?

2. Shouldn’t there be a notice provision, so that the government cannot settle with a plaintiff or perhaps have a judgment entered against it, and subsequently attempt to recover damages from the

Section or Attach ment contractor who may not even have been involved in the litigation?

3. How does this clause affect basic rules of civil procedure that already allow defendants to implead third parties who may be liable? In light of those existing third-party practice rules, why is this clause needed?

4. Is this the same as “contributory negligence?”

5. What is meant by “direct responsibility.” Is that to say that indirect damages are not covered?

17. Section I

I-3 3.1.7-1 Paragraph (a) of AMS clause 3.1.7-1, Exclusion from Future Agency Contracts, states the following: “Work under this contract may create a future organizational conflict of interest (OCI) that could prohibit the Contractor from competing for, or being awarded future Government contracts.” Per the prescription language this clause should be used as follows: “Must be used in all SIRs and contracts when the Contracting Officer has determined that an organizational conflict of interest could occur.” What work performed under the NEXCOM3 effort does the FAA believe may create an OCI that could prohibit a Contractor from competing for, or being awarded future contracts?

The NEXCOM V3 SIR includes AMS clause 3.1.7-1 Exclusion from Future Agency Contracts should an OCI occur in the future. Per AMS Procurement Guidance T3.1.7(A)(1) - Organizational Conflict of Interest, "The policy of the FAA is to avoid contracting with contractors who have unacceptable organizational conflicts of interest. An organizational conflict of interest means that because of existing or planned activities, (1) an offeror or contractor is unable or potentially unable to render impartial assistance to the agency, or (2) has an unfair competitive advantage, or

(3) the offeror or contractor's objectivity is or might be impaired. It is not the intention of the FAA to foreclose a vendor from a competitive acquisition due to a perceived Organizational Conflict of Interest (OCI)."

Parts, states the following: “A separately-priced recommended initial site and depot-level spare parts list for CLIN [Contracting Officer (CO) insert CLIN number here].” Does the FAA intend to identify the CLIN or CLINS requiring the separately-priced recommended initial site and depot-level spare parts list?

AMS clause 3.2.2.3-74 not applicable to the requirements of the NEXCOM V3 SIR and has been deleted from Section I in SIR Amendment 0002.

19. Section I

I-3 3.2.4-28 Paragraph (c) of AMS clause 3.2.4-28, Cancellation of Items, states the following: “If cancellation under this clause occurs, the Contractor will be paid a cancellation charge not over the cancellation ceiling specified in the "Schedule" as applicable at the time of cancellation.”

Does the FAA intend to provide a cancellation ceiling or should the contractor propose a cancellation ceiling?

AMS clause 3.2.4-28, Cancellation of Items not applicable to the NEXCOM V3 SIR and has been deleted from Section I in SIR Amendment 0002.
