Good Afternoon Ouhssayne, Attached please find the SHPO Concurrence for site 267 (PR‐155 km 30.1‐30.2), as requested.
Regarding site 281 (PR‐157 km 1.2), it does not have SHPO concurrence, because the PRHTA did not receive a response from SHPO after two (2) submissions. The 36 CFR 800.3(4) Failure of the SHPO/THPO to respond, indicates:
"If the SHPO/THPO fails to respond within 30 days of receipt of a request for review of a finding or determination, the agency official may either proceed to the next step in the process based on the finding or determination or consult with the Council in lieu of the SHPO/THPO. If the SHPO/THPO re‐enters the section 106 process, the agency official shall continue the consultation without being required to reconsider previous findings or determinations."
PRHTA understood that 15 months (first submission) and approximately 13 months (second submission) was enough time for SHPO to response, especially if site 281 has no historic properties. For that reason, the PRHTA requested the approval of the environmental document.

Good morning Jesse, We received a conditional certification for the subject project from EFL Environment Office and it indicates that the SHPO Concurrences from PR State Historic Preservation Office are missing for the following sites:
- Site 281, PR-157 KM 1.2 (AC-810579).
- Site 267, PR-155 KM 30.1-30.2 (AC-858579)
These SHPO Concurrence letters are required for landslide projects, and are typically include in the Appendix E of the NEPA document. I checked the previous submitted packages and was not able to find it in any of them.
Please reach out to the consultants and provide the missing documents as soon as possible.
Please note that the project is at the Certification stage and will be moving to final approval and advertisement soon.
If you have any questions, please let us know.
Best regards, Lahoucine Ouhssayne Civil Engineer (Highway)
