SUMMARY OF CHANGES

SECTION A - SOLICITATION/CONTRACT FORM

The following have been added by full text:

QUESTIONS & ANSWERS

Question #1: Are acts beyond our control and force majeure excluded? I do not see anything mentioned in the bid documents to clarify this.

Answer #1: Provision/Clause 52.212-4 states, “The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.”

Question #2: Damage / misuse by government officials is considered outside the scope and will be billable.

Does this apply to everyone who uses the elevators or just government officials?

Answer #2: Section 3.4.2.1 discusses that any misuse is to be reported whenever evidence is found that repairs are required due to other than fair wear and tear. This applies to anyone that uses the elevator(s).

Question #3: Please provide a more clear definition on obsolescence. I see that as the contractor we have to provide evidence satisfactory to the Government when repair parts are found to be obsolete.

Answer #3: An obsolete part is a part that is no longer available from any sources. The contractor is to provide notice to the Government as soon as repair parts are discovered to be obsolete.

Question #4: The solicitation states all repairs should be made in 48 hours. What if this is not possible due to delays with supply chain issues / shipping delays? Is there a penalty for not completing the repair in time?

Answer #4: The contractor is required to comply with the Performance Requirements (PWS Attachment 5). The contractor’s performance will be monitored and reported on an ongoing basis in the Contractor Performance Assessment Report System (CPARS).

Question #5: Repairs and service calls that fall outside the scope of normal wear and tear shall be billed separately. What is defined as a billable expense?

Answer #5: PWS paragraph 3.4.2.1 specifies that hours and parts will be paid for the repair of items outside normal wear and tear.

Question #6: Is “Buy American” a requirement of the contract? Will we be allowed to clarify that out due to the supply chain constraints?

Answer #6: Yes, please refer to clause 252.225-7021, which has been added to the solicitation.

Question #7: Are overtime service requests included in the contract? I see that if calls are made on a Saturday, Sunday or Holiday, the call must be answered on the next working day, but it does not specify if emergency calls that are answered after hours are billable.

Answer #7: No, emergency calls are not included under this contract.

Question #8: Will an escort be required for a badged employee of our company in order to access all the elevators and machine rooms to perform maintenance? If an escort will be required what type of notice will be needed to schedule?

Answer #8: Generally, no escorts are needed for vetted and badged employees (see PWS paragraph 5.2). An escort may be required in certain instances. One week’s notice should be sufficient, but the contractor is required to submit a schedule of when it will be doing their maintenance, in accordance with CDRL A002.

Question #9: Please provide clarity on what information is being asked for in the past performance questionnaire (Attachment 17). Are we to provide information on a similar contract we have held with the federal government or NSWCPD? If we have not had a previous contract with NSWCPD, will providing reference information for private commercial contracts be sufficient?

Answer #9: Please refer to Page 115 and 116 of the RFP and the Past Performance Questionnaire, Attachment

17. Each Offeror has the opportunity to provide in its proposal any information regarding its performance of contracts similar to the Government's requirement that it would like the Government to consider. Contracts submitted are not limited to those performed with NSWCPD, nor the Government.

Question #10: Please confirm we are to deliver a hard copy of the bid to the POC and location listed in block 15 of form 1449.

Answer #10: All quotes shall be submitted electronically to nicole.a.eckman.civ@us.navy.mil AND dillon.m.lucas.civ@us.navy.mil.

Question #11: Are you able to share the last bid information for this location?

Answer #11: N/A; new requirement.

Question #12: Currently you have two freight cars that Delaware Elevator is doing a MOD on. One seems to be completed and waiting to turn over and the other has not started yet. When the AFW 94 is turned over, will we be doing the monthly PMs or will they be included in the warranty from Delaware Elevator?

Answer #12: The contractor is required to perform PM on all elevators, every month, whether in service or not (including elevators being renovated) as stated in PWS paragraph 3.4.1(a).
