About this file

This document provides an amendment to a solicitation for the manufacture, assembly, test and delivery of Vertical Launching System (VLS) Universal Canister Electronics Units and associated cables.

The amendment adds instruction K-227-W001 regarding obtaining export-controlled technical data under the Joint Certification Program. It also provides responses to questions from offerors. The questions relate to making internal copies of technical data, sharing technical data with suppliers for pricing purposes, and requesting an extension to the proposal submission date. The responses indicate that internal copies are allowed following certain procedures, technical data cannot be shared with third parties, and the proposal due date will not be extended at this time.

The solicitation is being conducted by the Naval Surface Warfare Center Port Hueneme Division on behalf of the Naval Sea Systems Command. Offerors must submit proposals in response to solicitation number N6339420R0014 by September 25, 2020 to be considered. The technical data package required to develop proposals is restricted and only available to contractors under the Joint Certification Program.

Amendment 1:

Q&A and Revisions

The purpose of this amendment is to add K-227-W001 INSTRUCTIONS FOR OBTAINING EXPORT-

CONTROLLED TECHNICAL DATA (NAVSEA) (OCT 2018) to section K of the RFP and to provide response to questions.

1) Question: May we make internal copies of the CD to permit our locations in PA and FL to both work with the information (we will maintain control over the CD on a separate computer not on the network)?

Response: Yes, internal copies of the TDP CD are allowed as long as the procedures in Section L, Paragraph 2.3, Disposition of Technical Data Package (TDP) and Technical Drawings are followed.

2) Question: Currently we are not able to share with third parties. For material quotes with suppliers, the

TDP, BOMs, drawings etc may need to be shared with suppliers for pricing. With the restrictions, how should this be managed? Do we request permission from you and Nayneet specifically naming the supplier?

Response: To comply with International Traffic in Arms Regulations (ITAR, the TDP cannot be shared with third parties. If a possible third party vendor needs a copy of the TDP, they need to be under the Joint

Certification Program and request a copy of the TDP.

3) Question: Requesting instruction/authorization from the Government for the process to provide the TDP to vendors in order for vendors to quote source assembly support under the Solicitation.

Response: To comply with International Traffic in Arms Regulations (ITAR, the TDP cannot be shared with third parties. If a possible third party vendor needs a copy of the TDP, they need to be under the Joint

Certification Program and request a copy of the TDP.

4) Question: Requesting an additional 30 calendar day extension of time to submit the RFP response (from 25

Sep 2020 until 25 Oct 2020).

Response: The Government does not intend to extend the proposal due date at this time, should the

Government choose to do so, an RFP Amendment would be released.

(a) An offeror may not receive export-controlled technical data, which is specified in this solicitation, unless the offeror is a qualified U.S. contractor as defined in paragraph (b). See paragraph (c) and (d) for instructions on becoming a qualified U.S. contractor. (3) The U.S. Contractor acknowledges its responsibilities under U.S. export control laws and regulations

(including the obligation, under certain circumstances, to obtain an export license prior to the release of technical data within the United States) and agrees that it will not disseminate any export-controlled technical data subject to the Directive in a manner that would violate applicable export control laws and regulations.
