Notice No. 4 25 May 2022

PRE-PROPOSAL QUESTIONS & ANSWERS

RFP N62742-22-R-1317

FACILITIES AND INFRASTRUCTURE MULTIPLE AWARD CONSTRUCTION

CONTRACT FOR U.S. MILITARY CONSTRUCTION PROJECTS IN GUAM AND

OTHER AREAS UNDER THE COGNIZANCE OF NAVAFAC PACIFIC

NOTE: The following questions and answers are provided for INFORMATION ONLY.

The RFP remains unchanged unless it is amended in writing on a Standard Form 30.

18. Factor 3, Past Performance states the following. Drawing your attention to the statement “PPQs will not be accepted from the designer on a design-build project” and “PPQs shall be completed and signed by the contracting agent and/or their representative responsible for construction contract administration.” By using this criteria, the government is effectively eliminating from consideration many A/E that primarily perform services for a contractor rather than the government. If an A/E has participated on a design-build project the builder is the one in a direct construction contract administration relationship and are by all definitions the contracting agent with that designer and is the best judge of that designer’s performance. The government is not in a contract relationship with the designer and therefore in most instances will not provide a PPQ for work that was not contracted by the government.

The RFP states “The work to be performed under the Multiple Award Construction Contract (MACC) is for the design and construction of a broad range of new construction, repair, renovation and minor construction.” The MACC contractor owns the risk for incorporating the proper designer to complete a design that meets the criteria and funding.

Therefore, we request NAVFAC allow a contractor be able to utilize a designer’s CPAR or PPQ that was completed by the entity that had the construction contract administration over the designer.

RESP: The RFP remains unchanged.

19. We would like to ask for at least a 14-day extension (or longer if possible) for submission of the Phase-1 portion of the proposal which is currently due no later than 10 June 2022, 2:00 p.m., H.S.T.

RESP: The RFP remains unchanged.

20. Document 00 45 00, Representations & Certifications for Contracting by Negotiation,

1.12 DFARS 252.225-7018 Photovoltaic Devices. Document 00 45 00, Representations and Certifications for Contracting by Negotiation, Clause 1.12 DFARS 252.225-7018, Photovoltaic Devices – Certificate (Jul 2020) (Deviation 2020-O0019) requires the offeror to certify and designate the country of the photovoltaic devices to be used on this contract.

This RFP is a two-phase procurement; Phase-One does not provide drawings/specifications. Without drawings/ specifications, the Offeror is unable to make the required certification.

We kindly ask the Government’s consideration to delay this requirement to the Phase Two submission.

RESP: See Amendment 0003.
