Notice No. 1 03 May 2022
PRE-PROPOSAL QUESTIONS & ANSWERS
RFP N62742-22-R-1317
FACILITIES AND INFRASTRUCTURE MULTIPLE AWARD CONSTRUCTION
CONTRACT FOR U.S. MILITARY CONSTRUCTION PROJECTS IN GUAM AND
OTHER AREAS UNDER THE COGNIZANCE OF NAVAFAC PACIFIC
NOTE: The following questions and answers are provided for INFORMATION ONLY.
The RFP remains unchanged unless it is amended in writing on a Standard Form 30.
1. Document 00 21 16 (RFP). e. A list of existing commercial and government business commitments to include contract numbers, names of Contracting Officers, telephone numbers, value of contract, completion date and percent complete. If the list of existing commitments is extensive, provide the required information on at least five projects of similar dollar value and a summary of the existing commitments to include number of contracts, total dollar value of all contracts, and the total dollar value of work remaining. Please clarify the dollar value to use for comparison for the “similar dollar value” of the five projects mentioned in the paragraph e.
RESP: The dollar value for the required information on at least five projects of similar dollar value is as stated in Document 00 22 00, definition of relevant project.
2. Document 00 22 00. Attachment A, Item No. 1 and Item No. 1 b Entity Identifier (DUNS #). Sam.gov has changed the DUNS# to the Unique Entity Identifier starting April 4,2022. Most of the projects that will be submitted for Factor 2 - Experience, were performed before April 4, 2022, and the entities who performed the projects may not be existing anymore and may only have DUNS# instead of the Unique Entity Identifier, would the Government accept both the DUNS# and/or the Unique Entity Identifier as a valid entry for Item 1 and Item 1b of Attachment A?
RESP: Yes, include both if available. See forthcoming amendment.
3. SF 30- Block14. Desc of Work- “…. Work may include barracks/dormitories, administrative facilities, communication facilities, educational facilities, medical/dental/hospital facilities, dining facilities, industrial facilities, warehouse facilities….” Medical/Dental/Hospital facilities were mentioned in the description of work on page 5 of the RFP under Section SF 30 -Block 14. However, there was no mention of the Medical/Dental/Hospital facilities in the Construction Experience Relevancy.
RESP: While Medical/Dental/Hospital facilities are included as a part of the general scope of work of the MACC, the evaluation criteria does not include such facilities.
4. Document 002200. Construction Experience - Relevancy No. 1, 2, and 3. Please clarify which Construction Experience Relevancy a Medical/Dental/Hospital facility will be categorized:
(1) New construction of multi-story administrative, office, or headquarters facilities, approximately $30M or more.
(2) New construction of industrial facilities, specifically warehouses or maintenance buildings, approximately $10M or more.
(3) New construction of community support facilities, specifically schools, childcare centers, training buildings, theaters, retail, or recreation centers, approximately $30M or more.
RESP: See response to Question No. 4.
5. SF 1442. 1.2, a (1), “The proposal and each bond (Phase II) or other document submitted by or on behalf of the joint venture shall be executed by each joint venture partner and shall be accompanied by evidence of the authority of the signer. That authority shall be evidenced by a document satisfactory to the Contracting Officer, which would ordinarily be, in the case of a corporate joint venture partner, a certified copy of a resolution of the board of directors, and in the case of an unincorporated joint venture partner, an instrument of similarly binding character duly executed by that entity. If one individual signs for more than one partner, the individual must sign separately for each partner which he or she represents and must state under each signature the capacity in which he or she is signing (See FAR 4.102).
Document 00 21 16. Paragraph 1.7 b (The exact same sentence as above)
There is a duplicate requirement for Joint Venture Offerors. Will the Government accept for the Offeror to attach one certified copy of the resolution of the Board of Directors to SF 1442 section and just reference it in the latter Joint Venture Agreement section?
RESP: Yes, that is acceptable.
6. Document 00 21 16. 1.8 (b) (1) An Offeror is required to be registered in SAM when submitting an offer or quotation and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
FAR 52.204-7 and this solicitation section requires that an Offeror shall be registered in SAM by submission of the proposal. However, because the federal government has transitioned from using the DUNS Number to the Unique Entity ID since April 2022, there have been unexpected delays in new entity validation process recently. This is a very difficult and out-of-control situation for Offeror who plans to establish a new entity for this big $2.5B Facility and Infrastructure MACC package.
Please confirm if NAVFAC will accept proposals from Offerors who are currently under the SAM registration process and completed by the time of Phase I award?
RESP: Offerors must be registered in SAM when submitting an offer. A pending registration will not be accepted.
7. Document 00 22 00. 2.2 Non-Price Evaluation Factors, Factor 1 – Technical Approach: (a) Solicitation Submittal Requirements. We are unable to locate Document 00100 referenced in the Solicitation Submittal Requirements. Please provide.
RESP: The referenced document should have been Document 00 22 16. See forthcoming amendment.
8. Document 00 22 00. Factor 2 – Experience, (a) Solicitation Submittal Requirements.
Can you please provide the Attachment A – Construction and Design Experience Project Data Sheet as a Word document?
RESP: See project attachments in SAM.gov.
