4 Paragraph 4 states that "Only Offers from Prime Contractors and Joint Ventures (JV) will be accepted. Offers from Associazione Temporanea di Imprese (ATI) or Offers using a contract of availment (contratto di avvalimento) will not be accepted for this procurement and will be considered noncompliant to the solicitation requirements".

Since, in accordance with Italian regulations, a notarized ATI is

in all respects a form of JV which

(i) fully complies with all requirements set forth in the Submission requirements section and (ii) has usually been accepted by the US Government in all previous similar solicitations, we request you to confirm that paragraph 2 shall be interpreted as excluding from the procurement only those ATI that have not been formally established and notarized as of the date of the proposal submission.

Should the above not be the correct interpretation, we kindly ask for additional clarifications as to why an established Associazione Temporanea di Imprese would not be an admissible form of JV.

To such respect, we would like to highlight that if we were to establish a NewCo under Italian law for the submission of the offer and performance of the work, the

NewCo would not possess the certifications required for the submission of the proposal, as they would remain with the shareholders of the NewCo. Such problem would not exist in the case of an ATI.

PLease note that this change was accepted in prior similar procurement held by NAVFAC in SIgonella for project of similar size and complexity.

Option Item 1

The paragraph states: "Price to conduct survey for UXO in accordance with Health and Safety Plan (Piano Sicurezza e Coordinamento), Decree No. 81, Decree No. 82 Law No. 177. and GEN-BST 001 in areas where the site improvements occur and below existing grade, and locations where construction equipment (such as, but not limited to excavators, dump trucks, grader) are operating.

Minimum depth of survey must be

1m below utility location or site improvement."

The health and Safety plan at section 6.1.2 states that a geophysical survey is required for the areas subject to pavement replacement and excavation for new drainage piping and the results of the survey will determine the need for UXO survey.

Based on experience working in the area and on the same type of pavement, we anticipate encountering welded wire mesh reinforcement in the concrete pavement. this is not liklely going to allow reliable results form a georadar survey for the identification of buried metallic bodies. We request clarification on which type of geophysical survey should be executed in order to obtain reliable results to determine the need for an UXO survey. Please clarify what are the results that will trigger the need for a complete UXO survey. In particular, if the geophysical survey shall be executed by the UXO specialized company already and the required authorizations from 10th reparto are to be obtained for the geophysical survey.

CLIN 0002 -

Option Item 1

Based on the fact that previous construction was executed in the same area and that this project does not require any deeper excavation we request that the requirement for UXO clearance and associated surveys is removed from the Health and Safety Plan and from the option clins.

Solicitation remains unchanged.

Propose in accordance with the solicitation.

37 Att E - Price Proposal Form

CLIN 0002 -

Option Item 1

pavement demolition for each phase.

CLIN 0003 -

Option Item 2

CLIN Definition states: "removal, stockpiling, testing and off station disposal of 3,000 cubic meters of contaminated soil." in order to be able to provide a lump sum price we request these clarifications:

1. Is stockpiling going to be possible directly on the concrete pavement in the construciotn area with a plastic sheet underneath and a plastic sheet to cover it?

Assuming maximum height of 1.5 meters in the airfield area this would required 2000 sqm of storage space (40x50m).

If storage in the construciotn area will not be possible, how far is the storage location going to be? We need to be able to acccount for loading and transportaiton to the local storage area if this will be outside the construction area.

Before off site disposal temporary stockpiling will

See Attachment E – Revised Price Proposal Form be required for the period between sampling and analytical resuylts for disposal.

2. What level of soil contamination is to be considered?

Should the contaminated soil be considered Hazardous Material?

CLIN 0004 -

Option Item 3

CLIN Definition states: "removal, testing and off station disposal of 160,000 liters of contaminated groundwater." in order to be able to provide a lump sum price we request these clarifications:

1. Groundwater will have to be analyzed prior to off site disposal and some time will pass between sample colleciton and analytical results. Is the Government going to pèrovide temporary storage for the grounwater?

Should this be included in the price provided?

2. What level of groundwater contamination is to be considered?
