About this file

This document is an amendment to a solicitation for the P-1601 Wholehouse Revitalization project at Las Palmeras in Naval Station Rota, Spain. The Navy seeks to award a firm-fixed-price contract for design and construction services including 150 housing unit renovations. The pre-proposal site visit was held on June 12, 2019 and the proposal due date is July 2, 2019. The amendment provides responses to pre-proposal inquiries, revised drawings and attachments, and modifications to the solicitation instructions. Offerors must meet experience requirements on relevant projects of at least 50 housing units and $5 million in value. The evaluation will consider corporate experience, safety plans, and past performance. The Navy intends to make a single award to the offeror representing the best value determined by a tradeoff of non-price factors and price.

perimeter, please confirm if UFC 4-

010-01 shall be also applicable.

UFC 4-010-01 has been recently updated last December 2018 with clear design strategies that may result effective and economical in protecting

DoD personnel from blast incidents.

The UFC 4-010-01 (2018) is more up to date than the UFC 3-340-02 (2014) by defining the glazing frame bite in accordance with ASTM F2248, requiring to apply a structural silicone bead or a glazing tape to the glass panel, as a design strategy wich may result effective and economical in protecting DoD personnel from an explosive event, focused to minimize the hazard of most windows, which breaks at very low blast pressures. Its provisions are more accurate for the contract intended level of protection, in which glazing is retrained by the frame and shall not enter the room as a dangerous flying debris.

Supplementar y Instructions to Offerors

1.2b (a) Pursuant to Attachment (E) Schedule

B, Pricing Form, paragraph 1.2.b requires that for CLINs 0002 through

0014 the offeror shall divide the total amount of each CLIN by 150 and apply the resultant “per housing unit” cost to each unit of housing in CLINs 0001, and

0015 through 0032 as they are considered for award.

(b) Further, paragraph 1.2.1 CLIN-specific Bid Notes states that estimated and actual quantities of the unit-priced items will be handled in accordance with

[FAR] 52.211-18 – Variation in

Estimated Quantity.

We understand from (a) that the estimated “per housing unit” price resultant from unit priced CLINs 0002 through 0014 has to be incorporated to the firm fixed price of each unit of housing in the solicitation’s corresponding CLIN. However, we believe that there is a CLIN 0033 for five additional housing units, which is not mentioned in (a).

Additionally, we believe that the FAR referenced in (b) above is not included in the solicitation document.

See Revised Attachment (E)

Schedule B and Solicitation

Revision; additional clauses incorporated by reference.

13 Drawing AE503 Detail B1 In accordance with referenced detail, the contractor is required to install a self-adhering underlayment on the new and existing roof intersection.

Please, confirm if there are any other areas which may be subject to roof leaking.

Bid per Solicitation, drawings and specifications

14 Drawing P602 Detail in upper left corner of drawing

According to reference project detail, a solar panel steel support will be anchored on existing roof, by means of a drilled in galvanized threaded rod. We would like to clarify if:

1. Is there self adhering underlayment in the area to be drilled?

2. If there is, do underlayment sheets contain asbestos?

If the response to questions 1 and 2 above is positive, should the price of asbestos abatement be included in the

CLIN for the solar system? Or, will this cost be otherwise added to the contract price by application of CLIN 0003 for the removal and legal disposal of ACM in stucco and in roof?

Offerors must submit a price for CLIN 0001 through

CLIN 0033. Offerors not submitting pricing for all CLINs will be considered nonresponsive to the solicitation and will not be evaluated.

INTENT TO AWARD WITHOUT DISCUSSIONS: Proposals must set forth full, accurate and complete information as required by this Request for Proposal (including attachments). The penalty for making false statements in proposals is prescribed in 18 U.S.C. 1001. The Government intends to evaluate proposals and award without discussions. 7. EVALUATION FACTORS FOR AWARD

1. The solicitation requires the evaluation of price and the following non-price factors: Factor 1 – Corporate Experience

Factor 2 – Safety Factor 3 – Past Performance on Recent, Relevant Projects

The distinction between experience and past performance is that experience pertains to the volume of work completed by a contractor that are comparable to the types of work described under the definition of recent, relevant projects, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

2. The relative order of importance of the non-price evaluation factors is Factor 1 Corporate Experience and

Factor 3 Past Performance/Performance confidence assessment Factor are of equal importance to each other. When http://www.cnic.navy.mil/content/dam/cnic/hq/images/DBIDS/SECNAV%20Form%205512-1.pdf http://www.cnic.navy.mil/content/dam/cnic/hq/images/DBIDS/SECNAV%20Form%205512-1.pdf http://www.cnic.navy.mil/content/dam/cnic/hq/images/DBIDS/SECNAV%20Form%205512-1.pdf mailto:Robert.hernandez3@navy.mil mailto:iris.gholston@navy.mil mailto:steven.k.anderson@navy.mil the proposal is evaluated as a whole, the non-price factors are approximately equal to price. Factor 2 , Safety will only be rated Acceptable or Unacceptable, and offerors must be found Acceptable to be eligible for award, but this

Factor will not be considered in the weighting of non-price factors and the ultimate non-price/price tradeoff analysis. If an offeror is rated Unacceptable in any factor, they will not be eligible for award, unless the deficiency(ies) is/are remedied through discussions (if held).

The importance of price will increase if the Offerors’ non-price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-price proposal’s superiority to the Government. Award will be made to the responsible Offeror(s) whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.

3. Basis of Evaluation and Submittal Requirements for Each Factor.

(a) Non-price Factors:

Solicitation Submittal Requirements:

The Offeror shall submit one original, marked “Original”, five (5) copies marked “copy”, each in a separate three-ring or four-ring binder, and two (2) electronic copies on separate CDs, with the following characteristics:

• Text pages 8 ½ x 11 format (A4 paper is also acceptable)

• 12-point font, Times New Roman

• Two complete electronic copies of the technical proposal factors as a single .pdf searchable file, each on a separate CD (include the “Original” technical submission). If there are any conflicts between hard and/or electronic copies, the “Original” hard copy will govern.

• Include a cover page with Solicitation Number, Solicitation Title, Prime Contractor Name, Address, Phone Number, Fax Number, DUNS, Cage Code, Point of Contact, Title, phone number, and email address.

Factor 1 Corporate Experience:

(a) Solicitation Submittal Requirements:

The Offeror shall submit the following information:

Submit a minimum of (2) and maximum of five (5) relevant construction projects that best demonstrate the offeror’s experience on relevant projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as vertical construction projects which renovated Multi-Unit

Housing, apartment buildings or office buildings with at least fifty (50) residential units (across all buildings) in each project with a value equal to or exceeding $5,000,000 (or the equivalent foreign currency, on day of project award).

To be considered, projects submitted for the Offeror must have been completed within the past ten (10) years from the date of issuance of this request for proposal (RFP). To ensure a project is considered “complete”, the documentation should demonstrate final delivery to the client.

A project is defined as a construction project performed under a single task order or standalone contract. For multiple construction award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project; rather Offerors shall submit the work performed under a task order as a project.

The attached Construction Experience Project Data Sheet (Attachment B) is MANDATORY and SHALL be used to submit project information to demonstrate construction experience. Except as specifically requested, the

Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages) 8-1/2” X 11” page size. DUNS numbers for the entity that performed the project shall be noted for the construction projects.

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (e.g.: unique features, area, construction methods). The offeror must provide the construction cost of the example project in U.S. dollars (on day of project award). Failure to do so may result in a project being found non-relevant.

If the Offeror is a Joint Venture (JV)/ Union Temporal de Empresas (UTE), relevant project experience should be submitted for projects completed by the JV/UTE entity. If the JV/UTE does not have experience, at least one (1) project should be submitted for the JV/UTE members. Projects may be submitted for any JV/UTE partner; however, offerors who fail to submit experience for each JV/UTE partner may be considered less favorably. Offerors are still limited to a total of five (5) projects combined.

JV/UTE offerors shall provide with their proposal a notarized legal document that establishes the JV/UTE.

If an Offeror utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate the manner in which the affiliate/subsidiary/parent/LLC/LTD member firm will have meaningful involvement in the performance of the contract for the experience information of the affiliate/subsidiary/parent/LLC/LTD member companies to be considered. The proposal shall state specific commitments of technical resources (e.g. personnel, eq uipment) that the affiliate/subsidiary/parent/LLC/LTD member companies will commit to the performance of this contract. In particular, the proposal will clearly state the specific commitments of resources of the affiliate/subsidiary/parent/LLC/LTD member that will be located at the worksites and company offices in the city/area of the project. The proposal shall also describe specific roles of the affiliate/subsidiary/parent/LLC/LTD member companies in terms of the work it will either self-perform or manage on behalf of the Offeror in performance of the contract.

The Offeror may utilize experience of a subcontractor that will perform major or critical aspects of the requirement to demonstrate construction experience under this evaluation factor. The Offeror must provide a signed letter of commitment from the subcontractor and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract. Substitution of subcontractor(s) shall be avoided to the maximum extent possible, and any proposed substitutions shall have verifiable, equivalent experience to the subcontractor being replaced. More weight may be given to the Offeror’s projects than those submitted for subcontractors.

(b) Basis of Evaluation:

The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. The Government will only review five (5) projects for construction. If more than the maximum number of projects is submitted, the Government will evaluate projects in numerical order of submission up to the maximum number and will not evaluate projects beyond the maximum number specified in the submission requirements.

The Offeror may be considered more favorably if:

1. Relevant projects demonstrate construction experience with Multi-Unit Housing or apartments.

2. Relevant projects demonstrate construction experience in the geographic area of Rota, Spain where project is located.

3. Relevant projects demonstrate construction experience performed for the U.S. Government.

4. Relevant projects demonstrate construction experience performed as a prime contractor versus a subcontractor.

5. Relevant projects demonstrate experience performed by the offeror than those performed by subcontractors, affiliates or parent companies.

Factor 2, Safety:

(a) Submittal Requirements:

The Offeror shall submit the following information: (For a partnership, joint venture or union temporal de empresas, the following shall address each contractor who is part of the partnership, joint venture or union temporal de empresas; only one safety narrative is required.)

(1) Technical Approach for Safety:

Describe the offeror’s technical approach to safety for its employees as well as the plan that the offeror will implement to evaluate and measure safety performance of potential subcontractors, as part of the selection process for all levels of subcontractors. Also, describe any innovative methods that the Offeror will employ to ensure and monitor safe work practices at all subcontractor levels. The Safety Narrative shall be limited to three pages, 8 ½” x

11” page size (i.e.., one (1) double-sided page plus one (1) single-sided page; or three (3) single-sided).

(b) Basis of Evaluation:

The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for itself and its subcontractors. The

Government will evaluate the Offeror’s plan to select and monitor subcontractors, and any innovative safety methods that the Offeror plans to implement for this procurement. The Government’s sources of information for evaluating safety may include, but are not limited to, Government agencies, OSHA, NAVFAC’s Facility Accident and Incident Reporting (FAIR) and Contractor Incident Reporting System (CIRS) databases, and other related resources. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete safety information regarding these submittal requirements rests with the Offeror.

The evaluation will collectively consider the Offeror’s technical approach to safety and other sources of information available to the Government. The Government will also evaluate the narrative to determine whether subcontractor safety performance will be considered in the selection of all levels of subcontractors on the upcoming project.

This Safety Factor will be rated on an Acceptable/Unacceptable basis.

Factor 3. Past Performance:

(a) Solicitation Submittal Requirements:

The Offeror shall submit the following information:

If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 2 for Corporate Experience. If there is not a completed CPARS evaluation, then submit Past Performance Questionnaires (Attachment C) for each project included in Factor 1, Corporate Experience. The Offeror should provide completed Past Performance

Questionnaires (PPQs) in the proposal. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The

Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Heather Seibold, via email at heather.a.seibold@navy.mil .

Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 2, Corporate Experience. Offerors may also address any adverse past performance issues.

Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.

The Government reserves the right to contact references for verification or additional information. The

Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.

Performance award or additional information submitted will not be considered.

(b) Basis of Evaluation:

This evaluation will consider how well the Offeror’s team performed on relevant projects submitted under Factor 1, Corporate Experience and may also consider past performance on other relevant projects currently documented in known sources.

The Government will consider the recency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the

Contracting Officer’s responsibility determination. The assessment of the Offeror’s team’s past performance will be used as a means of evaluating the Offeror’s team’s probability to successfully meet the requirements of the RFP.

In the case of an offeror for which there is no information on past contract performance or where past contract performance information is not available or so sparse that no meaningful assessment can be performed, the offeror may not be evaluated favorably or unfavorably on the factor of past contract performance (see FAR

15.305(a)(2)(iv).) In this case, the Offeror’s past performance is unknown and assigned a performance confidence rating of “Neutral Confidence.” Although the Government may not rate an offeror that lacks recent, relevant past performance favorably or unfavorably with regard to past performance, the Government may determine that a

“Substantial Confidence” or “Satisfactory Confidence” past performance rating is worth more than a “Neutral

Confidence” past performance rating in a best value tradeoff as long as the determination is consistent.
