About this file
This document summarizes an amendment to a solicitation for wholehouse revitalization services at Naval Station Rota in Spain. The amendment extends the proposal due date from June 26 to July 2, 2019 at 2:00 PM EDT. It provides responses to pre-proposal inquiries, and revises portions of the solicitation including allowing relevant experience from the past ten years rather than five. The solicitation seeks a firm fixed-price contract for renovation of multi-unit housing and requires a minimum of two and maximum of five project examples demonstrating experience on similar projects valued over $5 million. Offerors must be registered in SAM and hold the requisite Spanish contractor classification. The evaluation will consider corporate experience, safety plans, and past performance. The amendment outlines submission requirements and evaluation criteria for these factors.

02 Solicitation
Per the instructions, the requirement for providing a bid for a UTE (J/V) is to have a DUNS number, NCAGE number and have an account activated in SAM. Given the timeframe for the bureaucratic processing of the documentation to form a UTE (J/V) and then achieve all these requirements, we kindly request an extension of the turn in date of the bid from 26 June 2019 to add an additional two weeks to permit adequate time for acquiring the required documentation.
Referencing the first page of the solicitation, (OFFERORS ARE ADVISED THAT
FUNDING MAY NOT BECOME
AVAILABLE. IF FUNDS ARE NOT
AVAILABLE, NO AWARD WILL BE
MADE AS A RESULT OF THIS
SOLICITATION) if currently there are no funds assigned and a possibility that funds made not become available, we feel the additional time will not be a factor in the overall time the USG will have to evaluate all offers received and request funds for awarding before the end of FY 19 (30 Sept 2019). By permitting this time extension, the USG is assuring the maximum possibility of the company with the best value and best

qualified to properly fulfill the requirements of the solicitation and not be disqualified for lack of registration documentation.
03 Solicitation
Per the instructions, “Submit a minimum of
(2) and maximum of five (5) relevant construction projects that best demonstrate the offeror’s experience on relevant projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as vertical construction projects which renovated Multi- Unit Housing, apartment buildings or office buildings with at least fifty (50) residential units (across all buildings) in each project with a value equal to or exceeding $5,000,000 (or the equivalent foreign currency, on day of project award). To be considered, projects submitted for the Offeror must have been completed within the past five (5) years from the date of issuance of this request for proposal (RFP). To ensure a project is considered “complete”, the documentation should demonstrate final delivery to the client.” Given the economic situation of Spain within the past 8 years, we kindly request to alternation to this requirement. 1. Permit new construction of Multi-Unit Housing, apartment buildings or office buildings with at least fifty (50) residential units (across all buildings) and 2.
to either consider projects at least 50% complete from the date of issuance of this request for proposal (RFP) or alternatively, past performance within the past eight (8) years from the date of issuance of this request for proposal (RFP).
See Amendment 0002, Factor 1, Corporate Experience has been revised to allow for relevant projects completed within the past ten (10) years.
04 Solicitation 00 21 16
The solicitation documents state that the “solicitation closing date” is 26 June 2019.
Section 002116 “Instructions to Proposers,” paragraph 6 “Inquiries, Proposal Format and Due Date” states that “the Government does not intend to respond to [PPI’s] submitted less than 15 calendar days before the solicitation closing date.” Therefore, the cut-off date for submittal of the PPI’s is established as 12 June 2019. However, pursuant to section 002116 “Instructions to Proposers,” paragraph 2 “Site Visits,” the site visit is also scheduled for 12 June 2019. We believe that there is no time allowed before the PPI cutoff date for the consideration, evaluation and submittal of any questions and/or issues that may arise from the site visit.
See Amendment 0002, proposal due date has been extended to July 2, 2019 at 2:00 PM, (EDT).

The Government reserves the right to eliminate from consideration any or all offerors at any time prior to award of the contract; to negotiate with offerors in the competitive range; to award the contract to other than the offeror submitting the lowest total price; and to award the contract to the offeror submitting the proposal determined to be the best value.
This acquisition will result in a firm fixed price contract for construction services. In accordance with FAR 36.205, the statutory cost limitation is $23,200,000 USD for P-1601. Award will be made in U.S. Dollars.

The penalty for making false statements in proposals is prescribed in 18 U.S.C. 1001. The Government intends to evaluate proposals and award without discussions. 7. EVALUATION FACTORS FOR AWARD
1. The solicitation requires the evaluation of price and the following non-price factors:
Factor 1 – Corporate Experience Factor 2 – Safety Factor 3 – Past Performance on Recent, Relevant Projects
The distinction between experience and past performance is that experience pertains to the volume of work completed by a contractor that are comparable to the types of work described under the definition of recent, relevant projects, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.
2. The relative order of importance of the non-price evaluation factors is the technical factors (Factor 1 Corporate Experience and Factor 2 Safety) are of equal importance to each other and, when combined are equal in importance to the past performance (performance confidence assessment factor). When the proposal is evaluated as a whole, the technical factors and past performance (performance confidence assessment) factor combined (i.e., the non-price evaluation factors) are approximately equal to price. Factor 2, Safety will only be rated Acceptable or Unacceptable. If an offeror is rated Unacceptable in any factor, they will not be eligible for award, unless the deficiency(ies) is/are remedied through discussions (if held).
The importance of price will increase if the Offerors’ non-price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-price proposal’s superiority to the Government. Award will be made to the responsible Offeror(s) whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.
3. Basis of Evaluation and Submittal Requirements for Each Factor.
(a) Non-price Factors:
Solicitation Submittal Requirements:
The Offeror shall submit one original, marked “Original”, five (5) copies marked “copy”, each in a separate three-ring or four-ring binder, and two (2) electronic copies on separate CDs, with the following characteristics:
• Text pages 8 ½ x 11 format (A4 paper is also acceptable)
• 12-point font, Times New Roman
• Two complete electronic copies of the technical proposal factors as a single .pdf searchable file, each on a separate CD (include the “Original” technical submission). If there are any conflicts between hard and/or electronic copies, the “Original” hard copy will govern.
• Include a cover page with Solicitation Number, Solicitation Title, Prime Contractor Name, Address, Phone Number, Fax Number, DUNS, Cage Code, Point of Contact, Title, phone number, and email address.
Factor 1 Corporate Experience:
(a) Solicitation Submittal Requirements:
The Offeror shall submit the following information:
Submit a minimum of (2) and maximum of five (5) relevant construction projects that best demonstrate the offeror’s experience on relevant projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as vertical construction projects which renovated Multi-Unit Housing, apartment buildings or office buildings with at least fifty (50) residential units (across all buildings) in each project with a value equal to or exceeding $5,000,000 (or the equivalent foreign currency, on day of project award).
To be considered, projects submitted for the Offeror must have been completed within the past ten (10) years from the date of issuance of this request for proposal (RFP). To ensure a project is considered “complete”, the documentation should demonstrate final delivery to the client.
A project is defined as a construction project performed under a single task order or standalone contract. For multiple construction award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project; rather Offerors shall submit the work performed under a task order as a project.
The attached Construction Experience Project Data Sheet (Attachment B) is MANDATORY and SHALL be used to submit project information to demonstrate construction experience. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages) 8-1/2” X 11” page size. DUNS numbers for the entity that performed the project shall be noted for the construction projects.
For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (e.g.: unique features, area, construction methods). The offeror must provide the construction cost of the example project in U.S. dollars (on day of project award). Failure to do so may result in a project being found non-relevant.
If the Offeror is a Joint Venture (JV)/ Union Temporal de Empresas (UTE), relevant project experience should be submitted for projects completed by the JV/UTE entity. If the JV/UTE does not have experience, at least one (1) project should be submitted for the JV/UTE members. Projects may be submitted for any JV/UTE partner; however, offerors who fail to submit experience for each JV/UTE partner may be considered less favorably. Offerors are still limited to a total of five (5) projects combined.
JV/UTE offerors shall provide with their proposal a notarized legal document that establishes the JV/UTE.
If an Offeror utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate the manner in which the affiliate/subsidiary/parent/LLC/LTD member firm will have meaningful involvement in the performance of the contract for the experience information of the affiliate/subsidiary/parent/LLC/LTD member companies to be considered. The proposal shall state specific commitments of technical resources (e.g. personnel, equipment) that the affiliate/subsidiary/parent/LLC/LTD member companies will commit to the performance of this contract. In particular, the proposal will clearly state the specific commitments of resources of the affiliate/subsidiary/parent/LLC/LTD member that will be located at the worksites and company offices in the city/area of the project. The proposal shall also describe specific roles of the affiliate/subsidiary/parent/LLC/LTD member companies in terms of the work it will either self-perform or manage on behalf of the Offeror in performance of the contract.
The Offeror may utilize experience of a subcontractor that will perform major or critical aspects of the requirement to demonstrate construction experience under this evaluation factor. The Offeror must provide a signed letter of commitment from the subcontractor and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract. Substitution of subcontractor(s) shall be avoided to the maximum extent possible, and any proposed substitutions shall have verifiable, equivalent experience to the subcontractor being replaced. More weight may be given to the Offeror’s projects than those submitted for subcontractors.
(b) Basis of Evaluation:
The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. The Government will only review five (5) projects for construction. If more than the maximum number of projects is submitted, the Government will evaluate projects in numerical order of submission up to the maximum number and will not evaluate projects beyond the maximum number specified in the submission requirements.
The Offeror may be considered more favorably if:
1. Relevant projects demonstrate construction experience with Multi-Unit Housing or apartments.
2. Relevant projects demonstrate construction experience in the geographic area of Rota, Spain where project is located.
3. Relevant projects demonstrate construction experience performed for the U.S. Government.
4. Relevant projects demonstrate construction experience performed as a prime contractor versus a subcontractor.
5. Relevant projects demonstrate experience performed by the offeror than those performed by subcontractors, affiliates or parent companies.
Factor 2, Safety:
(a) Submittal Requirements:
The Offeror shall submit the following information: (For a partnership, joint venture or union temporal de empresas, the following shall address each contractor who is part of the partnership, joint venture or union temporal de empresas; only one safety narrative is required.)
(1) Technical Approach for Safety:
Describe the offeror’s technical approach to safety for its employees as well as the plan that the offeror will implement to evaluate and measure safety performance of potential subcontractors, as part of the selection process for all levels of subcontractors. Also, describe any innovative methods that the Offeror will employ to ensure and monitor safe work practices at all subcontractor levels. The Safety Narrative shall be limited to three pages, 8 ½” x 11” page size (i.e.., one (1) double-sided page plus one (1) single-sided page; or three (3) single-sided).
(b) Basis of Evaluation:
The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for itself and its subcontractors. The Government will evaluate the Offeror’s plan to select and monitor subcontractors, and any innovative safety methods that the Offeror plans to implement for this procurement. The Government’s sources of information for evaluating safety may include, but are not limited to, Government agencies, OSHA, NAVFAC’s Facility Accident and Incident Reporting (FAIR) and Contractor Incident Reporting System (CIRS) databases, and other related resources. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete safety information regarding these submittal requirements rests with the Offeror.
The evaluation will collectively consider the Offeror’s technical approach to safety and other sources of information available to the Government. The Government will also evaluate the narrative to determine whether subcontractor safety performance will be considered in the selection of all levels of subcontractors on the upcoming project.
This Safety Factor will be rated on an Acceptable/Unacceptable basis.
Factor 3. Past Performance:
(a) Solicitation Submittal Requirements:
The Offeror shall submit the following information:
If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 2 for Corporate Experience. If there is not a completed CPARS evaluation, then submit Past Performance Questionnaires (Attachment C) for each project included in Factor 1, Corporate Experience. The Offeror should provide completed Past Performance Questionnaires (PPQs) in the proposal. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Heather Seibold, via email at heather.a.seibold@navy.mil .
Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 2, Corporate Experience. Offerors may also address any adverse past performance issues.
Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.
The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.
Performance award or additional information submitted will not be considered.
(b) Basis of Evaluation:
This evaluation will consider how well the Offeror’s team performed on relevant projects submitted under Factor 1, Corporate Experience and may also consider past performance on other relevant projects currently documented in known sources.
The Government will consider the recency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s team’s past performance will be used as a means of evaluating the Offeror’s team’s probability to successfully meet the requirements of the RFP.
In the case of an offeror for which there is no information on past contract performance or where past contract performance information is not available or so sparse that no meaningful assessment can be performed, the offeror may not be evaluated favorably or unfavorably on the factor of past contract performance (see FAR 15.305(a)(2)(iv).) In this case, the Offeror’s past performance is unknown and assigned a performance confidence rating of “Neutral Confidence.” Although the Government may not rate an offeror that lacks recent, relevant past performance favorably or unfavorably with regard to past performance, the Government may determine that a “Substantial Confidence” or “Satisfactory Confidence” past performance rating is worth more than a “Neutral Confidence” past performance rating in a best value tradeoff as long as the determination is consistent.
(b) Price:
Solicitation Submittal Requirements:
Offeror shall submit one (1) marked “Original,” one (1) copy, each in a separate three-ring or four-ring binder, and one (1) electronic copy (CD format) of the solicitation submittal requirements identified below:
-SF-1442, signed -Amendments (SF30s) Acknowledged -Completed Schedule B, Pricing Form -Include a cover page with Solicitation Number, Solicitation Title, Prime Contractor Name, Address, Phone Number, Fax Number, DUNS, Cage Code, Point of Contact and their phone and email address.

ADDITIONAL INFORMATION TO BE SUBMITTED WITH PRICE PROPOSAL PACKAGE:
RESPONSIBILITY DETERMINATION INFORMATION - In order to be eligible for award, the offeror must be determined responsible in accordance with FAR Part 9, specifically 9.104-1, General Standards. No purchase or award shall be made unless the Contracting Officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must have adequate financial resources to perform the contract, or the ability to obtain them. The Contracting Officer shall require acceptable evidence of the prospective contractor’s current sound financial status, as well as the ability to obtain required resources if the need arises. In regard to resources, the contractor must be prepared to present acceptable evidence of subcontracts, commitments or explicit arrangements that will be in existence at the time of contract award, to rent, purchase or otherwise acquire the needed facilities, equipment, services, materials, other resources or personnel. Consideration of a prime contractor’s compliance with limitations on subcontracting shall be taken into account for the time period covered by the contract base period or quantities, plus option periods or quantities, if such options are considered when evaluating offers for award. Pursuant to FAR 9.104-4, the Contracting Officer reserves the right to request adequate evidence of responsibility on the part of any prospective subcontractor(s). In the absence of information clearly indicating that the prospective contractor is responsible, the Contracting Officer shall make a determination of non-responsibility.
As a minimum requirement, all offerors are requested to submit (in the English language) as part of the price proposal submissions, the following:
1. One (1) Signed Bank Reference demonstrating adequate financial resources. If offeror’s firm has a line of credit – provide information on how many figures offeror can borrow against the line of credit (i.e. medium 6 figures – exact line of credit is not required).
2. The offeror shall provide the latest three complete fiscal year financial statements for the prime contractor, certified by an independent accounting firm, if practicable, or signed by an authorized officer of the organization. Submit evidence of availability of working/operating capital, which will be used for the performance of the resultant contract. For JV/UTE arrangements, submit the latest three complete fiscal year financial statements for each company in the JV/UTE and discuss the financial responsibilities among the companies. The Government may also utilize Dun & Bradstreet reports to evaluate the financial capacity of the offeror.
3. Point of contact from a bank or any financial institution with which the offeror transacts business.
Although required to be submitted with offeror’s price proposal, this information will not be evaluated as part of the price proposal. This information forms the basis of your firm’s responsibility determination should your firm be considered for award. Proposal packages from unsuccessful offerors will not be returned to the offeror, but shall be destroyed by the Contracting Officer. No certificate of destruction will be issued.
Basis of Evaluation:
The Government will evaluate price based on the total price. Total price consists of the basic requirements and all option items. The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in the solicitation. In accordance with FAR 52.217-5, evaluation of options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:
(i) Comparison of proposed prices received in response to the RFP.
(ii) Comparison of proposed prices with the IGCE.
(iii) Comparison of proposed prices with available historical information.
(iv) Comparison of market survey results.
8. PERFORMANCE GUARANTEE
Submittal Time: The offeror whose offer is accepted shall, within ten (10) days after award, furnish either (1) a Performance Guarantee and a notarized Performance Guarantee Letter conforming to the requirements below, or (2) Performance and Payment bonds conforming to the requirements below. If the offeror fails to provide either (1) a Performance Guarantee and a notarized Performance Guarantee Letter or (2) Performance and Payment Bonds within ten (10) days, the contract may be terminated for default. In such event, the offeror shall be liable for any cost of procuring the work which exceeds the amount of its offer and the bid guarantee shall be available toward offsetting such difference.
Form of Performance Guarantee: The Performance Guarantee shall be an amount equal to ten percent (10%) of the amount of the contract and shall be deposited into a banking institution, as acceptable to the contracting officer, which will then issue an irrevocable letter guaranteeing (the “Performance Guarantee Letter”) the payment of the amount deposited to the United States Government, upon demand by the Contracting Officer.
