1. OVERVIEW OF THIS SOURCE SELECTION

This solicitation is conducted as a negotiated procurement utilizing procedures in accordance with FAR Part

36.2. The best value continuum source selection process used in this acquisition is the tradeoff process. This process allows for a tradeoff between non-price factors (i.e., technical, past performance, and safety) and price and allows the Government to accept other than the lowest priced proposal or other than the highest technically rated proposal to achieve a best-value contract award. Award will be made to that responsible offeror whose proposal, conforming to the solicitation, is determined to offer the best value to the

Government considering the technical and price factors stated herein.

The Government reserves the right to eliminate from consideration any or all offerors at any time prior to award of the contract; to negotiate with offerors in the competitive range; to award the contract to other than the offeror submitting the lowest total price; and to award the contract to the offeror submitting the proposal determined to be the best value.

This acquisition will result in a firm fixed price contract for construction services. In accordance with FAR 36.205, the statutory cost limitation is $15,850,000 USD for P-119 and $18,940,000 for P-911. Award will be made in U.S. Dollars. An offer that does not contain separately-priced schedules will not be considered.

The contract completion time for P-119 and P-911 shall not exceed 925 days after notice to proceed.

INTENT TO AWARD WITHOUT DISCUSSIONS: Proposals must set forth full, accurate and complete information as required by this Request for Proposal (including attachments). The penalty for making false statements in proposals is prescribed in 18 U.S.C. 1001. The Government intends to evaluate proposals and award without discussions. However, the Government reserves the right to conduct discussions if it is later determined by the Contracting Officer to be necessary. Therefore, each initial offer should contain the best terms from technical, and price standpoints.

2. SITE VISITS

6. EVALUATION FACTORS FOR AWARD

1. The solicitation requires the evaluation of price and the following non-price factors:

Factor 1- Safety

Factor 2- Construction Experience

Factor 3- Past Performance

The distinction between experience and past performance is that experience pertains to the types or work and volume of work completed by a contractor that are comparable to the types of work described under the definition of recent, relevant projects, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

2. Factor 1, Safety will only be rated Acceptable or Unacceptable. If an offeror is rated Unacceptable for Factor 1, they will not be eligible for award, unless the deficiency(ies) is/are remedied through discussions (if held).

In making the best value award decision, the Government will consider Factors 2 and 3 and price. The relative order of importance of the non-price evaluation factors is the technical factor 2, Corporate Experience is equal in importance to the past performance (performance confidence assessment) factor. When the proposal is evaluated as a whole, Corporate Experience and the past performance (performance confidence assessment) factor combined (i.e., the non-price evaluation factors) are approximately equal to price.

The importance of price will increase if the Offerors’ non-price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-price proposal’s superiority to the Government. Award will be made to the responsible Offeror(s) whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.

3. Basis of Evaluation and Submittal Requirements for each factor.

(a) Non-price Factors:

The offeror shall submit one original, marked “Original”, five (5) copies marked “copy”, each in a separate three-ring binder, and two (2) electronic copies on separate CDs, with the following characteristics:

• Text pages 8 ½ x 11 format (A4 paper is also acceptable)

• 12 point font, Times New Roman (except that 10 pt font may be used on the Construction Experience Data Sheets (Att. (A))

• Two complete electronic copies of the technical proposal factors as a single .pdf searchable file, each on a separate CD (include with the “Original” technical submission). If there are any conflicts between hard copies and/or electronic copies, the “Original” hard copy will govern.

• Include a cover page with Solicitation Number, Solicitation Title, Prime Contractor Name, Address, Phone Number, Fax Number, DUNS, Cage Code, Point of Contact, Title, phone number, and email address.

The offeror’s proposal must include all data and information required and must be submitted in accordance with these instructions. The offeror shall be compliant with the requirements as stated herein, for non-conformance may result in an unfavorable proposal evaluation.

Factor 1 – Safety

(a) Solicitation Submittal Requirements:

The Offeror shall submit the following information: (For a partnership or joint venture, only one safety narrative is required).

Technical Approach to Safety:

Describe the Offeror’s technical approach to safety for its employees as well as the plan that the Offeror will implement to evaluate and measure safety performance of potential subcontractors as a part of the selection process for all levels of subcontractors. The Safety Narrative which shall include all information requested in this paragraph shall be limited to one single-sided, 8 ½ x 11 page size.

(b) Basis of Evaluation:

The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for itself and its subcontractors. The Government will evaluate the Offeror’s technical approach narrative, including the plan for safety of its employees and the Offeror’s plan to select and monitor subcontractors. The Government may also consider the Offeror’s overall safety record. The Government’s sources of information for evaluating safety may include, but are not limited to, Government agencies, OSHA, NAVFAC’s Facility Accident and Incident Reporting (FAIR) and Contractor Incident Reporting System (CIRS) databases, and other related resources. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete safety information regarding these submittal requirements rests with the Offeror. The evaluation will collectively consider the Offeror’s technical approach to safety and other sources of information available to the Government. The Government will also evaluate the narrative to determine whether subcontractor safety performance will be considered in the selection of all levels of subcontractors on the upcoming project.

This Safety Factor will be rated on an Acceptable/Unacceptable basis.

Factor 2 – Construction Experience:

(a) Solicitation Submittal Requirements:

The Offeror shall submit the following information:

Submit a minimum of one (1) and a maximum of four (4) relevant construction projects for the Offeror that best demonstrates your experience on relevant projects that are similar in size, scope, and complexity to the RFP. A relevant project must be submitted as a construction project performed under a single task order or stand-alone contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project; rather Offerors shall submit the work performed under a task order as a project.

There are two types of experience that will be considered relevant for this procurement:

(i) “Aircraft Pavement Construction Experience” – experience constructing concrete aircraft pavement, such as runways, taxi lanes, taxiways, and aprons. To be considered relevant Aircraft Pavement Construction Experience, the project must demonstrate construction of at least 10,000 square meters of reinforced concrete pavement, and must have been completed within the seven (7) years immediately preceding the date of issuance of this RFP.

(ii) “Fuel Pit Construction Experience” – experience in constructing aircraft fuel pits. To be considered relevant Fuel Pit Construction Experience, the project must demonstrate construction of either (a) four (4) aircraft fuel pits in new concrete, and/or (b) two (2) aircraft fuel pits in existing concrete pavement, and must have been completed within the seven (7) years immediately preceding the date of issuance of this RFP.

At a minimum, the offeror’s collective experience shall demonstrate the following:

1) at least one (1) relevant project demonstrating Aircraft Pavement Construction Experience.

2) at least one (1) relevant project demonstrating Fuel Pit Construction Experience. The offeror’s Fuel Pit Construction Experience must also collectively demonstrate:

(a) a minimum of four (4) pits installed in new concrete pavement, and

(b) a minimum of two (2) pits installed in existing concrete pavement.

NOTE: The requirement to demonstrate both Aircraft Pavement Construction Experience and Fuel Pit Construction Experience can be met by the same project or by separate projects. Additionally, the minimum requirements for Fuel Pit Construction Experience (minimum of four (4) pits installed in new concrete pavement and minimum of two (2) pits installed in existing concrete pavement) may be demonstrated either in a single project or across multiple projects. Considering all of the above, offerors are still limited to four (4) projects overall.

The attached Construction Experience Project Data Sheets (Att. (A)) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages) 8-1/2” X 11” page size.

DUNS numbers for the entity that performed the project shall be noted for the construction projects.

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e.: unique features, area, construction methods). Failure to do so may result in a project being found non-relevant.

If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects may be submitted for the Joint Venture members. Offerors who fail to submit experience for all Joint Venture members may be rated lower.

Offerors are still limited to a total of four (4) projects combined.

If an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract for the experience information of the affiliate/subsidiary/parent/LLC/LTD member companies to be considered. The proposal shall state specific commitments of technical resources (e.g. personnel, equipment) that the affiliate/subsidiary/parent/LLC/LTD member companies will commit to the performance of this contract. In particular, the proposal will clearly state the specific commitments of resources of the affiliate/subsidiary/parent/LLC/LTD member that will be located at the worksites and company offices in the city/area of the project. The proposal shall also describe specific roles of the affiliate/subsidiary/ parent/LLC/LTD member companies in terms of the work it will either self-perform or manage on behalf of the Offeror in performance of the contract.

The Offeror may utilize experience of a subcontractor that will perform major or critical aspects of the requirement to demonstrate construction experience under this evaluation factor. The Offeror must provide a letter of commitment from the subcontractor and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract. Substitution of subcontractor(s) shall be avoided to the maximum extent possible, and any proposed substitutions shall have verifiable, equivalent experience to the subcontractor being replaced.

(b) Basis of Evaluation:

The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. The Government will only review four (4) projects for construction. Any projects submitted in excess of the four (4) for Construction Experience will not be considered.

Relevant projects that are constructed on Naval Support Activity Souda Bay may be considered more favorably than those that do not demonstrate this experience.

Factor 3 – Past Performance:

If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 2 for construction experience. If there is not a completed CPARS evaluation then submit Past Performance Questionnaires (Att. (B)) for each project included in Factor 2, Construction Experience. When using Past Performance Questionnaires (PPQs), the Offeror should provide completed PPQs in the proposal. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Kate Delashmitt via email at kathleen.delashmitt@navy.mil.

Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 2, Construction Experience. Offerors may also address any adverse past performance issues.

Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.

The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.

Performance award or additional information submitted will not be considered.

(b) Basis of Evaluation:

This evaluation will consider how well the Offeror’s team performed on relevant projects submitted under Factor 2, Construction Experience and may also consider past performance on other projects currently documented in known sources. For purposes of this evaluation, relevance will be defined as any project demonstrating experience with construction of aircraft pavements and/or construction of aircraft fuel pits, although projects that are more similar to the subject project may be given more weight in the evaluation.

The Government will consider the recency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s team’s past performance will be used as a means of evaluating the Offeror’s team’s probability to successfully meet the requirements of the RFP.

In the case of offerors for which there is no information on past contract performance or where past contract performance information is not available or so sparse that no meaningful assessment can be performed, the offeror may not be evaluated favorably or unfavorably on the factor of past contract performance (see FAR 15.305(a)(2)(iv).) In this case, the offeror’s past performance is unknown and assigned a performance confidence rating of “Neutral Confidence.” Although the Government may not rate an offeror that lacks recent, relevant past performance favorably or unfavorably with regard to past performance, the Government may determine that a “Substantial Confidence” or “Satisfactory Confidence” past performance rating is worth more than a “Neutral Confidence” past performance rating in a best value tradeoff as long as the determination is consistent.

To be determined responsible, a prospective contractor must have adequate financial resources to perform the contract, or the ability to obtain them. The Contracting Officer shall require acceptable evidence of the prospective contractor’s current sound financial status, as well as the ability to obtain required resources if the need arises. In regard to resources, the contractor must be prepared to present acceptable evidence of subcontracts, commitments or explicit arrangements that will be in existence at the time of contract award, to rent, purchase or otherwise acquire the needed facilities, equipment, services, materials, other resources or personnel. Pursuant to FAR 9.104-4, the Contracting Officer reserves the right to request adequate evidence of responsibility on the part of any prospective subcontractor(s). Submit evidence of availability of working/operating capital, which will be used for the performance of the resultant contract. For Joint Venture arrangements, submit the latest three complete fiscal year financial statements for each company in the Joint Venture and discuss the financial responsibilities among the companies.

The Government may also utilize Dun & Bradstreet reports to evaluate the financial capacity of the offeror.

3. Point of contact from a bank or any financial institution with which the offeror transacts business.

Although required to be submitted with offeror’s price proposal, this information will not be evaluated as part of the price proposal. This information forms the basis of your firm’s responsibility determination should your firm be considered for award. Proposal packages from unsuccessful offerors will not be returned to the offeror, but shall be destroyed by the Contracting Officer. No certificate of destruction will be issued.

(b) Basis of Evaluation:

The Government will evaluate price based on the total price. Total price consists of the basic requirements (CLIN 0001 and CLIN 0002). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(i) Comparison of proposed prices received in response to the RFP.

(ii) Comparison of proposed prices with the IGCE.

(iii) Comparison of proposed prices with available historical information.

(iv) Comparison of market survey results.
