AMENDMENT 0004

Amendment 0004 is being issued to provide the following:

- Responses to PPIS 15-30

- Section 00100 – INSTRUCTIONS TO OFFERORS, Item B. ELIGIBILITY FOR AWARD, 4. ANTI-

MAFIA LAW has been changed in its entirety

Responses to PPIS 15-30

15. QUESTION: Based on the information presented below, can the Government provide guidance, or an alternative, such as acceptance of Self Certification? The above referenced documentation is no longer produced. From February 14, 2013, after the entry into force of the Amendments to the new anti-mafia code, Legislative Decree no. 159/2011, introduced by Legislative Decree no. 218/2012, the Chambers of Commerce can no longer issue chamber certificates with the statement Anti-Mafia Nulla Osta. Art. 120 of Legislative Decree no. 159/2011, in its new version, repeals—among others measures—even of Presidential Decree 252/1998, which in Section II, provided for the establishment and its regulation, of chamber certificates with the words anti-mafia. The repeal of this measure does not apply, accordingly with the current legislation, to the competence of the Chamber of Commerce on matter.

For the anti-mafia verifications public authorities or equivalent entities should contact the Prefecture of the province where the headquarters of the Contracting Authority (Article 99 of Legislative Decree no.

159/2011). Private individuals may use only the instrument of self-certification. Pursuant to art. 15 of Law 183/2011, public administrations and private providers of public services, can no longer claim to any kind of private certificates, including those anti- mafia, but only affidavits of certification. Currently, the anti-mafia certification request is made directly by the contracting authority and companies, during participation in contracts, to present adequate declaration that they are not in situations of exclusion.

RESPONSE: The Anti-Mafia language has been revised in its entirety in Amendment 0004.

16. QUESTION: At the Site Visit/Pre-Proposal Conference it was said that the Conference Presentation file and the List of Attendees will be distributed to Offerors by means of an amendment. Kindly provide the referenced files.

RESPONSE: Please see Amendment 0003.

17. QUESTION: The Government is listing 'Debarment from Award' requirements. What documents exactly are required for submittal from US companies? Which companies is this requirement valid for (Italian or US) as only Italian Law is specified in the paragraph?

RESPONSE: In accordance with the Solicitation, “A Contractor must submit an extract from criminal record or affidavits released by the local court of contractor’s residence.”

18. QUESTION: The Solicitation requires that Chamber of Commerce Certificates (Certificato di Iscrizione alla Camera di Commercio) is inclusive of "Nulla Osta" Statement. By Italian law (Law Nr. 646/82 and Nr.218/12) the Certificate issued by the Chamber of Commerce does not contain this statement. This means the Chamber of Commerce is not authorized to issue such a statement. This solicitation requirement contradicts local Italian Law. Offerors are able to provide Chamber of Commerce Certificate only. "Nulla Osta" Statement is directly issued to the Contracting Authority by the Italian Procura. We would like to respectfully request for the "Nulla Osta" requirement to be taken out from evaluation criteria, as Offerors are not able to provide this by Italian Law and this creates a condition to limit Italian companies from competition. As prescribed by Law, Offerors can provide self-certifications instead.

RESPONSE: The Anti-Mafia language has been revised in its entirety in Amendment 0004.

19. QUESTION: The US Government requires that proposals are submitted in the States. Shipment time shortens the number of days for preparation of proposals for European companies. Would the Government consider extending the proposal due date so that Offerors are given equal opportunity for preparation of proposals? If no time extension may be possible, would the Government consider allowing Offerors to also submit their proposals in Aviano Air Base, Italy?

RESPONSE: The proposal due date was extended in Amendment 0003. Proposals will NOT be accepted at Aviano Air Base.

20. QUESTION: Further questions have been received regarding the possibility of the Navy allowing other documentation in lieu of a SOA Certification.

RESPONSE: As stated in Amendment 0001, the SOA Certification is required.

21. QUESTION: (Page 244, Section 019113, Paragraph 1.1) This section specifies that “the CA shall be an independent third party hired by the Government via the A/E as part of the Contractor Quality Control (CQC), reporting directly to the Contracting Officer”. Therefore, the Contractor is to presume that the CxA (Commissioning Agent) is not required as a Contractor service to this contract, which means that the Contractor will not do the commissioning activities listed in the specification, and will not need to provide all documentation required by the LEED protocol; but is only to provide documents such as O&M manuals and eventual clarifications to the government furnished CA. Is this correct?

RESPONSE: The statement that "the contractor will not do the commissioning activities in the specification" is not correct. They still have commissioning activities to perform in support of the commissioning effort, but they are not responsible for the Commissioning Agent's activities.

01 91 17 section 1.7.3 defines the contractor responsibilities in support of the Cx effort.

- note that pre-functional checklist documentation and functional testing are commissioning activities to be performed by the contractor at the direction/witness of the CxA.

22. QUESTION: (Page A100-A201) At west side of the Building 5, columns are shown. While on structural drawings, only 1 column is shown adjacent to main entrance. Please clarify.

RESPONSE: There shall be total 5 columns as shown on Architectural Drawings. Structural design (including, footing, foundation, size, reinforcement, tie beams at top, etc.) for the remaining 4 columns shall be similar to the one shown on structural drawings.

23. QUESTION: (Page A104-A303/A304) 45db and 50db acoustic insulation, as requested, is not shown on wall detail. Please clarify.

RESPONSE: The overall construction of the wall shall meet STC 45 and STC 50.

24. QUESTION: (Page A307) Should cage on metallic ladder be included? Please clarify.

RESPONSE: Cage is not required.

25. QUESTION: (Page C101) Location of the 2 U/G water storage tanks is not shown on Site Plan. Please clarify.

RESPONSE: 2 Underground Tanks are shown on Layout Plan (C-101).

26. QUESTION: (Page C504) Enlarged plan and Wall Elevation indicate different dimensions of concrete perimeter wall. Please clarify.

RESPONSE: Enlarged Plan dimensions are correct.

27. QUESTION: (Section 01.14.0000.42, Paragraph 1.2.4) With reference to beneficial occupancy: Specs state that approximately 2 months after beneficial occupancy, the Contractor shall return to the Project site ….

contractor shall account for 2 months of GFCI installation. Please confirm contractor is allowed to proceed with the work at an external area beyond 1.5 mts from facility.

RESPONSE: All work, except that specified to be completed after the GFGI equipment installation, shall be completed prior to beneficial occupancy.

28. QUESTION: Regarding the windows that were designed, what are the charge weight and stand-off distance from the buildings and windows?

RESPONSE: The charge weight was based on an accidental detonation of 6,123 lbs (TNT Equivalent) with a standoff distance of 580 ft.

29. QUESTION: Regarding the windows that were designed, what are the pressure and impulse applied over the entire glazed area supported by the frame of the window?

RESPONSE: The windows were designed for a reflected pressure of 3.31 psi, with an impulse of 94.96 psi-ms.

30. QUESTION: (Page C101, P101, E103) On drawing C101, there are two underground tanks indicated with a note. On drawing P101, notes 4 and 5 indicate that they are holding tanks. And on E103, it shows the electrical connections. It is unclear the purpose of these two tanks. Please clarify their purpose?

RESPONSE: Tank descriptions are shown on drawing P-101 (Notes 4 & 5). One is Heating/Chilled Water Holding Tank and the other is Condenser Water Holding Tank. These tanks are required per Italian law.
