3.4 HAZARDOUS WASTE/REGULATED WASTE MANAGEMENT REQUIREMENTS:
3.4.1 DEFINITIONS:
3.4.1.1 Hazardous Waste (HW) – Any material intended to be
discarded as a solid, liquid, or gas which meets the definition of a HM and/or is designated a hazardous waste by the EPA as ignitable, (I) corrosive,(C) reactive, (R) toxicity characteristic, (i.e., metals)(E), acute hazardous waste, (H), toxic, (poison) (T) as specified in 40 CFR Part 261.20-.30, any material subject to the requirements for manifesting, pre transport inspections, record keeping and reporting, and exports and imports of hazardous waste, as specified in 40 CFR Part 262 or state hazardous material control authority.
3.4.1.2 Non-Hazardous Regulated Waste (NHRW) - Any non-
radioactive, non-hazardous waste generated that requires special handling and control, such as wastes that are governed by Department of Transportation (DOT) requirements for shipment.
Items that qualify as NHRW typically are prohibited from disposal into dumpsters. At NNSY, Contractors are required to dispose of their own NHRW, including waste streams that are normally “RCRA-hazardous” but are invoking one of the exclusions defined in 40
CFR 261.
3.4.1.3 Regulated Waste – Waste that, due to regulatory
restrictions, cannot be managed, transported, and/or disposed of as standard municipal waste. Such waste streams will include wastes regulated by the Resource Conservation and Recovery Act (RCRA), regulations of the U.S. Department of Transportation (DOT), or other regulations by federal, state, and local government entities. Hazardous Waste (HW) and Non-Hazardous Regulated Waste (NHRW) are the two primary subsets of Regulated Waste generated at NNSY.
3.4.1.4 Universal Waste (UW) - is subset of hazardous waste
consisting of all batteries, mercury containing equipment, and fluorescent light bulbs and ballast.

3.4.2 APPLICABILITY:
3.4.2.1 The requirements of this section (3.4 in its entirety) apply to all Contractors and sub-contractors. It is the responsibility of the Prime Contractor to communicate these requirements to all sub-contractors.
3.4.3 INITIAL MANAGEMENT REQUIREMENTS: Prior to a Contractor
beginning any tasks that may generate waste, the Contractor must appoint personnel to serve as Environmental Coordinators, identify the regulatory status of the waste streams to be generated, and contact Code 106.3 to establish accumulation areas for these waste streams.
3.4.3.1 APPOINTMENT OF ENVIRONMENTAL COORDINATORS (ECs):
(a) The Contractor (AND ANY SUBCONTRACTORS) must provide and maintain at least two representatives who will serve as Environmental Coordinators (ECs) for the purpose of administering the requirements of this Work Item (Section 3.4), including coordinating the work with the SUPERVISOR and WIT.
(b) The EC must be a direct employee of the Contractor.
Personnel obtained thru a temporary agency are prohibited from serving in the EC role.
(c) The Contractor must submit a list with names, addresses, offices, and home/cell telephone numbers of the designated representatives serving as the ECs, and at least one alternate to the SUPERVISOR.
(d) ECs must complete NNSY Code 106.33 initial Environmental Coordinator Training prior to the Contractor generating, processing and turn-in of HW to NNSY Code 106.32.
All employees who handle, store, or transport HM/HW must be trained, by NNSY Code 106.3, for their respective functions as required by federal and state regulations of 2.2, 2.4, 2.5, and 2.6.
3.4.3.2 IDENTIFICATION OF WASTE PRIOR TO GENERATION:
(a) PRIOR TO BEGINNING ACTIVITIES THAT MAY GENERATE WASTE, the Contractor (or sub-contractor) must contact their ECs in order to make the appropriate determinations about the regulatory status of waste streams to be generated.
(b) Waste determination shall be in accordance with the waste determination methodology outlined in the EC's training.
(c) For some waste streams, Toxicity Characteristic Leachate Procedure (TCLP) sampling and analysis may be required to accurately characterize the waste stream. All Contractors working at NNSY must have a plan to obtain these samples and have them analyzed. This entails:
- At least one staff member capable of obtain a TCLP sample in accordance with SW-846 methodology.
- Arrangements with a VELAP-accredited lab with which the Contractor may send the sample in order to get it analyzed per
