3. Minimum Guarantee: The Recurring (Firm-Fixed-Price) portion for the base year (only CLIN 0001) is the minimum guarantee for this contract.

4. Set-aside: This procurement is 100% Small Business Set-Aside.

5. NAICS Code: The NAICS Code is 561710. The size standard is $12,000,000.00. Refer to https://sam.gov/SAM/pages/public/index.jsf for entity registration.

6. Wage Determination: Service Contract Act wages are included in this solicitation. They are effective for the base period of the contract only and apply to all work subject to the Service Contract Act. New wage determinations will be incorporated at the time an option to extend the contract term is exercised. Price adjustments for option years shall be in accordance with FAR Clauses 52.222-43, Fair Labor Standards Act and Service Contract Act – Price Adjustments (Multiple Year and Option Contracts). Accordingly, prices in the Firm-Fixed-Price portion of this contract shall not include any contingency to cover increased costs for which adjustment is provided under this clause.

7. Bid Guarantee/ Bonding Requirements: A Bid Guarantee is not required for this procurement.

8. Contract Term: This contract contains provisions for one (1) base period and four (4) option periods. The Government has the option to extend the term of the contract in accordance with Contract Clause, FAR 52.217- 8, Option to Extend Services (Nov 1999).

9. Period of Performance: The period of performance is anticipated to be 1 August 2022 through 31 July 2027. Refer to Section F, Deliveries or Performance.

10. Evaluation of Proposal: For purposes of evaluating proposals for award, the Government will utilize pricing submitted for the base year and all option periods. Refer to Section M, Contract Clause 52.217-5 Evaluation of Options.

11. Contract Line Items (CLINS) and Contract Exhibit Line Items (ELINS):

a. Bidders shall enter unit prices and amounts for CLINS and ELINS in the schedule contained in the attached spreadsheet titled “Pest Control ELINs”.

b. In the event there is a difference between the unit price and the extended total amount, the unit price will be held to be the intended bid price and the total of the CLIN and ELIN will be recomputed accordingly. If the bidder provides a total amount for an ELIN, but fails to enter the unit price, the total amount divided by the ELIN quantity will be held to be the intended unit price.

c. The Schedule of the Recurring (Firm-Fixed Price) Work (CLIN 0001, 0003, 0005, 0007 and 0009) and Schedule of Non-Recurring (Indefinite Quantity) Work (CLIN 0002, 0004, 0006, 0008, 0010), will be used as the basis for deductions in accordance with the “CONSEQUENCES OF CONTRACTOR’S FAILURE TO PERFORM REQUIRED SERVICES” clause, Section E.

The contractor warrants, by submission of their bid that the bid price does not include any contingency for future wage increases.

13. Indefinite Quantity Individual Contract Line Item Quantities: Once the estimated quantities for individual line items shown in the Schedule have been ordered, additional quantities may be ordered as long as the overall not-to-exceed (NTE) amount of the contract per year is not exceeded and the Contractor agrees by signing the task order.

The contractor is cautioned to recognize that the initial term of the contract may be for a period less than one year, in accordance with the “Term of the Contract” clause in Section F. In the event that the period of performance is less than one year, the Government will reduce the individual line item quantities to reflect work remaining in the contract term and no other adjustments to the pro-rated contract price will be made.

15. Government Purchase Card: Indefinite quantity work may be ordered at the prices offered by two ways: 1) By the issuing activity using a DD Form 1155: Order for supplies and Services”, 2) Or by an authorized Government user via a Government Purchase Card (GPC). A. BASIS FOR AWARD

Offerors will be evaluated using the commercial procedures as prescribed in FAR Part

12. The solicitation will utilize the following evaluation factors: Price, Technical Approach, Corporate Experience, Past Performance, and Safety. The offeror’s proposal shall contain a response to each of the evaluation factors and shall be in the form prescribed by the solicitation. The resulting contract will be awarded to the responsible offeror whose proposal, conforming to the Request for Proposal (RFP), will be most advantageous to the Government, price and other evaluation factors considered.

1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest priced, technically acceptable offer.

2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

3. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

4. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

B. EVALUATION FACTORS FOR AWARD

1. The solicitation requires the evaluation of price and the following non-price factors:

Factor 1 – Technical Approach Factor 2 – Corporate Experience Factor 3 – Past Performance Factor 4 – Safety

The distinction between corporate experience and past performance is corporate experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

2. Basis of Evaluation and Submittal Requirements for Each Factor.

(a) Price:

(1) Solicitation Submittal Requirements:

Price Binder: The offeror shall submit one (1) electronic (emailed to rebecca.r.dennison.civ@us.navy.mil) and one (1) original (mailed), marked “original,” in a three ring binder with the following:

Paper size shall be 8 ½” x 11” Offerors shall use a minimum of a 12-point font Signed Solicitation, Offer and Award Form (SF1449), including Section

B (CLINs 0001 through 0010), with all amendments acknowledged.

Pest Control ELINs (Completing each tab of the bid schedule) Copy of Representation and Certifications from SAM Confirm submission of the most recent VETS 4212 Report Include a cover page with solicitation number, solicitation title, prime contractor name, address, phone number, fax number, DUNS, Cage Code, point of contact, point of contacts phone number, and email address.

Provide name of financial institution, point of contact, telephone number and email address. Provide a signed statement of release giving the reference permission to release information to the Navy.

The offeror shall provide the latest three complete fiscal year financial statements. If the offeror is a new joint venture partnership, include the last three complete fiscal year financial statements for each firm.

The price proposal shall be submitted separately (but at the same time as the technical proposal).

(2) Basis of Evaluation: The Government will evaluate price based on the total price. Total price consists of the basic requirements and all option items as noted in Section B of the solicitation, as well as in the attached Pest Control ELINs spreadsheet. The Government intends to evaluate all options, both Firm-Fixed Price (Recurring Work) and IDIQ (Non-Recurring) CLINS, and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in the solicitation. In accordance with FAR 52.217-5, Evaluation of Options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(i) Comparison of proposed prices received in response to the RFP.

(ii) Comparison of proposed prices with the IGCE.

(iii) Comparison of proposed prices with available historical information.

(iv) Comparison of market survey results.

Proposals will be evaluated for completeness and reasonableness as follows:

Completeness: All pricing information required by the solicitation has been provided, all mathematical computations are correct and the pricing application understood, prices are on an “all or none” basis, and failure to submit a price on an item or a number of items may cause this factor and the entire offer to be determined unacceptable.

Reasonableness: Price analysis comparisons indicate the offered price to be fair and reasonable, balanced across option years, and balanced amongst all Recurring and all Non-Recurring Exhibit Line items.

Unreasonable, unbalanced, or incomplete pricing may cause a proposal to be determined Unacceptable

(b) Technical Factors:

Technical Binder: The offeror shall submit one (1) electronic (emailed to rebecca.r.dennison.civ@us.navy.mil) and one (1) original (mailed), marked “Original”, and two (2) copies (mailed), each marked “Copy”, in separate three ring binders with the following:

(described below) for the four technical factors (technical approach, corporate experience, past performance, and safety).

Limited to 25 pages- page count excludes cover page and tabs. *PAGES

THAT EXCEED THE PAGE LIMITATION SHALL NOT BE

EVALUATED.

Include a cover page with solicitation number, solicitation title, prime contractor name, address, phone number, fax number, DUNS, CAGE Code, point of contact, point of contact phone number and email address.

Provide approved SBA JV Agreement or SBA approved Mentor-Protégé Agreement (if applicable).

(1) Factor 1- Technical Approach:

(i) Solicitation Submittal Requirements:

The offeror shall submit a narrative setting forth its proposed Contractor’s Work Plan (CWP) to perform the work described in the RFP. The plan must include discussion of the 4 questions listed below. CWP does not count toward the 25 page limit.

1 From the Contractor’s Work Plan (CWP), describe the tools to be used for pest surveillance (such as sticky traps, flashlights, flushing agents, light traps, etc.) and the techniques to be used for pest identification.

2 From the Contractor’s Work Plan (CWP), describe the proposed pest control procedures that follow the principles of Integrated Pest Management (IPM) and reflect current industry practices.

3 From the Contractor’s Work Plan (CWP), describe pest control records that will be kept electronically for reporting requirements.

4 From the Contractor’s Work Plan (CWP), describe how quality control oversight will be conducted for recurring work.

(ii) Basis of Evaluation:

Adjectival Ratings/Evaluation

Rating Evaluation

Acceptable

The proposal demonstrates an acceptable understanding of the performance objectives and standards. The proposal provides a feasible technical approach with the capability to at least meet solicitation performance objectives and standards. The proposal offers a low to moderate performance risk to the Government.

Unacceptable The proposal demonstrates a technical approach that is seriously flawed or inadequate which demonstrates an unacceptable understanding of the performance objectives and standards. There is no reasonable likelihood of success; Weaknesses, significant weaknesses, or deficiencies so major or extensive that a major revision tantamount to complete rewrite of the proposal would be needed. The proposal offers a high performance risk to the Government.

(2) Factor 2 - Corporate Experience: The offerors shall provide information on at least one (1) up to a maximum of five (5) relevant pest control service contracts that they have performed as the Prime Contractor within the past five years, including current and on-going contracts. Relevancy is defined as being of similar size, scope, and complexity to the current requirement. Offerors are to include a short description of the work performed, contract number, title, location, and a list of clients and/or points of contact with accurate telephone numbers. Offerors may include past experience information regarding predecessor companies, key personnel who have relevant experience, and subcontractors who will perform major or critical aspects of the requirement. The Contracting Officer will determine the value and relevancy of such information.

(i) Solicitation Submittal Requirements: Offerors shall provide short descriptions of work performed not to exceed one (1) page per contract using Attachment D- Corporate Experience. Offerors shall provide corporate experience information on the same contracts provided for Factor 3-Past Performance. Description shall include, but is not limited to, types and quantity of equipment, work performed, and (if applicable) any similarities to the work outlined in this solicitation.

Note: The distinction between corporate experience and past performance is that corporate experience pertains to the types of work and volume of work completed by a contractor, which are comparable to the types of work covered by this requirement in terms of size, scope, and complexity. Past performance relates to how well a contractor performed on those previous works.

(ii) Basis of Evaluation

Rating: Evaluation Acceptable The offeror has an adequate work experience history on contracts (at least one prior contract) that are similar in size, scope, complexity, context and relevancy. The proposal offers a low to moderate performance risk to the Government.

Unacceptable The offeror has no work experience on contracts that are similar in size, scope, complexity, context and relevancy. The proposal offers a high performance risk to the government.

(1) Factor 3 - Past Performance:

Offerors shall clearly demonstrate a history of successful past performance on contracts of similar size, scope and complexity to this RFP. The Government may consider 1) information supplied by the offeror; 2) information obtained by references provided by the offeror; 3) other relevant past performance information obtained from other sources and data bases known to the Government; and 4) information on past performance of predecessor companies, key personnel who have relevant experience, and subcontractors who will perform major or critical aspects of the requirement. The Government will use this information to determine if the record indicates accomplishing performance objectives, any problems and corrective actions taken on prior contracts, a reputation for reasonable behavior, and generally a business-like concern for the customer’s interest. Likewise, the Government shall use this information to assess whether the offeror’s experience demonstrates at least an adequate ability to avoid/correct performance problems and challenges as they arise.

(i) Solicitation Submittal Requirements: IF A COMPLETED CPARS

EVALUATION IS AVAILABLE, IT SHALL BE SUBMITTED WITH THE PROPOSAL. IF

THERE IS NOT A COMPLETED CPARS EVALUATION, the Past Performance Questionnaire (PPQ) included in the solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 2 (Corporate Experience). AN OFFEROR SHALL NOT SUBMIT A PPQ WHEN A

COMPLETED CPARS IS AVAILABLE.

IF A CPARS EVALUATION IS NOT AVAILABLE, ensure correct phone numbers and email addresses are provided for the client point of contact. Completed PPQs should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment C), which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Rebecca Dennison, via email at rebecca.r.dennison.civ@us.navy.mil, prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Also include performance recognition documents received within the last 2 years, such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information

Retrieval System (PPIRS) using all CAGE/Entity Identifier numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), and any other known sources not provided by the offeror.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

A copy of the blank Past Performance Questionnaire to be used for requesting client references is included as Attachment C.

(ii) Basis of Evaluation: The degree to which past performance evaluations and all other past performance information reviewed by the Government (e.g., PPIRS, Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), performance recognition documents, and information obtained from any other source) reflect a trend of satisfactory performance considering:

- A pattern of successful completion of tasks;

- A pattern of deliverables that are timely and of good quality;

- A pattern of cooperativeness and teamwork with the Government at all levels

(task managers, contracting officers, auditors, etc.);

- Recency of tasks performed that are identical to, similar to, or related to the task at hand; and

- A respect for stewardship of Government funds.

Rating Evaluation Criteria Acceptable Offer has at least a satisfactory history of performance on contracts that are similar in size, scope, complexity, context and relevancy.

Previous performance demonstrates an adequate ability to avoid/correct performance problems and challenges. The proposal offers a low to moderate performance risk to the Government.

Neutral Offeror does not have a record of relevant past performance. The offer will not be evaluated favorably or unfavorably on past performance.

Unacceptable Offeror has a history of predominantly unsatisfactory performance on contracts that are similar in size, scope, complexity, context and relevancy. Previous performance demonstrates a trend of poor or non-existent ability to avoid/correct performance problems and challenges.

The proposal offers a high performance risk to the Government.

(2) Factor 4 - Safety:

(i) Solicitation Submittal Requirements:

The Offeror shall submit the following information: The Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate; and Total Case Rate (TCR) for the specified five (5) Calendar Years (CY), as well as a safety narrative, as described below. For a partnership or joint venture, the Offeror shall submit separate DART and TCR rates for the specified five (5) CY for each contractor who is part of the partnership/joint venture; however, only one safety narrative is required. Any fatalities experienced within this 5-year timeframe must be explained in detail, to include root cause and corrective actions.

NOTE: DART and TCR shall not be submitted for subcontractors

1. DART Rate: Submit five (5) previous complete calendar years’ [CY 2017, 2018, 2019, 2020, and 2021] worth of data (not an overall average). If the Offeror has no DART rate, for any year, affirmatively state so and explain why.

a. DART cases include injuries or illnesses resulting in death, days away from work, and/or restricted work or transfer to another job days beyond the day of injury/illness.

b. Calculation of DART rate: Multiply the total number of DART cases by 200,000, and then divide by the number of employee labor hours worked

2. TCR Rate: Submit five (5) previous complete calendar years’ [CY 2017, 2018, 2019, 2020, and 2021] worth of data (not an overall average). If the Offeror has no TCR rate, for any year, affirmatively state so and explain why.

a. TCR cases include injuries or illnesses resulting in death, days away from work, restricted work or transfer to another job days beyond the day of injury/illness, medical treatment beyond first aid, or loss of consciousness.

b. Calculation of TCR rate: Multiply the total number of TCR incidents by 200,000, and then divide by the number of employee labor hours worked

3. Technical Approach to Safety: Submit a narrative that addresses the following:

a. Describe the Offeror’ s approach to implementing and executing a Safety Management System (SMS) including Management/Leadership involvement, Employee involvement, Hazard prevention, Hazard control, Worksite analysis, and Safety and health training, to include the standard(s) used to benchmark the

SMS.

b. Describe the evaluation process used to select potential subcontractors.

c. Describe the processes of how the Offeror will oversee safety compliance of subcontractors at all levels throughout performance of the contract (to include the Offeror’s own in-house workforce).

d. The Technical Approach to Safety narrative shall be limited to two (2) single-sided pages or one (1) double-sided page.

4. The Government reserves the right to review other available sources

(public/Government internal) of information. These may include but are not limited to OSHA data, NAVFAC’s Contractor Incident Reporting System (CIRS), Contractor Performance Assessment Reporting System (CPARS), Electronic Contract Management System (eCMS), etc.

(ii) Basis of Evaluation:

The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for itself and its subcontractors. To meet the minimum requirements, the Offeror must demonstrate the following:

1. DART rates at or below 2.99

2. TCR Rates at or below 4.49

NOTE: If the Offeror’s rates exceed the established levels above for any of the five years, it will result in a deficiency.

3. Technical Approach to Safety

a. Offeror describes a viable SMS that addresses elements; such as Management/Leadership involvement, Employee involvement, Hazard prevention, Hazard control, Worksite analysis, and Safety and health training, to include the standard(s) used to benchmark the SMS.

b. Offeror describes a methodical process of evaluating subcontractor’s safety performance in their selection process.

c. Offeror describes a logical management plan to hold both themselves and their subcontractors accountable for adhering to the safety requirements of the contract.

4. The Government reserves the right to review other available sources (public/Government internal) of information. These may include but are not limited to OSHA data, NAVFAC’s Contractor Incident Reporting System (CIRS), Contractor Performance Assessment Reporting System (CPARS), Electronic Contract Management System (eCMS), etc.
