SECTION SF30 BLOCK 14 CONTINUATION PAGE
SUMMARY OF CHANGES
1. Throughout RFP: CHANGE “UFGS Section 31 23 00.00 20 Excavation and Fill” to “Part 5 Prescriptive Specification Section 31 23 00.00 22 Excavation and Fill (PWD ME)”
2. RFP Part 1, Specification 00 41 00 BID SCHEDULES: DELETE in its entirety and REPLACE with attached revised specification.
3. RFP Part 2, Specification 01 57 19.05 22 TEMPORARY ENVIRONMENTAL CONTROLS FOR DESIGN- BUILD (PWD ME): DELETE in its entirety and REPLACE with attached revised specification.
4. RFP Part 3, Chapter 2 Project Objectives, Paragraph 2.3.2 Stormwater Management and Treatment:
DELETE and REPLACE with the following:
“Comply with State of Maine Department of Environmental Protection (MEDEP) Chapter 500 Stormwater Management Laws and other applicable State and Local stormwater regulations. The Designer of Record (DOR) shall balance all requirements and acquire required regulatory permits when managing stormwater generated.
Proposed work on the H-1 site is considered “maintenance” and does not require Maine Site Location of Development Act (SLDA) or Coastal Zone Management Act (CZMA) permitting and associated stormwater flow management and treatment. Proposed work on the three demolition sites requires stormwater management and treatment permitting under both permits which can be provided under the following Site Redevelopment Stormwater Design Concept.
PNS ∙ A/E Contract N40085-16-D-3006 ∙ Page 2
Site Redevelopment Stormwater System Design Concept:
The Contractor has the option of designing and constructing stormwater treatment systems and runoff controls to comply with Chapter 500 directly, or can take advantage of the following design concept for redevelopment sites. To comply with Chapter 500 rules to the extent practicable, PNS has entered into an agreement with Maine DEP regarding stormwater treatment and runoff control requirements for redevelopment sites on PNS.
The percentage of redeveloped area that must be treated for the project shall be calculated using Chapter 500 criteria and determined from Chapter 500, Table 3. Once the percentage of the redeveloped area that must be treated is known, a minimum pervious to impervious surface ratio of 2-to-1 can be applied to redevelopment of the site to satisfy the treatment requirements for the project. The concept drawings in Part 6, Attachment N indicate a possible redevelopment concept supported by the Stormwater Treatment Design Concept in Part 6 Attachment HH. The calculations (for the concepts) indicate that treatment of 60 percent of redeveloped areas are required for the demolition sites. Therefore, 60 percent of the redeveloped area can be used to satisfy the 2-to-1 pervious to impervious areas to meet the PNS treatment agreement for this project.
This concept reduces impervious surfaces so stormwater detention/retention or other runoff controls are not required and a waiver request is required to be filed as part of the SLDA permit application if this concept is implemented.”
5. RFP Part 3, Chapter 2 Project Objectives, Paragraph 2.4 Appropriate Design: ADD the following paragraphs:
“2.4.23 Asbestos Containing Plaster (Building H-1) The existing wall and ceiling plaster throughout Building H-1 was determined through sampling and testing to contain asbestos. The intent of this project is not to abate all of the existing wall and ceiling plaster. Where existing wall and ceiling plaster is required to be disturbed or removed to accomplish the work of the project, abatement of the plaster system will be required. See Part 6 Attachment G for the Historic Hazardous Materials Survey Report Data and the Hazardous Materials Reports included with this Amendment.
2.4.24 Lead-Containing Paint
The Contractor shall assume that all existing painted surfaces contain lead paint and comply with EPA regulations and Lead-Safe work practices.”
6. RFP Part 3, Chapter 2 Project Objectives, Paragraph 2.4.1, Paragraph 5: REVISE to read as follows:
“Given the project program, it is understood that not all interior character-defining features can be retained. However, these features should be considered throughout the design and priority should be placed on retention of features in primary spaces when possible. In order to establish guidelines for the design, and to support SHPO consultation, qualified personnel on the contractor's team (*qualified personnel shall be someone meeting the Secretary of the Interior's Professional Qualification Standards for: History, Architectural History, or Historic Architecture: https://www.nps.gov/history/local-law/arch_stnds_9.htm) shall prepare a summary of primary and secondary spaces and the character-defining features within. This summary shall be prepared in accordance with Preservation Brief 18:
Rehabilitating Interiors in Historic Buildings, "Identifying Character-Defining Elements," Preservation Brief 17: Architectural Character, "Identifying the Visual Aspects of Historic Buildings as an Aid to Preserving Their Character," and the National Park Service Technical Preservation Services publication "Planning Successful Rehabilitation Projects" available at:
https://www.nps.gov/tps/standards/applying-rehabilitation/successful-rehab/interiors-primary-secondary.htm. In order to complete this assessment, it is assumed that background research will be required. An electronic draft submittal shall be provided to the Navy for concurrence before producing a final document. Once finalized, this document shall be used as an aid to minimize or avoid impacts on historic properties during design.”

1.2 DEFINITIONS
1.2.1 Sediment
Soil and other debris that have eroded and have been transported by runoff water or wind.
1.2.2 Solid Waste
Garbage, refuse, debris, sludge, or other discharged material, including solid, liquid, semisolid, or contained gaseous materials resulting from domestic, industrial, commercial, mining, or agricultural operations.
Types of solid waste typically generated at construction sites may include:
a. Green waste: The vegetative matter from landscaping, land clearing and grubbing, including, but not limited to, grass, bushes, scrubs, small trees and saplings, tree stumps, and plant roots. Marketable trees, grasses, and plants that are indicated to remain, be re-located, or be re-used are not included.
b. Surplus soil: Existing non-hazardous soil that is in excess of what is required for this work, including aggregates intended, but not used, for on-site mixing of concrete, mortars, and paving.
c. Debris: Non-hazardous solid material generated during the construction, demolition, or renovation of a structure which exceeds
2.5 inch particle size that is: a manufactured object; plant or animal matter; or natural geologic material (e.g. cobbles and boulders), broken or removed concrete, masonry, and rock asphalt paving;
ceramics; roofing paper and shingles. Inert materials may be reinforced with or contain ferrous wire, rods, accessories, and weldments. A mixture of debris and other material such as soil or sludge is also subject to regulation as debris if the mixture is comprised primarily of debris by volume, based on visual inspection.
d. Wood: Dimension and non-dimension lumber, plywood, chipboard, hardboard. Treated and/or painted wood that meets the definition of lead contaminated or lead based contaminated paint is not included.
SECTION 01 57 19.05 22 Page 3
e. Scrap metal: Scrap and excess ferrous and non-ferrous metals such as reinforcing steel, structural shapes, pipe, and wire that are recovered or collected and disposed of as scrap. Scrap metal meeting the definition of hazardous material or hazardous waste is not included.
f. Paint cans: Metal cans that are empty of paints, solvents, thinners, and adhesives. If permitted by the paint can label, a thin dry film may remain in the can. NOTE: Aerosol (paint) cans are Hazardous Wastes and must not be disposed of as solid waste or be considered in any definition of "empty", "paint", or "metal" cans.
g. Recyclables: Materials, equipment, and assemblies such as doors, windows, door and window frames, plumbing fixtures, glazing, and mirrors that are recovered and sold as recyclables.
h. Hazardous Waste: By definition, to be a hazardous waste a material must first meet the definition of a solid waste. Hazardous waste and hazardous debris are special cases of solid waste. They have additional regulatory controls and must be handled separately. They are thus defined separately in this document.
Material not regulated as solid waste are: nuclear source or byproduct materials regulated under the Federal Atomic Energy Act of 1954 as amended; suspended or dissolved materials in domestic sewage effluent or irrigation return flows, or other regulated point source discharges; regulated air emissions; and fluids or wastes associated with natural gas or crude oil exploration or production.
i. Special Waste: "Special waste" means any solid waste generated by sources other than household and typical commercial establishments that exists in such an unusual quantity or in such a chemical or physical state, or any combination thereof, that may disrupt or impair effective waste management or threaten the public health, human safety, or the environment and requires special handling, transportation, and disposal procedures. Special waste includes, but is not limited to:
(1) Ash;
(2) Industrial and industrial process waste;
(3) Sludge and dewatered septage;
(4) Debris from nonhazardous chemical spills and cleanup of those spills;
(5) Contaminated soils and dredge materials;
(6) Asbestos and asbestos-containing waste;
(7) Sand blast grit and non-liquid paint waste;
(8) High and low pH waste;
(9) Spent filter media residue; and
(10) Shredder residue.
SECTION 01 57 19.05 22 Page 4
1.2.3 Hazardous Debris
As defined in Solid Waste paragraph, debris that contains listed hazardous waste (either on the debris surface, or in its interstices, such as pore structure) per 40 CFR 261 ; or debris that exhibits a characteristic of hazardous waste per 40 CFR 261 .
1.2.4 Chemical Wastes
This includes salts, acids, alkalies, herbicides, pesticides, and organic chemicals.
1.2.5 Garbage
Refuse and scraps resulting from preparation, cooking, dispensing, and consumption of food.
1.2.6 Hazardous Waste
Any discarded material, liquid, solid, or gas, which meets the definition of hazardous material or is designated hazardous waste by the Environmental Protection Agency or State Hazardous Control Authority as defined in 40 CFR Parts 260-273, as applicable .
The Resource Conservation and Recovery Act (RCRA) governs the management of hazardous wastes. There is no continuously updated, comprehensive list of hazardous waste, as hazardous waste identification is a process that involves many steps. By Regulation, to be considered a hazardous waste, a material first must be classified as a solid waste (40 CFR §261.2). If a waste is a solid waste, it must then be determined if it is hazardous waste (§262.11). Wastes are defined as hazardous by EPA if they are specifically named on one of four lists of hazardous wastes located in Subpart D of 40 CFR 261, or if they exhibit one of four characteristics located in Subpart C of Part 261 (characteristic wastes), which are:
ignitability, corrosivity, reactivity, and toxicity. Generators are responsible for characterizing their waste and must determine whether a waste exhibits a characteristic by either testing or applying knowledge of the hazardous waste characteristic of the waste (§262.11). Hazardous waste controls also apply to Universal Wastes.
1.2.7 Hazardous Materials
Hazardous materials as defined in 49 CFR 171 and listed in 49 CFR 172 .
Hazardous material is any material that:
a. Is regulated as a hazardous material per 49 CFR 173 , or
b. Requires a Safety Data Sheet (SDS) per 29 CFR 1910.120 , or
c. During end use, treatment, handling, packaging, storage, transportation, or disposal meets or has components that meet or have potential to meet the definition of a hazardous waste as defined by 40 CFR 261 Subparts A, B, C, or D.
Designation of a material by this definition, when separately regulated or controlled by other instructions or directives, does not eliminate the need for adherence to that hazard-specific guidance which takes precedence over this instruction for "control" purposes. Such material includes
SECTION 01 57 19.05 22 Page 5 ammunition, weapons, explosive actuated devices, propellants, pyrotechnics, chemical and biological warfare materials, medical and pharmaceutical supplies, medical waste and infectious materials, bulk fuels, radioactive materials, and other materials such as asbestos, mercury, and polychlorinated biphenyls (PCBs). Nonetheless, the exposure may occur incident to manufacture, storage, use and demilitarization of these items.
1.2.8 Waste Hazardous Material (WHM)
Any waste material which because of its quantity, concentration, or physical, chemical, or infectious characteristics may pose a substantial hazard to human health or the environment and which has been so designated. Used oil not containing any hazardous waste, as defined above, falls under this definition.
1.2.9 Oil or Oily Waste
Oil: Oil of any kind or in any form, including, but not limited to: fats, oils, or greases of animals, fish or marine mammal origin; vegetable oils, including oils from seeds, nuts, fruits, or kernels; and, other oils and greases, including petroleum fuel oil, sludge, synthetic oils, mineral oils, oil refuse, or oil mixed with wastes other than dredged oil.
Oily Waste: Those materials which are, or were, mixed with used oil and have become separated from that used oil.
