About this file
This is a Pre-Proposal Inquiry Form for federal solicitation N40084-26-Q-2300 dated July 28, 2026, regarding collection and disposal of solid waste bags at Marine Corps Installations Pacific (MCIPAC).
The document presents a single question and government response addressing prospective bidders' concerns about waste classification and regulatory compliance in Japan. The inquiry questioned whether bidders may independently consult with Japanese prefectural authorities regarding applicable waste licensing and classification requirements, or whether the current solicitation fully satisfies Japanese statutory requirements for non-hazardous solid waste management without special industrial waste licensing or controlled waste manifests. The Government response clarifies that offerors are not prohibited from conducting independent due diligence and consulting with appropriate Japanese prefectural authorities regarding licensing and regulatory requirements. Offerors bear responsibility for obtaining all necessary permits, licenses, and authorizations required to perform the contract in accordance with solicitation requirements and applicable host nation laws. The Government's environmental assessment determined that the sampled material does not meet Japanese Environmental Governing Standards criteria for hazardous waste. Although metal needles and medical-type debris were present during sampling and present a physical safety hazard to personnel, these items do not alter the environmental waste classification. Consequently, the requirement will proceed as a solid waste contract, and the solicitation remains unchanged.

Could the Government please confirm whether prospective bidders are permitted to independently consult with the appropriate local Japanese prefectural authorities, using the provided test results and photographs taken during the site visit, to verify the applicable waste classification and licensing requirements? Alternatively, does the Government consider the current solicitation scope to fully satisfy the applicable Japanese statutory requirements for non-hazardous solid waste management, without the need for special industrial waste licensing or controlled waste manifests?
The Government does not prohibit prospective offerors from conducting their own due diligence, including consulting with the appropriate Japanese prefectural authorities regarding applicable licensing or regulatory requirements. Offerors are responsible for obtaining all permits, licenses, and authorizations necessary to perform the contract in accordance with the solicitation requirements and applicable host nation laws and regulations.
Based on the Government's environmental assessment, the sampled material does not meet the Japanese Environmental Governing Standards (JEGS) criteria for hazardous waste.
The presence of metal needles and other medical-type debris was known during sampling and does not change that determination. While such items present a physical safety hazard to personnel handling the material, they do not alter the Government's environmental waste classification. Therefore, this requirement will proceed as a solid waste contract.
The solicitation remains unchanged.
