The Government does not believe that this requirement poses excessive risk on the Contractor. While the actual amount of each type of service orders is not known, the Government has provided historical estimates (informational only) to assist Contractors with their bids. It is up to each Contractor to consider their business operation and weigh the risk appropriately when developing the bids.

The Contractor should also refer to Attachment J-1502000-03 for additional data on Historical E/U/R work.

The Government responsibility for the inquiry:

No changes to the Specification (PWS).

00027 9/23/2024 61, 62 and 63

1502000 3.1.1, 2 and 3

Specification. indicates that the Contractor has full responsibility for any work up to the urgent service order limit of liability of Y100,000 in direct labor and direct material cost per emergency service order, Y200,000 per urgent service order and per Y300,000 per routine service order. The Government will ONLY PAY for the portion of dire labor and direct material that exceeds the emergency, urgent and routine service order limits of liability.

We read that the above-mentioned means that the Contractor bear the amount of Y200,000 in any case of each emergency, urgent and routine services.

NOBODY knows how many times the urgent service order happen so it is very difficult for Contractor to estimate amount of urgent service orders. That's why we have to estimate and bid the amount of limits of liability for unknown times will be occurred.

This matter will give the Contractor excessive risk under the contract to be equal.

We would like to request that this requirement be deleted or the number of urgent services be limited.

ELINs indicate "approximately 12 times annually" for emergency, urgent and routine (E/U/R) work. Shall these times be amount of limits of liability? or only information?
