No.) 983 in accordance with the contract drawings and this specification. The Contractor must conduct site survey to verify all dimensions and local and existing conditions, and to examine the contract drawings and specifications to determine the extent of the work prior to commencement of the work. The repair work includes removal of existing materials and related accessories, provision of those new materials and related accessories, painting, abatement and sampling of asbestos containing material (ACM) and abatement of material containing lead (MCL) and paint with lead, in accordance with the contract drawings and this specification. The work also includes temporary work, incidental related work necessary to accomplish the project. The contract also includes repair or replacement of existing work damaged by the Contractor’s operations to equal or better conditions.

b. Sampling and analysis for ACM existence at exterior wall paint including putty and mortar

1.2.1.2 Option Item:

For Option Item of the project, the work scope is as indicated in the following table. Option Item is only applicable if an existence of ACM is confirmed as the result of the work item “b” in Base Item.

Item Work Scope

Option Item Abatement of ACM at exterior wall paint including putty and mortar

1.2.2 Manage and Dispose of Asbestos Containing Materials (ACM)

Any material containing more than 0.1 percent asbestos by weight is defined as ACM. The Contractor must manage and dispose of the ACM in accordance with applicable codes, rules, and regulations, and Section 02

82 00.00 33 ASBESTOS REMEDIATION.

1.2.2.1 Existence of ACM before Start of Removal Work

1.2.2.1.1 Government Test Result

Government test result is attached to this section as Attachment 01

1.2.2.1.2 Government Assumption without Test Data

See following table as the Government assumed ACM. If denoted by a `Yes` in the `Contractor’s Survey and Sampling Work` column, the Contractor must conduct a survey for locations of assumed ACM in accordance with paragraph entitled, “Contractor’s Survey,” while if denoted by a `N/A` (i.e., not applicable), the Contractor does not necessarily need to perform the survey.

1.2.2.1.3 Contractor’s Survey

SECTION 01 11 00.00 33 Page 3

Perform asbestos surveying in accordance with 40 CFR 763 and Determination of ACM by JEGS before start of removal work.

Submit all laboratory reports to the Government. List the areas, types, locations, definition of non-detected and determination, and quantities of ACM and any contamination that will affect the project. Provide sample descriptions, results, locations, location maps, and photographic documentation. Asbestos sampling work must be done by a building inspector who is trained and certified by the U.S. EPA authorized certification and accreditation program. Testing laboratory must comply with following paragraph “Testing Laboratory.” The survey result, also refers otherwise as ACM Sampling and Analysis Result, must be submitted to the Government as soon as it is identified and within 45 calendar days after the award for Base Item, unless otherwise directed by the Contracting Officer.

If the Contractor suspects the presence of ACM in a location not identified within the table under paragraph entitled, “Government Assumption without Test Data,” the Contractor may conduct survey/sampling at its own expense. If sampled and analyzed items on the laboratory report are confirmed to contain ACM, a modification may be issued for the cost of the sampling, testing, abatement, and disposal.

1.2.3 Manage and Dispose of Lead (Material Containing Lead/Paint with Lead (MCL/PWL)), Cadmium and Chromium (VI)

Manage and dispose of the lead (MCL/PWL), cadmium, chromium (VI) in accordance with applicable codes, rules, and regulations, and Section 02 83 00.00 33 LEAD REMEDIATION. The Contractor is required to protect workers from lead exposure under OSHA lead standards covering general industry (29 CFR 1910.1025) and construction (29 CFR 1926.62); and from cadmium exposure under OSHA lead standards covering general industry (29 CFR 1910.1027) and construction (29 CFR 1926.1127); and from chromium (VI) exposure under OSHA lead standards covering general industry (29 CFR 1910.1026) and construction (29 CFR 1926.1126).

Any materials, including paint, that contain lead are defined as MCL or PWL. The OSHA lead standard for the construction industry makes no distinction between working on MCL/PWL with greater than 0.5% (5,000 mg/Kg) lead and those that have less. Also, the OSHA does not consider paint containing less than 0.06% lead to be “lead free.” Accordingly, for all tasks governed by OSHA lead standard involving materials/paints having any level of lead, must comply with the assessment measures and any applicable protections of that standard.

1.2.3.1 Existence of Lead, Cadmium and Chromium (IV) before Start of Removal Work

1.2.3.1.1 Government Test Result

Government test result is attached to this section as Attachment 01

ACM/LBP SURVERY REPORT.

1.2.3.1.2 Government Assumption without Test Data

SECTION 01 11 00.00 33 Page 4

See following table as the Government assumed lead. If denoted by a `Yes` in the “Contractor’s Survey and Sampling Work” column, the Contractor must conduct a survey for locations of assumed lead in accordance with following paragraph entitled, “Contractor’s Survey,” while if denoted by a `N/A` (not applicable), the Contractor does not necessarily need to perform the survey. In addition the Contractor must conduct a cadmium and chromium (VI) survey in the same location as the assumed lead if the survey is performed.

1.2.3.1.3 Contractor’s Survey

Perform lead, cadmium and chromium (VI) survey in accordance with EPA Title X and EPA RRP Rule before start of removal work.

Submit all laboratory reports to the Government. List the areas, types, locations, definition of non-detected and determination (Not use 0.5%, 5,000 mg/Kg, and 0.06%.), and quantities (mg/Kg) of lead, cadmium and chromium (VI) and any contamination that will affect the project, including soil and dust. Provide sample descriptions, results, locations, location maps, and photographic documentation. Lead, cadmium and chromium (VI) sampling work must be done by an inspector or risk assessor who is trained and certified by the U.S. EPA authorized certification and accreditation program. Testing laboratory must comply with following paragraph “Testing Laboratory.”

If the Contractor suspects the presence of lead, cadmium and chromium (VI) in a location not identified within the table under paragraph “Government Assumption without Test Data,” the Contractor may conduct survey/sampling at its own expense. If sampled and analyzed items on the laboratory report are confirmed to contain lead, cadmium and chromium (VI), a modification may be issued for the cost of the sampling, testing, abatement, and disposal.

1.2.3.1.3.1 Testing Laboratory

Submit the name, address, and telephone number of the testing laboratory selected to perform the analysis, testing, and reporting of concentrations (mg/Kg) of lead, cadmium and chromium (VI). Use a laboratory participating in the EPA National Lead Laboratory Accreditation Program (NLLAP) by being accredited by either the American Association for Laboratory Accreditation (A2LA) or the American Industrial Hygiene Association (AIHA) and that is successfully participating in the Environmental Lead Proficiency Analytical Testing (ELPAT) program to perform sample analysis. The testing laboratory firm must be independent of the lead, cadmium and chromium (VI) contractor and must have no employee relationship which could constitute a conflict of interest.

SECTION 01 11 00.00 33 Page 5

1.2.3.2 Unexpected Discovery after Start of Removal Work

After start of removal work, notify the Contracting Officer if any previously untested building components suspected to contain lead, cadmium and chromium (VI) survey are impacted by the work. Government will determine if the material is hazardous as specified in the paragraph entitled, “Unforeseen Hazardous Material,” in Section 01 35 26.00 33

GOVERNMENTAL SAFETY REQUIREMENTS.
