QUESTION GOVERNMENT RESPONSE
RFP Package;
Attachment(3) h(3)_1624524
Electromagnetic & Hydrographic Equipment:
The RFP package included attachment 3 which lists very detailed (to include manufacturer name and model number) information on equipment which has been approved for use. Can the Government clarify if the exact equipment listed must be used, or if bidders are allowed to use equipment from other manufacturer's which perform similarly to the equipment specified by the Government?
The Electromagnetic and Hydrographic Equipment to be used by the contractor awarded this requirement must be approved by the Naval Ordnance Safety and Security Activity (NOSSA). The awarded contractor is NOT required to use this exact equipment.
However, the list of equipment in Attachment (3) was used during Phase I Dredging. Attachment (3) is included to inform all bidders of the previously used equipment.
If the awarded contractor intends to use different equipment, then it will require NOSSA approval prior to being used. It does not need to be approved prior to award.

1.4.1.2; Page 2
Exclusionary Period:
During the period of "work stoppage" between April and October, is it possible for the Contractor to conduct non-dredging related work such as sampling of sediment, magnetic surveying, underwater surveying and depth and shallow surveying?
Yes, it is possible.
Sec 01 11
00.00 33; Para.
1.4.1; Page 2
Period of Performance:
On an assumed award timeframe of early November 2021 (90 days after the bid date) the Contractor would have until the end of March 2022 (about 4.5 months) to complete all contract specified pre-construction safety & environmental documentation, coordinate permits with various host nation authorities, coordinate and finalize disposal venues for dredged materials, and conduct all required pre-dredging surveys. Actual dredging would not start until December 1, 2022 after the April to November exclusionary period has passed. This means the Contractor will have about 121 calendar days (until Mar 31, 2023) to complete all of the dredging.
Once the anticipated weather delay days (01 32 16.00 33, para.
1.3.1.1), weekends and US holidays (01 14 00.00 33, para. 1.3.4) and Japanese New Year's observances are subtracted from the 121 calendar days, the actual time the Contractor will have to complete all of the dredging, associated surveying and acceptance inspections will be roughly 78 working days. In light of all of the coordination required, the 78 working days is really cutting the schedule close. Would the Government consider modifying the specified period of performance of 540 calendar days?
The 90 calendar days will be extended to finalize report and document after dredging works.
See Attachment (5).
Sec 01 14 00.00 33; Para.
1.3.2(g); Page 4
Overnight Berthing:
This section states that overnight berthing of Contractor's vessels will be limited to just (2) two; however, this type of operation requires a larger number of vessels for it to be done safely and efficiently. Will the Government reconsider the specified quantity of (2) two vessels?
There is no limit number of vessel berthing and floating-equipment if there is no impact with ship operation and it is approved by Port Ops.
See Attachment (5).
Sec 35 20 23.00 33; Para. 1.9;
Over depth Dredging:
In regard to over dredging, does the 30 cm allowable over dredging depth also applicable to the side slopes that are within the "dredging limits", or is that applicable to just the flat (horizontal) seabed?
The 30 cm allowable over dredging depth also applicable to the side slopes that are within the "dredging limits".
Sections 01 14
00.00 33 & 35 20 23.00 33;
Paragraphs 1.2.2 & 3.3.3.1; Pages 2 & 6
Down time Compensation:
This section states that Contractor will be compensated for any downtime caused by rescheduling brought about by emergency use of the dredging area by the military.
Question 1 - How can Contractors best reflect a single hourly rate for the multiple work tasks which could be impacted by an "emergency use" situation requiring a demobilization and remobilization and which each carry a significant cost difference?
Examples of planned work tasks which have significant costs differences include crane barges used for deploying and retrieving framed silt fence, divers for removal of non-hazardous anomalies, dredger and transport barge during actual dredging operations.
Question 2 - Will the hourly rate(s) also apply to time associated with demobilizing and remobilizing, or will the hourly rate(s) be applied only to the time the Government uses the dredging area under the "emergency use" provision?
Question 3 - To safely shut down work operations and demobilize due to an "emergency use" situation a minimum of six
(6) hours would be needed. How much advance notice can Contractors expect to receive in an "emergency use" situation?
Question-1:
The hourly cost of dredging work should be reflected as down time.
Question-2:
The hourly rate(s) will be applied all the effort of the time for Government uses the dredging area under the "emergency use" provision.
Question-3 The Government intends to issue the "Suspension of Work Order" 14 calendar days prior to suspend the Contractor's work.
See spec 01 14 00. 00 33 page 2, para 1.2.2 Government Emergency Use Scheduling Requirements.
Sec 35 20 23.00 33; Para. 1.13.1;
Site Investigations:
Electromagnetic surveys are required to be conducted prior to dredging and surveys are more effective if conducted when there aren't any berthed crafts in the way; will the Government have all watercrafts cleared from the area to be surveyed or are Contractors expected to work around them?
The Electromagnetic surveys is performed when the ship is not berthed. The Port OPS will coordinate the ship operations in India Basin to enable Contractor to complete the Site Investigations works within 90 days.
See spec 01 11 00. 00 33 SUMMARY OF WORK, para 1.4.1.2 Sequence Work.

The planned water depth (MDD) is -10.67m; however, there are shallow parts around the current construction area. Considering the measurement error, there is a high possibility that the hydrographic survey would not pass. Can the depth change to - 10.9m? (Refer to the colored area, especially the red circles in the Attachment No.1)
No, the depth can’t change. Follow the drawing.
The dredging sediment area is based on the hydrographic survey data on 2015 and reference purpose only.
Dredging volume and area are government assumption based on the hydrographic survey data on 2015 and sediment rate for 2020.
Contractor needs to determine the actual dredging area by hydrographic survey and submit the hydrographic report.
DWG
C-101~105
In the areas that are approximately 20 m indicated in the corners of the map: between berth No.1 and No.2, berth No.6 and No.7, and berth No.9 and No.10; silt containments and turbidity protection floating frames will be in contact with both berth sides, which makes it difficult to conduct the dredging work. Are we able to conduct the dredging work without using the floating frames for these areas? In that case, the silt containments and turbidity protection curtain will be installed between the dreading ship and the quay. (Please refer to the red circles A&B in the Attachment No.2)
Contractor must uses the floating frame to perform the dredging work.
Follow the drawing.
Can the dredging ships (sand-carrying barge, tag boat, and etc.)
berth daily in India Basin after the work is completed? Also, there is no quay in Sasebo city where sand-carrying barges can be moored at all times. Is it possible to secure a place where we can moor these barges in India Basin?
Yes, it is possible if there is no impact with ship operation and it is approved by Port Ops.
See 01 14 00. 00 33 Para. 1.3.2(g); Page 4
C-304 Could the government provide us with detailed drawings such as cross-sections of the areas that are marked as red circles in the attached drawing? We would like to confirm the structures on the quay wall side. (Please refer to the Attachment No.3)
Yes.
See Attachment (5)
Under this project, coordination with ships from the SSK area will be required. Will the Government be responsible for the ship coordination?
Yes, Government will coordinate with SSK.
01 14 00.00 33 Para 1.2.1(1)
It is mentioned that the Contractor must not work on a berth when ship is berthing. Does this mean that if one ship is berthing in India Basin, we cannot conduct work on all berths? Are we able to work on the other areas where the ship is not berthing?
Contractor is able to work on the other areas (berth) where ship is not berthing.
01 11 00. 00 33 Para1.4.1
The construction period has been changed to 630 days. If we sign the contract by the end of September, the estimated time of completion for the work would be around June 2023. Based on the previous dredging project, it will normally take 5 to 6 months to complete the documents such as the quality control, safety, environment protection, and diving plan, etc.
Therefore, on-site construction work will not be able to start until March 2022. Considering the optional dredging work, the whole dredging work will take approximately 6 months. We also consider the movement period of the ships. With that information, we would like to request an extension until March 2024 for the completion of work.
The construction period is not changed. Follow the Spec section 01 11 00. 00 03 Project schedule and time constraints.
Performance periods can typically be changed after award due to:
- Differing (unforeseen) site conditions in accordance with 52.236-2 Differing Site Conditions
- Changes to the specifications (or changes from what the specification required) in accordance with 52.243-4 Changes
- Unforeseeable cause beyond the control and without the fault or negligence of the Contractor in accordance with 52.249-10 Default.

Regarding the closeout submittals, should we prepare the bathymetries for each dredging area in both meters and feet? In the previous dredging project for the Juliet Basin, we only prepared it for meters.
Yes, the both meters and feet are required. See drawing C-001, General description of work, Scope No2 and Spec 35 20 23.00 33 para3.6 hydrographic survey.
35 20 23. 00 33 Para3.1.1 Para3.3.1.1
In this paragraph, it is mentioned that prior to start of dredging work verify locations of magnetic anomalies, and detect any magnetic debris and unexploded ordnances (UXO) by towing a magnetic probe, having 2 meter depth detecting capability. It would be okay to use the suspended-type small boat that we used in the previous dredging project instead of using the towed-type?
Yes, contractor can decide the boat type.
35 20 23. 00 33 Para1.2
SD-11
Para3.6
In the paragraph 3.6, hydrographic survey, it is mentioned that the Contractor must submit reports and drawings including depths and contours in meters and feet, rounded off to first decimal place;
however, are we allowed to submit the reports rounding off to second decimal place?
No, it does not allow. Follow the Spec Section 35 20 23. 00 33, Para1.2 SD11 Para3.6.
35 20 23. 00 33 Para3.6.2
In the method of measurement, it is mentioned that the material removed will be measured by cubic meter in place, by means of soundings taken before and after dredging. Survey will be taken by 200 kHz sonic methods, and additional lead line survey upon requested by the Government. We assumed that the material removed should be measured by square meter not by cubic meter?
Also, could survey be taken by 400 kHz (Multi)? We think that it would be better to measure the depth with multi. (prior to construction and after completion)
1. The dredging sediment volume was measured by cubic meter.
2. Contractor can decide the method of measurement if the requested depth information is provided.
Sec 01 14 00.00 33; Para.

If a contractor will not be awarded, can the same contractor work on this contract as a subcontractor?
Yes
Section 01 11
00.00 33 1.4.1.2
If the dredging work is carried out for multiple years, the dredging range will be used even during the work exclusion period (4/1 ~ 10/31). Therefore, there is a possibility that the range where the work has already been completed at the planned water depth will be reworked. Is it possible to deliver the dredging completion range every year?
Regarding to "Work Sequence-3, dredging work", it is possible to complete for each work sequence area if the post hydrographic survey and hydrographic survey for JCG chart edit are completed and confirmed required depth. See Section 01 11 00. 00 33, para1.4.1.2 Sequence work table.
Section 01 32
16.00 33 Page 6 1.5
This is a question when annual inspection is not possible.
Is the rework that occurred during the period from April 1st to October 31st allowed to be subject to the delay covered by the contract change (Section 01 32 16.00 33 Page 6 1.5)?
If the dredging depth isn't reached to required depth, contractor needs to rework with contractor's responsibility.
DWG
