Unacceptable (U) will be assigned to each offeror’s non-price factors proposal.

The following adjectival ratings and rating descriptions will be used to assign an overall rating to each technical proposal and to assign a rating for each technical factor. Use upper case letter ratings for major technical factors as well as the overall rating. The addition of plus (+) or minus (-) to an adjectival rating is not allowed.

Past Performance shall be evaluated when using the LPTA process, unless waived by the PCO in accordance with FAR 15.101-2(b). Past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in the following table:

Past Performance Evaluation Rating Method

Adjectival Rating Description

Unacceptable (U)

Based on the offeror’s performance record, the Government does not have reasonable expectation that the Offeror will be able to successfully perform the required effort.

*Offerors lacking past performance information on other task orders under this MACC will not be evaluated favorably or unfavorably in past performance and will receive a Neutral Confidence rating.

I. EVALUATION FACTORS FOR AWARD

The proposed task order will be awarded to the responsible offeror offering the best value to the

Government. To determine Best Value, the Government shall evaluate following:

PHASE I -

Factor 1 – Past Performance

PHASE II –

Price

This will be a single-phase procurement.

This procurement will be solicited in two phases. Phase I will evaluate the non-cost/price evaluation factors to determine technical acceptability. Offerors who are rated Acceptable overall for the non-cost/price evaluation factors will be determined within the competitive range. Only those Offerors determined to be in the competitive range shall submit a price proposal. Offerors who are rated

UNACCEPTABLE will be ineligible to proceed to Phase II.

PHASE I - NON-COST/PRICE EVALUATION FACTOR

Factor 1 – Past Performance:

(i) Solicitation Submittal Requirements:

• Non-cost factor proposal shall be submitted in .PDF searchable format.

• Cover page with solicitation number, solicitation title, offeror name, address, phone number, fax number, Unique Entity Identifier (UEI) in SAM, CAGE code, Point of Contact (POC), POC phone number, and POC email address;

• All amendments acknowledged;

• Copy of Representation and Certifications and proof of registration in System for Award

Management (SAM);

• Confirmation of filing of Veterans’ Employment and Training (VETS) VETS-4212 for the

2022/2023 filing cycle;

Offerors do not need to provide any information under this factor as the Government will base the evaluation on known past performance on task orders awarded under this Multiple Award Construction

Contract (MACC). However, Offerors may provide any information on problems encountered and the corrective actions taken on task orders under this MACC. Offerors may also address any adverse past performance issues under this MACC. Explanations shall not exceed four pages, 8 ½” x 11” in total and the document should be in searchable PDF format.

(ii) Basis of Evaluation:

Based on the Offeror’s performance record under this MACC, the Government will review past performance evaluations to determine whether performance reflects a trend of satisfactory performance.

The Government will rate the confidence in the Offeror’s ability to successfully perform the required effort.

This evaluation focuses on how well the Offeror performed on projects under this Multiple Award

Contract. More emphasis will be placed on task orders that are more similar to the RFP. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System

(PPIRS), inquiries of owner representative(s), Federal Awardee Performance and Integrity Information

System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.

The Government will consider the currency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the

Offeror’s past performance will be used as a means of evaluating the Offeror’s ability to successfully meet the requirements of the RFP.

Phase II - Price (Competitive Range Only)

Price

i) Solicitation Submittal Requirements:

Price shall be submitted on the Price Proposal Form included in the solicitation. The offeror shall submit one (1) original PDF separate from the non-cost/price factors submission.

• Cover page with solicitation number, solicitation title, offeror name, address, phone number, fax number, Unique Entity Identifier (UEI) in SAM, CAGE code, Tax ID Number, Point of Contact

(POC), POC phone number, and POC email address;

• All amendments acknowledged;

• Price Proposal Form – Attachment F – provided in Phase 2;

• Bid Guarantee in accordance with FAR Clause 52.228-1, Bid Guarantee. Amount shall be at least

20 percent of the proposed price, but shall not exceed $3 million;

• Small Business Subcontracting Plan – Attachment G – template provided in Phase 2

• Copy of Representation and Certifications and proof of registration in System for Award

Management (SAM); and

• Confirmation of filing of Veterans’ Employment and Training (VETS) VETS-4212 for the

2022/2023 filing cycle

The offeror is required to submit a complete Price Proposal Form that includes completion of all contract line items numbers (CLINs). All required proposal documents shall be submitted in accordance with FAR

15.208.

(ii) Basis of Evaluation: The Government will evaluate price based on the total lump sum price. Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

a. Comparison of proposed prices received in response to the RFP.

b. Comparison of proposed prices with the Independent Government Cost Estimate (IGCE).

c. Comparison of proposed prices with available historical information.

d. Comparison of market survey results.

II. EVALUATION

1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the Offeror submitting the lowest price technically acceptable proposal.

2. The Government intends to evaluate proposals and award a contract without discussions with offerors

(except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the

Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

3. The lowest price technically acceptable process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. Proposals will initially be screened for technical acceptability by evaluation of the non-cost/price factors proposal. The Navy will determine the competitive range to include those who received an overall rating of ACCEPTABLE for the non-cost/price factors, or as otherwise determined by the

Contracting Officer. Offerors in the competitive range will be invited to submit a price proposal for Phase

II evaluation. Award will be made to the responsible lowest price proposal submitted in Phase II.

3. The lowest price technically acceptable process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. Proposals will initially be screened for price and placed in order (lowest price to highest price). The Navy will then evaluate the technical factors of the lowest priced proposal. The Navy will make award to the lowest priced technically acceptable proposal from among the awardable proposals unless discussions are deemed necessary. However, the Navy, at its sole discretion, reserves the right to increase the number of proposals it will review under this methodology. If the first proposal reviewed is not found technically acceptable, the Navy will review the next lowest-priced proposal (unless a different number is deemed appropriate as noted above) and continue to evaluate using this methodology.

Accordingly, under this methodology, the technical factors of some proposals may not be evaluated by the Navy. If discussions are deemed necessary by the Contracting Officer, all proposals will be evaluated

(both technical and price) for the purpose of establishing a competitive range. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An

“UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated

“UNACCEPTABLE” unless corrected through discussions.

An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

Any proposal found to have a Deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award unless the Deficiency is corrected through discussions.

Proposals may be found to have either a Significant Weakness or multiple Weaknesses that impact either the individual factor rating or the overall rating for the proposal. The evaluation report must document the evaluation board’s assessment of the identified Weakness(s) and the associated risk to successful contract performance resulting from the Weakness(s). This assessment must provide the rationale for proceeding to award without discussions.

Offerors shall submit electronic proposals (.pdf format) in response to this solicitation.

Offerors shall ensure that the Government has received the electronic proposal prior to the date and time specified.

Offerors shall allow adequate time to upload files which may be slower for non-DoD users and to avoid other technical difficulties that may be encountered. Offerors are also responsible for submitting files in the format specified and consistent with requirements stated elsewhere in this solicitation. Files that cannot be opened or are otherwise missing the required content are the responsibility of the Offeror.
